AWARDING OF ROAD RESURFACING CONTRACT "RECYCLING" THE WAY OF THE FUTURE! 001 1t'f MINUTES OF AN AGENDA MEETING BOARD OF TRUSTEES VILLAGE OFFICES 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK JUNE 11, 1991 CONVENE MEETING The Meeting of the Board of Trustees was called to order by Mayor Cresenzi at 6:05 p.m. in the Meeting Room and the Pledge of Allegiance followed. Present were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Michele Daly Trustee Joseph Pellino Trustee Robert Ravich Trustee Randy Solomon Also present were: Christopher J. Russo, Village Administrator Edward F. Beane, Village Attorney Rocco V. Circosta, Director of Public Works Lori Ann DeMarco, Ass't. to Village Administrator Elizabeth Czajkowski, Secretary to Village Board 0019 June 11, 1991 Mayor Cresenzi stated that, other than setting the Agenda for the June 25, 1991 meeting, there are no items on the Agenda for discussion. ITEMS FOR JUNE 25, 1991 PUBLIC HEARING 1. CONTINUATION OF CODIFICATION PROCESS RESOLUTIONS 2. HUMANE SOCIETY CONTRACT RENEWAL 3. AUTHORIZATION TO ENTER INTO YOUTH SERVICES AGREEMENT WITH PORT CHESTER 4. APPOINTMENT OF POLICE OFFICER S. APPROVAL OF LEASE FOR YOUTH OFFICER SPACE 6. SETTING MEETING DATE FOR JULY AND AUGUST BOARD MEETINGS APPROVAL OF MINUTES 6. MAY 21, 1991 7. MAY 28, 1991 Trustee Pellino questioned when we would appoint the appropriate members to various committees, commissions and boards. Mayor Cresenzi replied that we would add that to the Agenda of June 25, 1991. Dominick Spadaro questioned whether or not the Board would be discussing the Meadowlark Park issue and presented a letter to the Board of Trustees. Mayor Cresenzi stated that the Village Attorney has the letter, which will be entered into the minutes. If Attorney Beane has any comments he will contact Mr. Spadaro's Attorney. Joanne Harris stated that the proposed park is not strictly a toddler park. It is for children from 2 years of age to 10 years of age. 2 - 00192-L June 11, 1991 Mayor Cresenzi stated that they needed another informal meeting before having a public discussion. Mayor Cresenzi mentioned that Mr. Kulik, a member of the Playground Committee, stated that people who live in the area and over in the Loch Lane/Woodland Drive area lack access to a neighborhood playground. Many of the problems stem from dealing with the location of that particular site and that is why more discussion is needed. Trustee Pellino inquired as to what was going on with Connecticut Limousine. Attorney Beane stated that as a result of a court appearance on May 29, 1991 at the Supreme Court in White Plains, a stipulation was entered into with the court's approval whereby Connecticut Limousine committed to the Court to be out of the Zinsner Site not later than June 16, 1991. The stipulation, if violated, would have a potential of moving for contempt of court. The reason for the Court order, which in essence gave Connecticut Limousine two additional weeks, was because the Court would not reach a decision for another couple of months. The Court granted us the injunction on May 29, 1991 but deferred it's effectiveness until June 16, 1991. Connecticut Limousine is working on a site in the Rye Ridge Shopping Center in connection with the travel agent, and also at the Marriot Hotel in Rye. Trustee Pellino questioned if this also deals with the real estate firm using that space now used by Connecticut Limousine for other purposes. Attorney Beane stated that this prohibits Zinsner from allowing anyone else to operate in that fashion. Trustee Solomon questioned the status of High Point Hospital. Attorney Beane stated that they are preparing the opposition papers to the motion for dismiss. There is a law that says an offer of dedication does not have to be in writing. Attorney Beane stated that there were no deeds filed and there were private transfers of land. The court states that to convey property, it must be in writing, however it does not have to be in writing when a municipality is offered or accepts a dedication. We have very favorable information on this issue, Attorney Beane added. The papers will be prepared and served on Monday. Trustee Solomon questioned the Loch Lane stream. Administrator Russo stated that he has been trying to contact Dolph Rotfeld. One resident has already been contacted. 3 - n®I2 June 11, 1991 Attorney Beane stated that in our subdivision ordinance there is no time limit. We will include a time limit in the future through our codification process. Attorney Beane stated that there is a six month time frame to file a map, which they have already done. He stated that some developers can let a piece of land stand untouched for thirty years and then pull out the old file map and start to build. These people have to be under some time constraint. Trustee Daly stated that there are many projects that extend far beyond a reasonable time span of development. ADJOURNMENT On Motion made by Trustee Ravich, seconded by Trustee Pellino, the meeting adjourned at 6:20 p.m. into Executive Session for personnel litigations.
