HomeMy WebLinkAbout1995-11-28 - Board of Trustees Meeting Minutes MINUTES OF A REGULAR BOARD MEETING 005970 VILLAGE OF RYE BROOK BOARD OF TRUSTEES VILLAGE OFFICES 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK NOVEMBER 28, 1995 CONVENE MEETING: The Meeting was called to order at 7:40 p.m. in the Meeting Room and the Pledge of Allegiance followed. Present were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Nancy Stein Tunis Trustee Joseph Pellino Trustee Gary J. Zuckerman Also present were: Christopher J. Russo, Village Administrator Lori Ann DeMarco,Assistant to the Village Administrator Rocco V. Circosta, Director of Public Works Kenneth e, Powell,Village Attorney Lisa B. Marinaccio, Secretary to the Village Board Christian Miller, Planning Consultant,F.P.C.A. Mayor Cresenzi announced that the Board has been serving as a four member board and he wished to report that the Board would be appointing a new member to the Board. The new member is currently the Chairman of the Rye Brook Planning Board and has been a member of the Planning Board for nine years and Chairman for five years. Mayor Cresenzi announced that the new member is Mr.Eugene Strum and welcomed him to the Board. 1. SETTING PUBLIC HEARING ON LOCAL LAW INTRODUCTORY#4-1995 HOME OCCUPATION LAW: RESOLUTION SCHEDULING A PUBLIC HEARING LOCAL LAW INTRODUCTORY#4-1995 OME OCCUPATION LAW On motion made by Trustee Pellino, seconded y Trustee Tunis, the following Resolution was hereby adopted. RESOLVED,that a public hearing shall be held by the Board of Trustees on December 12, 1995 at 7:30 p.m., 90 South Ridge Street,Rye Brook,New York, to consider a local law amending the Code of the Village of Rye Brook to provide for the regulation of home occupations. REFERRAL TO THE PLANNING BOARD -MICHAEL NEUMAN-HILLANDALE ROAD - SF.CTION 1; BLOCK 7: LOTS 2B2 & 3112 - SUBDIVISION APPLICATION: 2 November 28, 1995 00597 1 RESOLUTION REFERRAL TO THE PLANNING BOARD MICHAEL NEUMAN HILLANDALE ROAD SECTION 1; BLOCK 7; LOTS 2112 & 3112 SUBDIVISION APPLICATION On motion made by Trustee Pellino, seconded by Trustee Tunis,the following Resolution was hereby adopted. RESOLVED,that the subdivision application by Michael Neuman of Hillandale Associates is hereby referred to the Planning Board for their review and recommendation; and it is FURTHER RESOLVED,that the applicant will pay the sum of$1,000.00 into the environmental/professional fee fund and such additional sums as may be required. CONSIDERING ROAD DEDICATIONS -LITTLE KINGS LANE AND HIDDEN POND DRIVE: Mr. Powell communicated that there is a condition regarding ministerial activities regarding property transfers which probably could be cleared up very quickly,but, nonetheless, are present now in the title report. Mr. Powell conveyed that his points are simply procedural issues to be considered by the Board, and the Board must decide whether to take the dedication as this point. Mr. Powell suggested the possibility of leaving the other issues to be handled in the future. Mr. Powell stated that the Board could also except the dedication with a further resolved in the language of the resolution referring to the ministerial activities. Mr. Mitchell Hochberg, applicant, wished to have the Board consider the dedications separately because Little Kings Lane is 100 percent complete and the Building Inspector is satisfied with the road. Mr. Hochberg requested that the Board adopt a resolution subject to the aforementioned items which can be handled by the attorneys. Mr. Circosta said that he had inspected Little Kings Lane and there were some minor punch list items (drain pipe and some curbing)that have been satisfied. Mayor Cresenzi announced that the road dedications would be done separately. Mr. Powell said that it is not necessary to have a deed to accept an offer of a road,but it is desirable for various legal reasons. W. Powell said that when a provision is placed on a subdivision map for the dedication of the road, the act of acceptance is what takes over the Road. Mr. Powell suggested that the road dedication be accepted only on certain conditions. 3 RESOLUTION November 28, 1995 005978 ACCEPT OFFER OF DEDICATION OF LITTLE KINGS LANE TO VILLAGE OF RYE BROOK On motion made by Trustee Pellino, seconded by Trustee Zuckerman,the following Resolution was hereby adopted as amended. RESOLVED,that the Road known as Little Kings Lane (formerly Messina Lane)together with the improvement therein as described in a certain title certification from Ticor Title Guarantee Company and as shown on a certain map filed in the Westchester County Clerk's office as Map No. 25265 on October 4, 1994, FURTHER RESOLVED,that said Road is hereby dedicated by Kings Street Partners,L.P.,a New York Partnership with offices c/o Spectrum Group, Ltd., 115 Stevens Avenue, Valhalla,New York 10595 to the Village of Rye Brook, a duly incorporated Village in the State of New York and upon condition that any ministerial items, and the required title acceptable to the Village Attorney will be resolved between the Village Attorney and Kings Street Partners,L.P. ANDREW GENTILE,PH.D. -HAWTHORNE AVENUE CASE: Mayor Cresenzi reported that the letter received from Dr. Andrew Gentile was a very nice letter from a resident that understood what the Village had to go through to get the possible plan for 6 Hawthorne Avenue. Mayor Cresenzi asked Mr. Russo to read the letter. APPROVAL OF MINUTES: S. JUNE 13, 1995 9. JULY 11, 1995 10. JULY 25, 1995 11. SEPTEMBER 6, 1995 12. DECEMBER BOARD MEETING: Mayor Cresenzi announced that there would be an agenda meeting on December 12, 1995, and if there was a need for a bill paying meeting thereafter,that could be decided on the evening of December 12, 1995. NEXT MEETING DATE: DECEMBER 12, 1995 7 November 28, 1995 005982,, ITEMS FOR DECEMBER 12, 1995: RESOLUTION• TRAFFIC COMMISSION RECOMMENDATIONS ON VARIOUS MATTERS: Mr. Russo reported that he would be submitting a memo to the Board because there are five or six outstanding recommendations which include; slow curve on Acker Drive,parking recommendation for Garibaldi Place, reduced speed limit recommendation,no parking change on Latonia Road and limited parking on one side on Talcott Road, Mr. Russo added that the Loewenthiel settlement should be added to the December 12, 1995 agenda. Mayor Cresenzi asked if any of the Board members or members of the public wished to comment on anything. Mr. Heller 20 Lincoln Avenue brought up traffic problem on the comer of Westchester Avenue and Bowman Avenue due to the construction of a new development. Mayor Cresenzi reported that the Senior Citizen Housing project is supposed to start Friday or Monday and there has been discussion about the need to keep the fence in place during the construction because of school children who walk across Bowman Avenue and Westchester Avenue.
