2015-07-21 Draft Local Law - PUD LOCAL LAW AMENDING CHAPTER 250 OF THE VILLAGE OF RYE BROOK CODE A LOCAL LAW to amend Chapter 250 of the Code of the Village of Rye Brook concerning regulations in the PUD District. BE IT ENACTED, by the Board of Trustees of the Village of Rye Brook, as follows: SECTION 1. Subsection E of Section 250-7 of Chapter 250 of the Village of Rye Brook Code, titled “Zoning”, is hereby amended as follows: (3) Authority. The Village Board shall be the municipal authority designated to grant approval for rezoning to a PUD District, as well as the PUD concept plan, after recommendation of the Planning Board. The Village Board shall retain the jurisdiction to waive, in whole or in part, dimensional requirements of the Zoning Ordinance to allow for flexibility of design in the site plan, including but not limited to: (a) the standards and requirements set forth in section 250-7.E.(2)(d)[1] may be waived, in whole or in part, to permit additional floor area to be developed in such PUD development, beyond the 9,000 square foot limit, if the development provides Affordable Housing equivalent to ten (10) percent in number of the market-rate dwelling units in such development, provided that such Affordable Housing is so restricted for a fifty (50) year term consistent with the 2009 Stipulation and Order of Settlement and Dismissal in the case of United States of America ex rel. Anti-Discrimination Center of Metro New York, Inc. v. Westchester County, New York and is marketed in accordance with the terms of said settlement. (b) The buffer areas set forth in section 250-7.E.(2)(e) may be reduced where the PUD development abuts commercial office improvements. SECTION 2. This Local Law shall take effect immediately upon filing in the Office of Secretary of State.
