HomeMy WebLinkAbout1998-04-21 - Board of Trustees Meeting Minutes 006-/03 MINUTES OF A BOARD MEETING VILLAGE OF RYE BROOK BOARD OF TRUSTEES VILLAGE HALL 938 KING STREET RYE BROOK, NEW YORK APRIL 21, 1998 7:30 p.m. CONVENE MEETING The Board Meeting was called to order at 6:30 p.m. by Mayor Filipowski in the Meeting Room and the Pledge of Allegiance followed. The following members of the Board of Trustees were present: Mayor Francis L. Filipowski Trustee Donald E. Degling Trustee Joseph Pellino Trustee Eugene R. Strum Trustee Gary J. Zuckerman Village staff attending the meeting were: Village Administrator Christopher J. Russo Deputy Treasurer Diane DiSanto Certiorari Attorney Mark Tulis The Board discussed the resolution regarding the Village's concerns as a party to the IDA financing and tax agreement for the Doral/Arrowwood Pfizer Conference Center Development proposal. On the motion of Trustee Strum, seconded by Trustee Pellino, the following resolution was adopted: RESOLUTION CONDITIONAL OBJECTION TO WESTCHESTER COUNTY IDA FINANCING OF THE ARROWWOOD/PFIZER PROPOSAL. WHEREAS, on or about March 24, 1998, the Westchester IDA gave the Village of Rye Brook a notice under Section 923-a of the General Municipal Law of the anticipated financing of the Pfizer management training center at the Arrowwood Conference Center, as to which notice the Village is afforded 30 days to respond; and WHEREAS, on April 8, 1998 the County of Westchester unexpectedly raised certain issues concerning the settlement of the Arrowwood tax certiorari cases, which settlement is related to the Westchester IDA notice; and WHEREAS, the Westchester IDA notice has not been withdrawn and the Village believes it may, unregrettably, be necessary to issue this objection to preserve the Village's rights, if in the event that the following documentation satisfactory to the Village special tax counsel is not received by 5:00 p.m. 0 6 70,1 April 21, 1998 E.D.T. on Wednesday, April 22, 1998: 1. Agreement from the Westchester Industrial Development Agency(IDA) that it will not take title to the above referenced project without a Payment in Lieu of Taxes Agreement (PILOT). Such PILOT must have the written approval of the village of Rye Brook, and 2. A letter satisfactory to the Village Special Tax Counsel from Doral Arrowwood agreeing to an adjournment of the tax certiorari cases, for six (6) months. NOW THEREFORE BE IT RESOLVED, that the Village of Rye Brook objects to the use of Westchester IDA funds to commence the project which is the subject of the notice to the Village dated March 24, 1998, and the Village Administrator shall deliver a copy of this objection to the Westchester County IDA within the time required by law, unless the conditions set forth above are satisfied.
