MESSINA & PAUL MESSINA 808 KING STREET SECTION 1, BLOCK 7, LOTS 3B4, 3B5 3C4 & 3C5 RESOLVED, that a public hearing will be held by the Board of Trustees of the Village of Rye Brook on Tuesday, June 22, 1993, at 8:00 p.m. at the Village Offices located at 90 South Ridge Street, Rye Brook, New York, to consider application from Donald L. Lori Ann DeMarco, Ass't to Village Administrator, replied that we will be receiving a check after June 11, 1993 in the amount of $3,500.00. Trustee Pellino stated that the Groundbreaking Ceremony for the Anthony J. Posillipo Community Center was held today, June 8, 1993 at 5:30 p.m., which marked the kick off of the construction phase. 3. AUTHORIZING PAYMENT OF APPRAISAL HIGH POINT HOSPITAL On Motion made by Trustee Zuckerman, seconded by Trustee Pellino, the following resolution was hereby adopted: 3 June 8, 1993 004'78a RESOLUTION AUTHORIZING PAYMENT OF APPRAISAL OF HIGH POINT ESTATES INC. BY ELLIOT GLASER AND ROLAND GRECO RESOLVED, that the Village of Rye Brook is authorized to pay $5,000.00 to Elliot Glaser and Roland Greco for the appraisal services performed regarding High Point Estates, Inc. in connection with a tax certiorari suit, representing one-third of the total cost of$15,000.00; and be it FURTHER RESOLVED, that such payment be made to the Town of Rye who will make payment. Administrator Russo explained that the Town of Rye pays a large portion of the money. POSILLIPO COMMUNITY CENTER WHEREAS, the Village of Rye Brook conducted a competitive bidding procedure on Contract #9303 for plumbing work in connection with the reconstruction of the Anthony J. Posillipo Community Center; and WHEREAS, 4 bids were received on Contract #9303 which were publicly opened and read aloud on May 4, 1993; and 4 004790 June 8, 1993 WHEREAS, Capstone Enterprises of 10 Broad Street, Port Chester, NY submitted the lowest bid as follows: Base Bid: $49,950 Alt 1 (full basement): $3,100 Alt 2 (lowered ceiling in multi-purpose room): $800 Total: $53,850 WHEREAS, Capstone Enterprises has stated that Anthony Sansaverino of Yonkers, NY, a subcontractor for Capstone will be performing that plumbing work for this contract, in accordance with all contract documents. POSILLIPO COMMUNITY CENTER 5 004131 June 8, 1993 WHEREAS, the Village of Rye Brook conducted a competitive bidding procedure on Contract 119304 for Electrical work in connection with the reconstruction of the Anthony J. Posillipo Community Center; and WHEREAS, 10 bids were received on Contract 119304 which were publicly opened and read aloud on May 4, 1993; and WHEREAS, Capstone Enterprises of 10 Broad Street, Port Chester, NY submitted the lowest bid as follows: Base Bid: $72,200 Alt 1 (full basement): $0 Alt 2 (lowered ceiling in multi-purpose room): $0 Total: $72,200 WHEREAS, Capstone Enterprises has stated that E.C.N.Y. Electric, Inc of 1 Coligni Avenue, New Rochelle, NY, a sub-contractor of Capstone Enterprises, will be performing the electrical work for this contract in accordance with all contract documents. NOW, THEREFORE, BE IT RESOLVED, that Contract 119304 for Electrical work is awarded to Capstone Enterprises of 10 Broad Street, Port Chester, NY for the total sum of $72,200.00 which shall include Alternate 1 and 2; and be it FURTHER RESOLVED, that E.C.N.Y. Electric Inc. shall obtain a electrical license in the Village of Rye Brook prior to the start of work; and be it FURTHER RESOLVED, that if E.C.N.Y. Electric Inc. does not obtain such Electrical License f then this contract shall become null and void; and be it FURTHER RESOLVED, that the Mayor is authorized to execute and deliver all documents necessary or appropriate to accomplish the purposes of this resolution. Trustee Zuckerman questioned what would happen if the Electrical License is not obtained. Trustee Daly stated that if they already have a license in Westchester County, they could just get a reciprocal because they already hold a license in New Rochelle. Trustee Zuckerman questioned if that needed to be included in the resolution. Mr. Circosta stated that it is already in the resolution. All he has to do is show us his masters license from New Rochelle and he will get a reciprocal license. 6 June 8, 1993 004792 Trustee Zuckerman questioned if there was a time frame for him to get the license regarding the Plumbing Contract. Mr. Circosta stated that once the contract documents have been signed we will be issuing an exam. It is the same procedure as for the Electrical License as long as the municipality where he holds his master license reciprocates with us. POSILLIPO COMMUNITY CENTER WHEREAS, the Village of Rye Brook conducted a competitive bidding procedure on Contract #9305 for H.V.A.C. work in connection with the reconstruction of the Anthony J. Posillipo Community Center; and WHEREAS, 7 bids were received on Contract#9305 which bids were publicly opened and read aloud on May 4, 1993; and WHEREAS, Hi-Tech H.V.A.C. of 262 Westchester Avenue, Buchanan NY, submitted the lowest bid as follows: Base Bid: $106,300 Alt 1 (full basement): $0 Alt 2 (lowered ceiling in multi-purpose room): $0 Total: $106,300 NOW, THEREFORE, BE IT RESOLVED, that Contract#9305 for H.V.A.C. work is awarded to Hi-Tech H.V.A.C. of 262 Westchester Avenue, Buchanan, NY for the total sum of$106,300 which shall include Alternate 1 and 2; and be it 7 June 8, 1993 {)0479.3 FURTHER RESOLVED, that the Mayor is authorized to execute and deliver all documents necessary or appropriate to accomplish the purposes of this resolution. REFERRAL TO THE PLANNING BOARD H. LOEWENTHEIL, INC. 6 HAWTHORNE AVENUE LOT COUNT APPROVAL OF NIINUTES 3. APRIL 13, 1993 PUBLIC HEARING 8. LOCAL LAW #3-1993 ENTITLED: A LOCAL LAW REPEALING SECTION 66-7 (E) OF THE ZONING LAW OF THE VILLAGE OF RYE BROOK AND SUBSTITUTING A NEW SECTION 66-7 (E) REGARDING PLANNED UNIT DEVELOPMENT DISTRICTS Mayor Cresenzi convened the Public Hearing at 8:35 p.m. Attorney Powell reviewed the changes that were made at the previous meeting. Trustee Zuckerman stated that subsequent to the last Board Meeting we received the minutes of the April Planning Board Meeting and a memo from Frederick P. Clark and Associates dated May 10, 1993. Most of those items were already addressed, however in the Clark Memo and the Planning Board Minutes, they mention limiting the extension to one six month extension. Trustee Pellino stated that we addressed that comment by changing the original draft from twelve months to eighteen months. Trustee Zuckerman questioned if we should put a time limit on the extension or leave it open ended. If we leave it open ended, we may be tempted to extend it more than once. The Board agreed to include in the resolution that the extension would be not to exceed six months. Trustee Zuckerman stated that the Planning Board and Frederick P. Clark Associates suggested a language change on page 5, 4b to include modifications or, between the words with and conditions to read with modifications or conditions. The Board agreed with the language change. 9 June 8, 1993 004795 On Motion made by Trustee Solomon, seconded by Trustee Zuckerman, the Public Hearing was closed at 8:45 p.m. TRUSTEE DALY VOTING AYE TRUSTEE PELLINO VOTING AYE TRUSTEE SOLOMON VOTING AYE TRUSTEE ZUCKERMAN VOTING AYE MAYOR CRESENZI VOTING AYE 9. ADOPTING LOCAL LAW #3-1993 PLANNED UNIT DEVELOPMENT On Motion made by Trustee Solomon, seconded by Trustee Pellino, the following resolution was hereby adopted: RESOLUTION ADOPTING LOCAL LAW #3-1993 PLANNED UNIT DEVELOPMENT WHEREAS, the Zoning Code Update Committee has presented to the Board of Trustees an update of Section 66-7 (E) of the Zoning Law of the Village of Rye Brook which update was prepared after considerable study and discussion; and WHEREAS, the Board of Trustees referred Local Law #3-1993 to the Planning Board for its report and recommendation and has held Public Hearings on the local law as required by law. NOW, THEREFORE, BE IT RESOLVED, that the accompanying Notice of Determination of Non-Significance or Negative Environmental Declaration is approved; and it is FURTHER RESOLVED, that Local Law #3-1993 is enacted into law. Trustee Zuckerman questioned that since we are repealing the current PUD, is that repealing the PUD under which the Arbors is authorized and leaving them without a formal law of authorization. Attorney Powell stated that it may be Grandfathered. Trustee Zuckerman questioned if we needed any special exceptions in the law for that particular development before we repeal the old PUD. 10 June 8, 1993 004'796 Attorney Powell replied that this was something that the Board could decide to do as a matter of clarifying the issue. We could clarify this with a minor language change such as: This local law shall not invalidate any PUD existing prior to the date this local law shall become effective. The Board decided to include such a change in the Local Law under item number 3. Trustee Solomon congratulated the Zoning Code Update Committee on a job well done. TRUSTEE DALY VOTING AYE TRUSTEE PELLINO VOTING AYE TRUSTEE SOLOMON VOTING AYE TRUSTEE ZUCKERMAN VOTING AYE MAYOR CRESENZI VOTING AYE Trustee Daly stated that our Youth Officer has completed his Drug Abuse Resistance Education Program. Chief Santoro stated that he is now qualified by the State to be a DARE Instructor. The next step now is meeting with the Blind Brook Schools and setting everything up for the Fall Semester. Mayor Cresenzi questioned how Officer Mitchell would work in the Port Chester School System. Chief Santoro stated that the guidelines on the DARE Program are classroom but there are many extra-curricular activities as well. Rocco Platterati and Jimmy will still work very closely together in the Port Chester School District and it should work out well. Trustee Solomon questioned if the Building Department had anyone traveling around the Village during the day that could point out where there is excessive vegetation rather than the residents or Trustees having to point it out at meetings. Mr. Circosta stated that of course we have employees driving around the Village doing different things but we do not have a particular person going around that is taking notes. He added that IF he would bring this to the attention of some of our staff. Trustee Solomon questioned if there was any new news on the EPA. i 11 I June 8, 1993479 1 Trustee Zuckerman stated that he spoke with Nita Lowey and a member of her staff and followed that up with a phone call the following week and spoke to Debra Barr expressing our concern that we have not heard anything from the EPA since our last communication with them several months ago. Trustee Zuckerman commented that he gave her several questions to ask the EPA which she conveyed to them. We expect to receive some communication from the EPA soon. Larry Labriola, the grounds maintenance contractor at Philip Morris Corporation located on Westchester Avenue stated that his company is handling the task of controlling the Canadian Goose problem on their property. The Canadian Goose is a Federal bird so we followed directions and obtained a permit in controlling this bird. The permit primarily allows us to scare the birds off the property using a type of firework. Since the Village of Rye Brook Code restricts the use of fireworks other than the fourth of July, we request permission to use such fireworks in conjunction with the Federal Permits we have obtained. Trustee Daly questioned how often the fireworks would be going off, and if they would be murdering any of the geese as the contract states. Mr. Labriola stated that the one or two fireworks go off every day. The Game Ordinant recommended to kill four a year and that would scare of the geese, however Philip Morris has not permitted any bird killing and we do not want to kill any birds. Trustee Daly questioned if the section about killing the geese could be stricken from the contract. Mr. Labriola stated that for the last 15 years he has been controlling the geese at Pepsico and they never killed any geese there. Trustee Solomon stated that there is not much housing near Pepsico, however there are houses near Philip Morris. He questioned what time of the day this would take place, and if they would be notifying the residents in the area. f i Mr. Labriola explained that right now the time is critical for me to get this flock of birds off the 'j property before they molt and lose their feathers, so he would love to have permission to use the fireworks as necessary. One person doing it won't be as effective as four people, one on each side of the lake, doing it. We would contact the Police and provide notification with the people. Trustee Pellino pointed out that in the documentation received regarding this subject, this control procedure is to eliminate their nesting sites. 12 -TA79 June 8, 1993 Mr. Labriola stated that they recommended to use various other controls such as putting nets up around the lakes so they could not come in and out of the water easily, shading of the eggs, because every bird that is born on that property will come right back to the nest, so we have been given permission to shade the eggs so that they won't hatch. Mayor Cresenzi questioned Attorney Powell how we were to treat this request with regard to our ordinance, which prohibits the use of fireworks other than on the Fourth of July. Attorney Powell stated that the ordinance is a local law and it clearly prohibits use of fireworks except for the public display on the Fourth of July. In order to allow this to go on, you must amend the local law providing the exception because when the law was written there was no discretion given by the Village Board in the law. William Aughavin, a resident stated that this activity is too close to the Port Chester Middle School. He added that Rye Golf Course just hired trainable dogs to get rid of the geese population and the use of dogs has been very successful. Mr. Heller stated that Geese droppings are a health hazard and people should not feed ducks and geese because that is what is keeping them around. Trustee Solomon agreed with Mr. Heller and stated that he was recently at Pepsico and there was bird feces everywhere and you could not even walk. If this problem develops in Rye Brook, we may have the same problems at General Foods that Pepsico has currently with lawsuits. i Trustee Daly questioned how often these fireworks are going to go off during the day. i Mr. Labriola stated that they go over to Philip Morris in the morning and chase the birds of the property then they come back at noon time and probably at the end of the day. Trustee Daly questioned how many days this would take. Mr. Labriola replied that because these birds are so persistent it would probably take forever. 1 Trustee Zuckerman questioned if the Board would want to consider passing a local law that would give the Village Board the right to make exceptions to the current local law. Trustee Daly stated that she could not see the noise going on forever in the area with the school and houses so nearby. r Mr. Labriola stated that they never received any complaints as the traffic is so noisy that the fireworks can't be heard from the road. ,I 13 00479) June 8, 1993 Trustee Pellino questioned if it was possible to interpret this as a discretionary action on the part of the Village Board where it concerns the public safety where the geese and their droppings are promoting a health hazard, can we act on that basis and override the local law in conjunction with our responsibility to public health and safety. Attorney Powell stated that he did not think so because if the Board wished to take that route, they would have to amend the local law. Trustee Daly questioned the possibility of using dogs. Mr. Labriola stated that it is difficult to get the dogs motivated. Mr. Aughavin stated that there is a contractor in Rye who works with dogs and it has been extremely successful. The dog aggravates the geese and they leave. Trustee Solomon questioned if Mr. Labriola ever had an accident with someone getting injured due to this procedure. Mr. Labriola replied that in reference to the starter pistols, they are shot in the air, one going 100 feet and the other 25 feet. At Pepsico, there are many pedestrians and we haven't hit one yet. Chief Santoro stated, for the record that the use of the fireworks has been going on illegally in Rye Brook in case the Board did not know. Trustee Solomon questioned how long Mr. Labriola was doing this illegally. Mr. Labriola stated that they have been doing this for a year. They recently were caught when there were four of us shooting on opposite sides of the lake and a police officer came and thought he heard gunfire and that is when we found out that it was illegal in the Village of Rye t Brook. We want to get them out of there before they molt, which will be in mid June. Trustee Zuckerman questioned if there have been any noise complaints in the Police Department. Chief Santoro stated that there have been no complaints. Trustee Zuckerman suggested that we consider looking into amending the local law and then possibly authorize a week long testing to see how it impacts on the neighbors. Mayor Cresenzi stated that the Village would research this matter and get back to Mr. Labriola at their earliest convenience. 14 k' June 8, 1993 00*300 Trustee Pellino recommended that we put the setting of a public hearing date for a new sign law on the June 22, 1993 agenda. He questioned what the votes were from the Planning Board. Bill Aughavin, a member of the Planning Board stated that to the best of his knowledge, it was approved. Mayor Cresenzi agreed to set the public hearing date on June 22, 1993. Trustee Zuckerman questioned why we could not set the date tonight and hold the public hearing on June 22, 1993. Mayor Cresenzi explained that we need to go over the law prior to setting the public hearing date.
