The following members of the Board of Trustees were present: Mayor Salvatore M. Cresenzi Trustee Joseph Pellino Trustee Eugene R. Strum Trustee Nancy Stein Tunis Trustee Gary J. Zuckerman Village staff attending the meeting were: Village Administrator Christopher J. Russo Village Attorney Kenneth E. Powell Assistant to the Administrator Richard C. Slingerland RESOLUTIONS: The Mayor proceeded with the agenda and asked the Village Administrator to read the first item. On a brief discussion by the Board members, it was agreed that a call for a public hearing would not be approved at this meeting. 1. REFERRING LOCAL LAW INTRO. 3 -- 1998 PROPOSING A CHANGE IN THE RYE BROOK ZONING CODE WITH REGARD TO BUILDING HEIGHT TO THE PLANNING BOARD FOR A REPORT AND RECOMMENDATION AND CALLING FOR A PUBLIC HEARING ON SAID LAW FOR FEB. 24, 1998. On the motion of Trustee Strum, seconded by Trustee Tunis, the Board agreed to refer the following local law, as amended, to the Planning Board: RESOLVED, that the Board of Trustees hereby refers Local Law#3 entitled, "A LOCAL LAW amending Section 250-2 of the Code of the Village of Rye Brook in relation to the zoning definition of the height of a building," to the Planning Board for a report and recommendation. BE IT ENACTED by the Board of Trustees of the Village of Rye Brook as follows: Section 1. Section 250-2 of the Code of the Village of Rye Brook is amended to revise the definition of"Height of Building" to read as follows: HEIGHT OF BUILDING- The vertical distance to the level of the highest point of the roof's surface, if the roof is flat or mansard [inclines not more than one (1) inch vertical in one(1) inch horizontal], or to the mean level between the eaves and the highest point of the roof, if the roof is of any other type, measured from the average level of the finished grade adjacent to the exterior walls of the building. Where the finished ground surface is made by filling, the level of such finished grade, for the purpose of this definition, shall not be deemed to be more than three(3) feet above the established grade of the curb. Section 2. This local law shall take effect immediately upon filing in the Office of the Secretary of State. 2. CHECK REGISTER. On the motion of Trustee Pellino, seconded by Trustee Tunis, the following resolution was adopted: RESOLUTION WHEREAS, the following checks, representing payment for services rendered, have been submitted to the Treasurer's Office and Budget Officer for payment: On-Line Checks 18003-189071 Environmental 130 & 131 NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees after audit hereby approves payment of the above- mentioned claims and authorizes payment thereof. MINUTES: On discussion by the Board, it was agreed that the September 9'minutes would be amended to include Trustee Strum's statement. It was also agreed that the September 23`" minutes would be amended to correct and clarify the comments made by Trustee Zuckerman. On the motion of Trustee Strum, seconded by Trustee Zuckerman, the following minutes were approved and adopted as amended: 3. SEPTEMBER 9, 1997 AGENDA MEETING. 4. SEPTEMBER 23, 1997 .REGULAR MEETING. 5. NOVEMBER 18, 1997 BOARD MEETING. On the motion of Trustee Tunis, seconded by Trustee Pellino, the board unanimously agreed to enter into Executive Session on Personnel issues.
