Since the rear framed structure on your property is less that 18 inches above grade and was constructed prior to 8/26/03, it does not qualify as a deck as per the code in effect at the time of construction. Therefore, is not subject to any code requirements pertaining to decks, other than the property maintenance code for upkeep in a state of good repair.
