CONVENE MEETING Mayor Cresenzi convened the Meeting at 8 : 00 p.m. and the Pledge of Allegiance followed. Present were the following members of the Board: Mayor Salvatore M. Circosta, Director of Public Works Elizabeth Czajkowski, Secretary to Village Board 00423j- April 023j- April 28, 1992 PUBLIC HEARINGS Mayor Cresenzi announced that the Board would address item #3 first. 1. MOBIL OIL, INC 105 SOUTH RIDGE STREET SECTION 1, BLOCK 23 , LOT 1A-2B, 3 & 4 APPROVAL OF SITE PLAN EXTENSION OF OPERATING HOURS Mayor Cresenzi explained that due to a misprint in the Public Notice calling for the Public Hearing this evening, we cannot convene the Hearing tonight on this issue. On Motion made by Trustee Pellino, seconded by Trustee Zuckerman, a Public Hearing will be on Wednesday, May 6, 1992 at 8: 00 p.m. to deal with the Mobil oil Site Plan Approval and Extension of Operating Hours. ADOPTION OF LOCAL LAW #2-1992 ENTITLED: "NUMBERING OF BUILDINGS" On Motion made by Trustee Pellino, seconded by Trustee Daly the Public Hearing on the Adoption of Local Law #2 will be adjourned to the next regular Board Meeting on Tuesday, May 26, 1992 at 8: 00 p.m. Trustee Daly questioned if there was a time factor for 911. ADOPTION OF 1992-1993 BUDGET On Motion made by Trustee Pellino, seconded by Trustee Zuckerman, the following resolution was hereby adopted: RESOLUTION VILLAGE OF RYE BROOK 1992-1993 BUDGET WHEREAS, the Board of Trustees met on the 14th of April, 1992 pursuant to Notice of Public Hearing, regarding the Proposed 1992- 1993 Budget, and has heard all persons desiring to be heard thereon; NOW, THEREFORE, BE IT RESOLVED, that the Proposed Budget as amended and revised, and as hereinafter set forth by the Board of Trustees, is hereby adopted this 28th day l�of April, r 1992 • and be it FURTHER RESOLVED, that the amounts listed therein for payment of principal and interest on indebtedness, and that maintenance district charges be paid, and that the salaries, wages, benefits and other terms and conditions of employment for all employees, including those not represented by a bargaining unit, shall be paid such salaries as determined by the Board of Trustees. 00423-1 j April 28, 1992 Administrator Russo explained that the Budget was amended to include the 24th Police Officer, and the budgeted item for sidewalks in Capital was eliminated. Any funds appropriated for sidewalks in the future will be taken out of the proposed borrowing for road resurfacing. APPOINTMENT OF POLICE OFFICER On Motion made by Trustee Solomon, seconded by Trustee Pellino, the following resolution was hereby adopted: RESOLUTION APPOINTMENT OF POLICE OFFICER RESOLVED, that Thomas Fee of 36 Echo Avenue, Apt. 4A, New Rochelle, New York, be hereby appointed to the probationary position of Police Officer 5th Grade at a starting salary of $25, 373 . 00 with the Rye Brook Police Department, and be it FURTHER RESOLVED, that the probationary period for the position shall be six months effective on the commencement date of April 29, 1992 . TRUSTEE DALY VOTING AYE TRUSTEE PELLINO VOTING AYE TRUSTEE SOLOMON VOTING AYE TRUSTEE ZUCKERMAN VOTING AYE MAYOR CRESENZI VOTING AYE Chief Santoro stated that Mr. Fee on duty this evening and was unable to attend this meeting. Mayor Cresenzi clarified for the Public that this is not the 24th Officer, this is a replacement based on a previous retirement. We currently have 23 Officers. Trustee Solomon stated that Mr. Fee should be present at a future meeting to meet the Board. 0042 LI April 28, 1992 6. AUTHORIZING MAYOR TO ENTER INTO AGREEMENT WITH ABBEY RICHMOND AMBULANCE SERVICE, INC. On Motion made by Trustee Zuckerman, seconded by Trustee Pellino, the following resolution was hereby adopted: RESOLUTION ABBEY RICHMOND AMBULANCE SERVICES RESOLVED, that the Mayor is hereby authorized to enter into agreement with Abbey Richmond Ambulance Services, Inc. for Emergency Ambulance Service to the Village of Rye Brook for the 1992 Calendar year. Administrator Russo explained that this a 10% increase, which covers a three year period with Abbey Richmond and does not change the service. In addition, we are looking into a communications system between the Police Department and the Ambulance Corps. Mayor Cresenzi added that the hours of operation for Abbey Richmond are from 6: 00 A.M. until 6: 00 P.M. They provide a daytime coverage to the community and the evening hours and all Holidays are covered by the Volunteer Ambulance Corp. SETTING PUBLIC HEARING DATE ANGLICAN CHURCH OF THE ADVENT COMLY AVENUE SECTION 1, BLOCK 8, LOTS 4B-2 FINAL SUBDIVISION APPROVAL On Motion made by Trustee Daly, seconded by Trustee Pellino, the following resolution was hereby adopted: 0042c3i April 28, 1992 RESOLUTION ANGLICAN CHURCH OF THE ADVENT COMLY AVENUE SECTION 1, BLOCK 8, LOTS 4b-2 FINAL SUBDIVISION APPROVAL RESOLVED, that a Public Hearing will be held by the Board of Trustees of the Village of Rye Brook on Tuesday, May 12, 1992 at 8: 00 p.m. at the Village Offices, 90 South Ridge Street, Rye Brook, NY to consider an application from the Anglican Church of the Advent regarding final subdivision approval at the premises located at Comly Avenue and also known on the official tax map of the Village of Rye Brook as Section 1, block 8, Lots 4b-2 . UNITED CEREBRAL PALSY KING STREET & LINCOLN AVENUE SECTION 1, BLOCK 02, LOT 3A1 REFERRAL TO THE PLANNING BOARD On Motion made by Trustee Solomon, seconded by Trustee Zuckerman, the following resolution was hereby adopted: RESOLUTION UNITED CEREBRAL PALSY SITE PLAN APPROVAL KING STREET & LINCOLN AVENUE SECTION 1, BLOCK 02, LOT 3A1 REFERRAL TO THE PLANNING BOARD WHEREAS, an application was received for Site Plan Approval foe the premises located on King Street & Lincoln Avenue and known on the Tax Assessment Map of the Village of Rye Brook as Section 1, Block 02, Lot 3A1; NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of Rye Brook will hereafter circulate a notice of intent to declare itself as the Lead Agency in this matter; and be it "' 0423 April 28, 1992 FURTHER RESOLVED, that this matter is hereby referred to the Planning Board this 28th day of April, 1992 for their review and recommendations; and be it e u ' FURTHER RESOLVED, that the applicant is hereby required ited to contribute the amount of $1, 000 toward consulting fees for environmental impact review, and said amount shall be due and payable upon referral to the Planning Board of said application; and be it FURTHER RESOLVED, that if the entire sum is not required for consulting fees, then the balance shall be returned to the applicant. However, if additional sums are needed, then they shall be paid by the applicant. Trustee Daly questioned the returning of sums to the applicant. Administrator Russo explained that occasionally, the Village spends less than the amount put up for consulting fees. APPOINTMENT TO TREE COMMITTEE On Motion made by Trustee Pellino, seconded by Trustee Daly, the following resolution was hereby adopted: RESOLUTION APPOINTMENT TO THE TREE COMMITTEE RESOLVED, that William Aughaven of 16 Mohegan Lane, be hereby appointed to the Tree Committee to fill the unexpired term of Edward Lorch to expire in April 1993 . 004231 April 28 , 1992 Mayor Cresenzi added that Mr. Aughaven will be the Planning Board's representative on the Tree Committee and will fill the unexpired term of Mr. Lorch who is moving from the community. CHECK REGISTER On Motion made by Trustee Pellino, seconded by Trustee Zuckerman, the following resolution was hereby adopted: RESOLUTION CHECK REGISTER WHEREAS, the following checks, representing payment for services rendered, have been submitted to the Treasurer's Office for payment and have been certified to by the Village Administrator; On-Line Checks: #4192-4333 Hand Checks: #9999-10021 Payroll Checks: #6674-6871 NOW, THEREFORE, BE IT RESOLVED, that this Board hereby approves payment of the above- mentioned claims and authorizes payment thereof. JULIE ECKHERT RE: RESIGNATION CABLE TV COMMISSION Administrator Russo read a letter from Ms. Eckhert, explaining that due to professional commitments she can no longer serve on the Cable TV Commission. However, she has said that she will make herself available for any particular services that she may be able to assist the Village with in the future. Mayor Cresenzi stated that the Board will accept her resignation and directed Administrator Russo to send Ms. Eckhert a letter of thanks for the time she has given to the Village. Trustee Zuckerman stated that the Village should let the Community know that there is an opening on the Cable TV Commission and if residents would like to serve on this Commission, perhaps they could submit letters. Trustee Pellino suggested that we announce that there is an opening on the Cable TV Commission on the Village's Cable Channel. 12 . FREDERICK C. SCHMALING, SECRETARY VETERANS CENTRAL COMMITTEE RE: MEMORIAL DAY 1992 REQUISITION OF FUNDS Administrator Russo read the letter and explained that the Veterans Committee have requested funds for Memorial Day 1992 . He stated that we have not done so in the past and this is the first time that they are requesting funding. Mr. Brown stated that in the past, the State said that each Town is required to give $300 to each Veterans Organization and for Memorial Day services. The Village of Port Chester always picked up the total of the remainder of the bills. Now they have changed their set up because there was a large difference of bills. He stated that he was Treasurer of this group in the past. Mayor Cresenzi stated that a year ago, Bernie Abel approached the Board for funding for Veteran's Day, which is the first time the Village had contributed to any of the Veteran's organizations. Trustee Pellino questioned who the Village's representative for this committee is, as the letter states that "as agreed at a meeting of the representative of all local municipalities, all bills must be paid by the Veterans Central Committee. " 0423 April 28, 1992 Administrator Russo stated that he was not aware of any representation. Trustee Solomon questioned if we could table this until we get more information, rather than voting on a sum of money this evening. Trustee Zuckerman questioned what sum was requested from the other municipalities. The Board agreed that more information be obtained and this be addressed at the May 12 , 1992 Agenda Meeting. i I 13 . ALICE K. CONRAD, CITY CLERK CITY OF RYE RE: DEDICATION OF MARSHLAND CONSERVANCY AS PARKLAND Administrator Russo explained that the City of Rye enclosed a copy of the Resolution that they currently passed urging the dedication of the Marshland Conservancy as parkland. Trustee Solomon suggested that the Board pass this resolution. Administrator Russo stated that if we pass a resolution, we must send a copy to the Westchester County Board of Legislators. We will prepare a resolution for the May 26, 1992 Regular Board Meeting. Administrator Russo stated that today, he received a letter from the Port Chester High School Marching Band requesting to put a sign at the corner of Bowman Avenue and Ridge Street. The Board agreed that to rant this request and directed g 9 q Administrator Russo to inform the proper party of their decision. Administrator Russo stated that on Thursday, April 30, 1992 at 2 : 00 P.M. there will be a Tree Planting Ceremony for Arbor Day and to receive our next Tree City Award. Anyone in the community is welcome to attend. It will be held in the vicinity of Sunset Road on Lincoln Avenue. There will be a representative from the State Department of Environmental Conservation to present the Village it's Tree City Award. U04". April 28, 1992 APPROVAL OF MINUTES 14 . MARCH 17, 1992 Trustee Zuckerman stated that he should not vote to accept the first six sets of minutes as he was not yet elected Trustee. On Motion made by Trustee Solomon, seconded by Trustee Daly, the minutes of December 17 , 1991, January 28, 1992 , February 11, 1992, February 25, 1992 , March 10, 1992 and March 17, 1992 were accepted as presented. TRUSTEE DALY VOTING AYE TRUSTEE PELLINO VOTING AYE TRUSTEE SOLOMON VOTING AYE TRUSTEE ZUCKERMAN ABSTAINED MAYOR CRESENZI VOTING AYE Mrs. Chatman, a resident of Upper King Street questioned why the Village voted to refer the proposed Shopping Center on King Street to the Planning Board and wondered if they really thought about whether or not -it is proper to put a shopping center right in the middle of King Street. Trustee Daly stated that this issue has not yet come before the Village Board. Mrs. Chatman stated that she understood that the Board of Trustees has the right to consider something without first giving it to the Planning Board. Mayor Cresenzi stated that this is true, however it is not the planning process that we follow. When an individual wishes to make application it comes in front of the Village Board so that the members are aware of what is going on. It is then passed on to the Planning Board to vote and deal with all of the planning issues and then it ultimately comes back to the Village Board with a written recommendation from the Planning Board. 004241k April 28, 1992 Mrs. Chatman questioned, that in other words if someone decided that they wanted to start a garbage dump on King Street, it would be turned over to the Planning Board. Mayor Cresenzi stated that a garbage dump could not be equated to a shopping center. Any reasonable development that is suggested within the Village will be referred to the Planning Board. Garbage dumps are not included. Trustee Pellino stated that as a property owner, they have the right to make application for any reasonable development that they choose to apply for. We are giving them their right to make a presentation to the Planning Board to discuss all the pertinent issues regarding the planning of any project. Trustee Zuckerman added that if we don't refer it to the Planning Board and simply vote against, they will then have the right to go to Court on it and compel us to send it to the Planning Board which would cost the Village a great deal of money and we would accomplish nothing. Sending this to the Planning Board is the wisest step in the long run. 20. MARCH 31, 1992 On Motion made by Trustee Zuckerman, seconded by Trustee Daly, the minutes of March 31, 1992 were accepted as presented. MAY 12 , 1992 AGENDA MEETING - 8 : 00 P.M. MAY 26, 1992 REGULAR MEETING - 8: 00 P.M. Don Brown thanked the responsible party for getting rid of the dirt pile on King Street. He questioned if the Village has a law that requires the contractor to clean up the mess that he makes on the street while doing work in the Village. April 28, 1992 Mayor Cresenzi stated the we do. Mr. Brown stated that someone should enforce it because the last time a contractor made a mess on King Street, it was Rye Brook who cleaned it up. Frank Filipowski stated that at the last Board Meeting he questioned the chain locked gate through the easement where the path for Blind Brook High School is located. Trustee Zuckerman suggested that he speak with Superintendent Kusal, which he did. He was informed that the gate was locked to protect children from the criminal activities that are going on in the Arbors so that the children would not be exposed to it. What criminal activity is he speaking of and what are the Police doing about it. Chief Santoro stated that he would contact Dr. Kusal tomorrow as he obviously knows something that the Police do not know. Mayor Cresenzi stated that the we will get information to Mr. Filipowski as soon as possible. Mr. Heller stated that at the Lutheran Church, where the houses were being built, the developers did not keep their promise, as the berming was there so they would plant trees to screen those houses from the street and they did not. Mr. Circosta stated that the original plan did not include that. The developer was going to submit a new landscape plan including that berm, but they opted not to and are going back to the original plan which is the planting on the grade as it is now. Mr. Heller questioned if they would plant larger trees, because to get enough height for the screening effect 6 feet will not do the job. Mr. Circosta stated that the developer will be planting what was approved on the landscape plans. He does not have the plans here this evening, so the exact size is not available right now. He added that the final drawing has not been filed yet. J iG 2as April 28 1992 Mr. Heller stated that in the past, the final drawing, never meets the intent of the community. They plant undersized trees of not very great quality. They also use poor materials. He added that the last foundation seems awfully close to King Street and questioned if the setbacks are illegal . Trustee Pellino stated that Mr. Circosta should check the final map and resolution from the Planning Board and Village Board Approval on that project, however he remembers from his days as a member of the Planning Board, that the developer was going to plant shrub- type screening sparsely spaced. He does not remember trees or berming of the line across the property in the final analysis. Mr. Heller stated that he did not feel that shrubs will do the job, and we again have a variance of the intent of what we originally wanted and the neighbors requested. Mayor Cresenzi directed Mr. Circosta to do as Trustee Pellino suggested and check into this. Mr. Brown stated that if they want decent screening, go up the street and look at what Messina has on the other side of the street. He has perfect screening for the side of his house right across from the Nursing Home. It must be to feet high. He questioned if the shrubs are going to be planted on the street side of the fence or the other side of the fence. Mayor Cresenzi stated that he believes that they were supposed to be planted on the street side of the fence. Mr. Brown questioned if they would be on their property or the State right-of-way. Mr. Circosta stated that the shrubs will be located on their property. Mr. Brown questioned if that meant it would be on the sewer right of way or the drain right of way. He added that the Village was supposed to have that pulled out of White Plains Attorney, Sara Peake. Mayor Cresenzi stated that he dropped the ball on that issue, however, we will deal with it. Mr. Brown stated that they have the good side of the fence towards the street which is nice, so why not put the shrubs on the other side so they can enjoy the hedges also. :JA241 2 April 28 , 1992 Frank Filipowski stated that in going through the parks recently he noticed that there may be a problem with property boundary lines. He spoke to Tom Hroncich about it and he said that he was trying to get the parks surveyed for a number of years. There is a real need for establishing property lines on one course in Rye Hills Park. Mr. Heller stated that it is his understanding that Rye Town is considering an extensive planning program for Crawford, such as setting up a tree nursery. He suggested to the Town officials that perhaps the piece of property that is located at the top of Crawford near Elm Hill Drive can be turned into a nursery for residents of the Town. Mayor Cresenzi stated that he will speak to supervisor Sapione and report back to the Board. Mr. Brown stated that there is a right of way off of Elm Hill Drive to go into that property and a fence was put up to block it. Frank Filipowski stated that we could trade the acre for a road. Don Brown stated that the property on the bottom of Crawford Park was set up for either 5 or 7 acres for a Town Hall/Fire Department Complex. Mayor Cresenzi stated that it was 5 acres.
