2018.11.01 Village of Port Chester ResolutionRESOLUTION VILLAGE OF PORT CHESTER BOARD OF TRUSTEES COMMENTS ON PROPOSED SENIOR HOUSING PROJECT AT 900 KING STREET IN THE �LLAGE OFRYEBROOK On motion of TRUSTEE DIDDEN, seconded by TRUSTEE FERRARA, the following resolution was adopted by the Board of Trustees of the Village of Port Chester, New York: WHEREAS, King Street (New York State Route 120A) is a vital north-south corridor serving the Villages of Port Chester and Rye Brook, the Town of New Castle, and that provides access to Westchester County Airport; and WHEREAS, traffic volumes on King Street have significantly increased in recent years, particularly from the interchange of the Hutchinson River Parkway/Merritt Parkway to North Regent Street/Putnam A venue; and WHEREAS, as a result, the Village is concerned about any new development, whether within the Village of Port Chester, or in neighboring communities, that may have an impact on King Street within the Village; and WHEREAS, based upon the increased traffic volumes, on December 18, 2018, the Board of Trustees authorizing the Mayor to request assistance in securing from the New York State Department of Transportation (NYSDOT) an assessment of traffic conditions on King Street; and WHERAES, based upon the increased traffic volumes and roadway geometry, on January 16, 2018, the Village of Port Chester Board of Trustees ("Board of Trustees") authorized the preparation of a traffic study for the King Street, Indian Road, and Quintard Drive intersection; and WHEREAS, on June 4, 2018, the Village received an application for the subdivision of the propetiy located at 1 Betsy Brown Road into two (2) single-family lots; and WHEREAS, as part of the subdivision application, the Village requested that a traffic analyses be completed given the concerns regarding the Betsy Brown Road/King Street intersection; and WHEREAS, in a memorandum dated July 12,2018, the Village's consulting traffic engineer, AKRF, Inc., states that "the Proposed Project could be expected to generate an additional one to two vehicle trips during a peak hour with a second single-family home on the property. The level of project generated traffic is minimal and would not be expected to cause impacts to traffic in the area"; and WHEREAS, in a memorandum dated August 13,2018, AKRF states: "A review of the traffic and pedestrian volumes and crash data indicate a signal is not warranted at this location."; and WHEREAS, both the Village of Port Chester Planning Commission and Board of Trustees have held public hearings on the proposed subdivision; and WHEREAS, at these public hearings, members of the public, as well as Planning Commissioners and Trustees have expressed their concern regarding the King Street and Betsy Brown Road intersection; and WHEREAS, the Village has obtained public notice of the public hearing scheduled by the Village of Rye Brook Board of Trustees to consider (i) a petition for amendments to Village Zoning Code §250-7.E (Planned Unit Development District) to permit the redevelopment of an existing office building property in the PUD District, with 269 senior housing units that include 160 independent living units, 85 assisted living units and 24 townhomes, (ii) an application for PUD Concept Plan Approval for such redevelopment at 900 King Street (Parcel ID 129.68-1-13), west of the intersection of King Street and Arbor Drive, and (iii) a Draft Environmental Impact Statement (DEIS) for the proposed amendments to the Village Code and redevelopment of 900 King Street ("the Project"); and WHEREAS, the public hearing is scheduled for October 22, 2018 and comments on the DEIS will be accepted until November 1, 2018 or until at least 10 days after the close of the public hearing; and WHEREAS, as indicated in the DEIS, the project is a Type I action under the New York State Environmental Quality Review Act ("SEQRA"); and WHEREAS, the Village of Port Chester is an Interested Agency under SEQRA for the purposes of review of the DEIS; and WHEREAS, as an Interested Agency, the Village should have been noticed properly at the outset of the SEQRA process to allow for comment on the project and the DEIS scope; and WHEREAS, Village staff and its consultants have reviewed the DEIS. NOW, THEREFORE, be it RESOLVED, that the Board offers the following comments: 1. The Traffic Impact Study and DEIS should examine the following additional intersections: a. King Street (Route 120A) and Indian Road/Quintard Drive b. King Street (Route 120A) and Putnam Terrace/Putnam Avenue 2. A traffic signal should be provided at the intersection of King Street (Route 120A) and Betsy Brown Road. 3. A traffic meeting between the Village of Port Chester and Village Rye Brook, hosted by NYSDOT should be scheduled, similar to a series of meetings that NYSDOT hosted with the two Villages and the City of Rye regarding the redevelopment of the United Hospital site. 4. More information should be provided regarding the potential of a shuttle to and from the project to potentially the Port Chester train station as this could potentially not only impact King Street, but the area in and around the train station and downtown. 5. Additional discussion should occur regarding the potential impact of the project on fire services and the April3, 2018 agreement between the Village of Port Chester and Village of Rye Brook. 6. The Village of Port Chester Board of Trustees should be included as an Interested Agency for all future correspondence on this project and the fourth page of the Cover Page of the DEIS should be revised to reflect so; and be it finally RESOLVED, that the Board authorizes the Mayor or his designee to attend the public hearing on October 22,2018 to provide these comments to the Village of Rye Brook Board of Trustees.
