HomeMy WebLinkAbout1990-10-09 - Board of Trustees Meeting Minutes 1 001728 I MINUTES OF AN AGENDA MEETING THE BOARD OF TRUSTEES VILLAGE OF RYE BROOK i VILLAGE OFFICES 90 SOUTH RIDGE STREET i RYE BROOK, NEW YORK OCTOBER 9, 1990 CONVENE MEETING The Meeting of the Board of Trustees was called to order by Mayor Cresenzi at 8:00 p.m. in the Meeting Room and the Pledge of Allegiance followed. Present were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Michele R. Daly Trustee Francis L. Filipowski Trustee Robert J. Ravich Trustee Jane Saffir Smith Also Present were: Christopher J. Russo, Village Administrator Rocco V. Circosta, Director of Public Works Edward Beane, Village Attorney Lori Ann DeMarco, Ass't. to the Village Administrator Elizabeth Czajkowski, Secretary to the Village Board Joseph Cortese, Village Treasurer was not in attendance at this meeting. * k W k Y/y 001729 October 9, 1990 RESOLUTIONS 1. APPOINTMENTS TO THE PLANNING & ZONING BOARD On Motion made by Trustee Daly, seconded by Trustee Ravich, With a unanimous vote of the Board, the following Resolution was adopted: RESOLUTION APPOINTMENT TO PLANNING & ZONING BOARD RESOLVED, that Alan Briskman of 233 Country Ridge Drive be hereby appointed to the Rye Brook Planning Board to fill the unexpired term of Bernard Klem, to expire on April 1, 1993, and be it FURTHER RESOLVED, that John Munnick of 13 Wyman Street be hereby appointed to the Rye Brook Zoning Board of Appeals to fill the unexpired term of Rosalind Klem, to expire on April 1, 1992. Mayor Cresenzi congratulated the newly appointed Board members and welcomed them aboard. 2. BUDGET MODIFICATIONS On Motion made by Trustee Filipowski, seconded by Trustee Smith, with a unanimous vote of the Board, the following Resolution was adopted: RESOLUTION BUDGET MODIFICATION POLICE OVERTIME RESOLVED, that the following budget modification be hereby approved as follows: FROM: Contingent Account #1990.424 . . . . . $19,000 TO: Police Department Account #3120.189 . . . . . . . . . . $19,000 -2- 001 t kii - October 9, 1990 Administrator Russo explained that the following Resolution was an accumulation of past salary settlements. PROCLAIMING OCTOBER 1990 SUBSTANCE ABUSE AWARENESS MONTH On Motion made by Trustee Ravich, seconded by Trustee Filipowski, with a unanimous vote of the Board, the following Resolution was adopted: -3- '1 00173 -1 October 9, 1990 RESOLUTION i PROCLAIMING OCTOBER 1990 SUBSTANCE ABUSE AWARENESS MONTH i WHEREAS, the County of Westchester is fighting the "War on Drugs"; and WHEREAS, as an expression of our solidarity in fighting drug use in Westchester County, the Village of Rye Brook supports the County ". " and in recognizing October as Substance Abuse Awareness Month"; WHEREAS, the County of Westchester will join the Citizen's Alliance to prevent Drug Abuse by observing the National Federation of Parents' Red Ribbon Campaign in late October; and WHEREAS, the Village of Rye Brook will demonstrate their commitment to a drug free lifestyle by encouraging residents and employees to wear red ribbons during the week of October 22 - 28, 1990. NOW, THEREFORE, BE IT RESOLVED, that, I, Salvatore M. Cresenzi, Mayor of the Village of Rye Brook, do hereby proclaim October 1990 to be "Substance Abuse Awareness Month" in the Village of Rye Brook, County of Westchester, and call an all in our community to join in our fight to win the war on drugs. Mayor Cresenzi suggested that Mr. Russo contact the two school districts. Trustee Ravich suggested that the Youth Officer participate in the drug awareness campaign by offering information to area youth on drugs and also by distributing Red.Ribbons to children in both districts. 3. SETTING PUBLIC HEARING DATE FOR PROPOSED LOT 10C SUBDIVISION RE: LARIZZA/CAPOCCI CORP. COMLY AVENUE SUBDIVISION On Motion made by Trustee Ravich, seconded by Trustee Smith with a unanimous vote of the Board the following Resolution was adopted: -4- I001732 October 9, 1990 PUBLIC HEARING LARIZZA/CAPOCCI CONSTRUCTION CORP. COMLY AVENUE SUBDIVISION SECTION 1, BLOCK 11, LOT 10C PLEASE TAKE NOTICE that a Public Hearing will be held on Tuesday, October 23, 1990 by the Board of Trustees of the Village of Rye Brook at the Village Offices, 90 South Ridge Street, Rye Brook, N.Y. , to consider an application received from Larizza/Capocci Construction Corp. for subdivision approval of their property located on Comly Avenue; also known on the Official Tax Map of the Village of Rye Brook as Section 1, Block 11, Lot 10C; All interested persons will have the opportunity to be heard at that time. A copy of the proposed plans may be reviewed at the Village Clerk's Office during regular business hours. By order of the Board of Trustees Village of Rye Brook, N.Y. Salvatore M. NEW YORK STATE CONFERENCE OF MAYORS AMICUS CURIAE BRIEF REQUEST Administrator Russo explained the Village of Rye Brook is a member of the New York State Conference of Mayors. As part of our membership they will donate a Amicus Curiae to help support the Village in the appeal from the decision of the lawsuit brought by the developers of 6 Hawthorne Avenue against the Village. Administrator Russo pointed out that he felt that this would be a tremendous support to the Village to have the Conference of Mayors submit a brief on behalf of the Village. In addition, this assistance is offered to the Village free of charge. on Motion made by Trustee Smith, seconded by Trustee Ravich, with a unanimous vote of the Board, the following Resolution was adopted: -5- 00 1 73J October 9, 1990 RESOLUTION NEW YORK STATE CONFERENCE OF MAYORS AMICUS CURIAE BRIEF REQUEST WHEREAS, an Article 78 Lawsuit filed against the Village of Rye Brook by developers Howard Lowentheil, Inc. , and Peter J. Murray regarding the Village Board's rejection of a subdivision proposal located at 6 Hawthorne Avenue, Rye Brook, New York and WHEREAS, Judge Donald Silverman of the State Supreme Court has ruled in favor of the Petitioners (Lowentheil and Murray) and WHEREAS, on August 16, 1990 the Village of Rye Brook (Respondents) filed a notice of appeal to the Appellate Division, Second Department from Judge Silverman's Order/Decision and WHEREAS, NYCOM offers various services to member municipalities including the ability to become involved in a lawsuit of statewide significance as a "Arnicas Curiae" friend of the court, and WHEREAS, the Village Board of the Village of Rye Brook considers this case to be worthy of consideration for NYCOM involvement, now, therefore, be it RESOLVED, that the Village Board hereby requests that the New York State Conference of Mayors and Other Municipal Officials assist the Village of Rye Brook as a friend of the court to pursue the appeal and ultimately prevail by having the Supreme Court decision reversed and to uphold the integrity of this architecturally and historically significant residential area of the Village of Rye Brook. PAULS LUTHERAN CHURCH SUBDIVISION LOCAL LAW #3 OF 1990 RE: ABANDONED VEHICLES COMLY AVENUE SUBDIVISION OF LARIZZA/CAPOCCI CONST. -6- .. ......._ . 001. 734 October 9, 1990 RESOLUTIONS ADOPTION OF YOUTH COUNCIL CHARTER APPROVAL OF UNITED CEREBRAL PALSY SITE PLAN APPOINTMENTS OF ARCHITECTURAL REVIEW BOARD & ZONING CODE UPDATE COMMITTEE CHECK REGISTER APPROVAL OF MINUTES JULY 17, 1990 AUGUST 14, 1990 SEPTEMBER 18, 1990 NEXT MEETING DATES NOVEMBER 13, 1990 AGENDA MEETING NOVEMBER 27, 1990 REGULAR MEETING Mayor Cresenzi stated that the November 13, 1990 Agenda Meeting would convene at 7:00 p.m. and the November 27, 1990 Regular Meeting would convene at 8:00 p.m. as usual. Ken Heller,'a resident mentioned that there has been a few trees taken down in Rye Brook without a tree permit and he wanted to know what is being done. Mayor Cresenzi replied that Summons' have been served. The Mayor then asked Attorney Beane if there is any way the Village could hold a tree company as guilty as the homeowner for removing trees without a tree permit. Attorney Beane stated that according to the law, the tree company would be guilty as well as the homeowner but what the Village should do is send copies of the Local Tree Ordinance to all the tree companies. Trustee Smith stated that this was done when the law was adopted last year. -7- 00173 i I October 9, 1990 Randy Solomon, a resident mentioned, regarding Substance Abuse Awareness Month, that it would be a good idea to contact the Unite for Safety Committee, B.W.C. (Because We Care) , The P.T.A. and Dr. Coletti at the Port Chester School system to see if they want to join in the fight against drugs. Mayor Cresenzi agreed that this was a good idea and stated that he would like to get the children physically involved and have them wear the Red Ribbons. Ken Heller mentioned that the local newspaper printed the square footage of the office space rented to the Youth Officer at 5,000 square feet. Mayor Cresenzi replied that it was a typographical error and the office is less than 500 square feet. .
