SUBDIVISION APPLICATION HOWARD LOWENTHEIL, INC., 6 HAWTHORNE AVENUE SECTION 1, BLOCK 15, LOT 38 1 f i I I i i i i 005403 MINUTES OF A SPECIAL MEETING VILLAGE OF RYE BROOK BOARD OF TRUSTEES VILLAGE OFFICES 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK JULY 14, 1994 CONVENE MEETING The Meeting was called to order at 7:00 p.m. by Mayor Cresenzi in the Meeting Room and the Pledge of Allegiance followed Present were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Michele Daly Trustee Joseph Pellino Trustee Randy A. Solomon Trustee Gary J. Zuckerman Also present were: Christopher J. Russo, Village Administrator Lori Ann DeMarco, Assistant to Village Administrator Rocco V. Circosta, Director of Public Works Kenneth E. Powell, Village Attorney Thomas Gissen, Frederick P. Clark Associates Village Treasurer, Joseph Cortese was not in attendance. 1 005401 July 14, 1994 PUBLIC HEARING 1. SUBDIVISION APPLICATION HOWARD LOWENTHEIL, INC., 6 HAWTHORNE AVENUE SECTION 1, BLOCK 15, LOT 38 1 Mayor Cresenzi opened the public hearing at 7:00 p.m. Thomas Gissen, of Frederick P. Clark Associates gave a brief overview of a memo written by him which was read as part of the official record. In short, Frederick P. Clark Associates does not recommend approval of this application. (See Attachments) Peter Murray, owner of the property in question, 6 Hawthorne Avenue, stated that he feels as though he is in Kangaroo Court. He added that he also feels that the Board Board since it "in its infinite wisdom" suspend moratorium. He informed the Board that he intends to ask the Court to grant a preliminary site plan. Dr. Gentile of 25 Hawthorne Avenue discussed a number of issues related to the new zoning area and the area of non-conformance of subdivision. He stated that he upholds the decision of the Village of Rye Brook Board of Trustees on rezoning as the prior zoning was clearly inappropriate as the residents own study showed this. True law applicability would have needed to be addressed and it was totally overlooked in the application before the Board. Dr Gentile commented on the item in the EAF and stated that the plan was inaccurate and obsolete. On Motion made by Trustee Zuckerman, seconded by Trustee Solomon, the public hearing was closed at 7:38 p.m. with a resolution to be prepared for the July 26, 1994 meeting.
