REGULAR MEETING TUESDAY, APRIL 26, 1994 - 7:30 P.M. 00,5229 j MINUTES OF A SPECIAL MEETING VILLAGE OF RYE BROOK BOARD OF TRUSTEES i VILLAGE OFFICES 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK APRIL 4, 1994 i CONVENE MEETING The Meeting was called to order at 5:35 p.m. by Mayor Cresenzi in the Conference Room and the Pledge of Allegiance followed. jPresent were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Michele Daly Trustee Joseph Pellino Trustee Randy A. Solomon Trustee Gary J. Zuckerman Also present were: Christopher J. Russo, Village Administrator Lori Ann DeMarco, Ass't to Village Administrator Rocco V. Circosta, Director of Public Works Kenneth E. Powell, Village Attorney Elizabeth Bottali, Secretary to Village Board Joseph Cortese, Village Treasurer, was not in attendance at this meeting. 1 005230 April 4, 1994 I Mayor Cresenzi asked Director of Public Works, Rocco Circosta to speak about the Sign Law. Mr. Circosta referred to a memo he wrote pertaining to the amendment to floor signs at 200 South Ridge Street and explained that as part of the further requirement of the Resolution the signs have to be approved by the Board of Trustees. Trustee Pellino stated that Lenny's Bagel's sign is planning to take the maximum allowed footage. It also means that he is using 100% of allowable wall sign usage on that particular sign. He is allowed up to 12 square feet of window signage or x amount of feet of some other kind of signage. If he uses 1.00% of his maximum allowed on window signs he can have no other type of sign at all. Trustee Pellino suggested that we advise the applicant of this. Mayor Cresenzi stated that the applicant must file for the permit and when Mr. Circosta issues the permit he will politely inform the applicant what space is left under the ordinance, so there will be no misconception later on. Mr. Circosta informed the Board that he will contact the applicant and send a copy of the sign law. He added that Brook's Drugs has made an application for a sign, however, 1 it was denied based on the fact that it was too large. They have made an application to the Zoning Board of Appeals. It is a total of 38 square feet that they want to put up. The allowable is 30 square feet. Trustee Pellino stated that a little under a 25% variance would be needed. Under the terms of the Resolution all applications come to the Board of Trustees for approval. Under normal circumstances, the applicant would go to Rocco and he would decide whether it meets the code or not. The denial of the permit automatically means he goes to the Zoning Board of Appeals. Trustee Pellino questioned, if from a legal standpoint in light of the Resolution, can we require Brook's Drugs to make the application to the Board of Trustee's ? Mayor Cresenzi stated that if they did that and made the application to the Board of Trustees we would be powerless to approve it because we could not grant the variance, only the Zoning Board of Appeals can do that. The only thing that we can do is to deny it. If the Zoning Board of Appeals approves it, we could not deny it. Trustee Pellino stated that is why he believes the application should come to the Board of Trustees, under the terms of the Resolution. It should come to the Board, we should deny it and have representation at the Zoning Board of Appeals meeting. 2 005231. April 4, 1994 Trustee Zuckerman stated that since we can only deny it, Rocco's denial is an administrative function and the proper thing to do is to go to the Zoning Board of Appeals, where the Board of Trustee's is represented by Village Counsel. Mayor Cresenzi informed the Board that they must coordinate between Rocco and Ken when it is before the Zoning Board of Appeals. Trustee Zuckerman added that he believes we should formally retain Ken Powell to do this rather than him appearing without a formal resolution from the Board. Rocco Circosta informed the Board that an application has been filed by Brook's Drugs for the May meeting of the Zoning Board of Appeals. Twenty to twenty five days are required to get an application on the calendar. Therefore the earliest we can hear this case if we don't act on it will be in June. Mayor Cresenzi stated that that would give the Board plenty of time to act on it. Rocco Circosta added that the applicant has to be informed that this is the case. The applicant has filed in time for the May meeting. Trustee Zuckerman stated that when the Zoning Board has the official calendar and the Board of Trustees is advised, we need to pass a Resolution. ENACTING LOCAL LAW #5-1994 TO EXTEND THE INTERIM DEVELOPMENT LAW OF THE VILLAGE OF RYE BROOK FOR THE HAWTHORNE AVENUE AREA FOR 3 MONTHS On Motion made by Trustee Pellino, seconded by Trustee Daly, the following resolution was hereby adopted: RESOLUTION ' ENACTING LOCAL LAW #5-1994 TO EXTEND THE INTERIM DEVELOPMENT LAW OF THE VILLAGE OF RYE BROOK FOR THE HAWTHORNE AVENUE AREA FOR 3 MONTHS RESOLVED, that the accompanying Negative Environmental Declaration is hereby adopted for Local Law Introductory #5-1994; and be it FURTHER RESOLVED, that Local Law Introductory #5-1994, the Interim Development Law of the Village of Rye Brook for the Hawthorne Avenue area, is hereby enacted into law. Administrator Russo informed him that they are filled out except for one section. Trustee Pellino asked Planning Consultant Thomas Gissen if the Planning Board is going to be discussing the rezone at their April meeting. 4 April 4, 1994 Mr. Gissen informed him that it is on their Agenda.
