Dear Ms. Paterno,
Thank you for the revised survey.
Unfortunately, the survey shows that the pool was constructed such that a side yard setback variance is
required. The minimum required setback is fifteen (15) feet from a property line to the pool water's edge, and
the survey indicates that the pool was constructed 13 feet from the property line.
In order for the Building Department to close this permit the property owner(s) must:
1. File an Application for Certificate of Occupancy and remit the $110.00 C/O fee.
2. Upon issuance of the Notice of Disapproval by this office for the zoning inconsistency file an
application to appear before the Zoning Board of Appeals in accordance with Village Code.
3. Retain the services of a Westchester County Licensed Electrician to perform an electrical survey of
any associated electrical wiring and devices. If repairs are needed, he must file for an electrical permit
in the usual manner.
4. Provide documentation from their pool service company that the pool has been retrofitted with code
compliant entrapment protection including the manufacturer's specifications and installation
instructions for the specific entrapment protection installed.
