2019.06.14 HDR Environmental Review Technical Memo hdrinc.com Use UPDATE/INSERT ADDRESS feature in ribbon 1 Environmental Review Technical Memo Date: Friday, June 14, 2019 Project: 900 King Street Redevelopment preliminary Final Environmental Impact Statement To: Marilyn Timpone Mohamed From: HDR: Noemi Castillo, Joshua Gillespie, Michael Musso Subject: Technical Review of Air Quality, Noise and Hazardous Materials Responses and Recommendations for Permit Conditions As requested, Henningson Durham & Richardson Architecture and Engineering, PC (HDR) performed a technical review of the 900 King Street Redevelopment preliminary Final Environmental Impact Statement (pFEIS) dated May 14, 2019. The pFEIS was submitted by Rye King Associates, LLC to the Village of Rye Brook Board of Trustees as part of a petition to amend Section 250-7 E, Planned Unit Development (PUD) regulations of the Village Code and an application for a PUD Concept Plan regarding the property located at 900 King Street, Town of Rye. The Proposed Action would construct age-targeted housing and related infrastructure, including driveways, walkways, garage and surface parking, site lighting, signage and stormwater management facilities. HDR, on behalf of the Village Board of Trustees, conducted a review of the Air Quality, Noise and Hazardous Materials sections of the Applicant’s response to comments provided by HDR and the public on the Draft Environmental Impact Statement (DEIS). The results of HDR’s review are identified in the attached Table of Responses to HDR and Public Comments Verification and do result in some additional information/revisions required from the Applicant. Separately, a list of recommended conditions for the permits/approvals for the project has been provided below, also. Recommended Conditions for Permits/Approvals It is HDR’s understanding that the Applicant has requested separate approvals to demolish existing structures prior to the conclusion of the State Environmental Quality Review Act (SEQRA) process, but before final site plan approval so as to minimize the impact on the Blind Brook Middle School and High School. In this case, it should be noted that HDR’s comments and recommendations regarding construction activities are inclusive of the demolition activities and should therefore also be considered prior to approval for demolition. hdrinc.com Use UPDATE/INSERT ADDRESS feature in ribbon HDR recommends that the following conditions to be included in the permits/approvals for the project: • Generators should not be placed on the east side of the project site to avoid disturbance to receptors in that area, including the Village Hall, Rye Brook Police Department and Rye Brook Fire Department. • The days of the week and time of day restrictions during construction and demolition. It is recommended that the permits/approvals for the proposed project restrict construction and demolition hours to Monday through Saturday and not allow construction or demolition to occur during evening and overnight hours. • On Saturday mornings until noon and on Sundays all day, no work shall be performed that increases the noise levels greater than 3 dBA. • The air quality and noise control measures presented in the DEIS and pFEIS to be implemented during construction and demolition. • Preparation of a detailed Construction Management Plan (CMP), which would provide for implementation of the proposed construction plan and the measures proposed to mitigate potential adverse impacts. These mitigation measures should be adhered to during construction and demolition activities. • Equipment predicted to increase noise levels at the property boundary by more than 6 dBA or to a noise level greater than 65 dBA should be required to include path controls. • A vibration monitoring program at The Arbors community and at the Tennessee Gas Pipeline during demolition of the existing office building to ensure that vibration levels do not exceed the thresholds that could potentially result in damage to adjoining property, utilities, etc. during construction and demolition. • Preparation of a Materials Management Plan prior to demolition and for implementation during construction and demolition that includes specific plans for monitoring (visual or instrumentation) with action levels and includes the appropriate responses outlined. • Provide the Village with a copy of the pre-demolition ACM/LBP surveys as well as provide progress reports.
