HomeMy WebLinkAbout1990-04-24 - Board of Trustees Meeting Minutes 00162 MINUTES OF A REGULAR MEETING THE BOARD OF TRUSTEES VILLAGE OF RYE BROOK VILLAGE OFFICES 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK APRIL 24, 1990 I CONVENE MEETING: The Meeting of the Board of Trustees was called to order by Mayor Cresenzi at 8:05 p.m. in the Meeting Room and the Pledge of Allegiance followed. I I Present were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Jane Saffir Smith Trustee Francis L. Filipowski Trustee Robert J. Ravich Trustee Michele R. Mendicino was not in attendance. Also present were: Christopher J. Russo, Village Administrator Edward F. Beane, Village Attorney Rocco B. Circosta, Director of Public Works Elizabeth Czajkowski, Secretary to the Village Board 00"628 April 24, 1990 1. ADOPTION OF 1990/91 BUDGET Administrator Russo read the proposed Resolution pertaining to adoption of. the 1990/91 Budget. Thereafter, on motion by Trustee Smith, .seconded by Trustee Ravich, with a unanumous vote of the Board, the following Resolution was adopted: RESOLUTION VILLAGE OF RYE BROOK 1990-91 BUDGET WHEREAS, the Board of Trustees met on the 3rd day of April, 1990 pursuant to Notice of Public Hearing, regarding the Proposed 1990-91 Budget, and has heard all persons desiring to be heard thereon; NOW, THEREFORE; .BE IT RESOLVED, that the Proposed Budget as amended and revised, and as hereinafter set forth by the Board of Trustees, is hereby adopted this 24th day of April, 1990; and be it FURTHER RESOLVED, that the amounts listed therein for payment of principal and interest on indebtedness, and that. maintenance district charges be paid, and that the salaries, wages, benefits and other terms and conditions of employment for employees, not represented by a bargaining unit, shall be paid such salaries as determined by the Board of Trustees; and be it FURTHER RESOLVED, that the budget shall reflect the elimination of the full time position of Deputy Village Clerk. 2. PROCLAIMING MAY, 1990 AS MENTAL HEALTH MONTH Thereafter, on motion by Trustee Ravich, seconded by Trustee Smith, with a unanimous vote of the Board, the following Proclamation was adopted: _2_ 001 f32i April 24 , 1990 RESOLUTION PROCLAIMING MAY, 1990 MENTAL HEALTH MONTH WHEREAS, A substantial portion of the people in the U.S will suffer either directly or indirectly from the disabling con- sequences of mental illness in their lifetimes, WHEREAS, Community based mental health approaches offer hope for overcoming mental disabilities, WHEREAS, There has been a vast growth in homelessness in our nation and in our county, in part created by unmet mental health needs, and inevitably creating mental health problems, WHEREAS, Meeting the mental health needs of children is essen- tial to the well being of' our society, WHEREAS, Changes in family life in the United States have brought with them new stresses on the family which call for innovative, preventive intervention as well as for the development of non-traditional forms of treatment, WHEREAS, The elderly, who are the fastest growing segment of our population, are more likely to suffer problems of mental health than the younger population, and require innovative forms of care and treatment, WHEREAS, Stigma and myths about mental illness interfere with people seeking and getting the mental health services they need, WHEREAS, The Mental Health Association of Westchester County along with other Mental Health Associations around the country takes a leadership role with regard. to winning community accep- tance of the mentally ill, stimulating the development of vital services and providing education for both professionals and non- professionals alike, and I NOW, THEREFORE, BE IT RESOLVED, that 1, Salvatore M. Cresenzi, Mayor of the Village of Rye Brook, do hereby proclaim May, 1990 to be Mental Health Month in Westchester, and call on all in our county to ,join with our Mental Health Association in working for .Westchester's mental health during May and throughout the year. -3- April 24, 1990,, 3. APPROVING TAX REDUCTION STIPULATION RE: BROOK II VENTURES Administrator Russo read the Resolution and it was aimnended to provide that the Mayor and/or the Village Administrator be authorized to enter' into the agreement with Brook II. The agreement involves a 23.09% tax reduction of land on the land portion of hidden falls for 1990 tax year. Attorney Beane explained that this means that the assessment on each lot, just the land value, will be reduced by 23.09%. Any improvement that is erected on the property will be assessed at full value. What is thought to be a lot, consists of a piece of property with a home and reduction would be in the land portion. What has happened, stated Attorney Beane, is that the original sales prices of the various improved lots have increased so that any decrease in assessment of the land has more than been made up by an increase in the assessment on the improvement, so in reality there is no net loss and In fact probably a net gain for the Village of Rye Brook, as each improved lot comes on line and is sold. Assessor Barbara Chase sat down and the developer reveiwed the proceedings and looked at what was going to happen prospectively. As a result of that, there was a reduction in the assessment on the land, based on the assessment of comprable parcels totally surrounding that land, even taking into account that was a sub-division and a site plan approval and the other lots are single lots. One could argue that Brook II property was over assessed, so what we did was reduced the assessment for 1990. They dismissed the petitions for 88 & 89 which means the Village of Rye Brook does not have to pay back anything. Joe Pel.lino of 8 Terrace Ct. asked if this reduction would result in less revenue for the Village than was projected in the Environmental. Input Study done during the approval process for the sub-division. After some discussion, it was determined that the decrease in assessment would not negatively change the previous projection, however Administrator Russo said he would verify that. Attorney Beane stated that the houses started at 495 and now are at 540. The 1990 tentative assessment reflects the 540 number, not the 495 number. Also no one has sat down and said that based on the reduction of 23.09% and based on hypothetical sales prices for the 60 lots it will yield less than anticipated revenue. -4- 001 63-L April. 24, 1.990 Jules Harris of 12 Rock Ridge Drive stated, in answer to Joe Pellino's question, that the value that would be brought to the Village would be 400,000 forgiving of. the 23.09% is that 102,000 reduction. Attorney Beane stated that it's not 23.09% on total assessment it is 23.09% only on the land, not on the whole assessment. The assessor, Barbara Chase, will prospectively set the assessed value of the land based on this 23.09% reduction that is based on her view that the land should have been assessed all along. Also this does not have to come before either of. the School Boards as it does not involve a loss and neither school is paying any portion of any payback. Ken Heller of 22 Lincoln Ave, pointed out that if Barbara Chase is going to assess the houses in. Rye Brook according to cost of the house, the people will later complain. He feels that sales price has norhing to do with the actual assessment. On motion by Trustee Ravich, seconded by Trustee Smith, with a unanimous vote of the Board, the following Resolution was adopted: RESOLUTION RESOLVED, That the Village Board of the Village of Rye Brook hereby approves the stipulation of agreement between Brook II Ventures and the Village of Rye Brook for a 23.09% reduction of land assessment. FURTHER RESOLVED, That the Village Attorney and or the Mayor shall be authorized to enter into such an agreement. 4. CHECK REGISTER AUTHORIZATION Thereafter, on motion by Trustee Smith, seconded by Trustee Filipowski, with a unanimous vote of the Board, the following resolution was adopted: RESOLUTION CHECK REGISTER WHEREAS, the following checks, representing payment for services rendered, have been submitted to the Treasurer's Office for payment and have been certified to by the Village Administrator; -5- 00163" April 24, 1994 On-Line Checks: #00360-00560 Hand Checks: #08281-08304 Payroll Checks: #00978-01283 NOW, THEREFORE, BE IT RESOLVED, that this board hereby approves payment of the above-mentioned claims and authorizes payment thereof. 5. RATIFICATION OF POLICE UNION CONTRACT SETTLEMENT Thereafter, on motion by Trustee Smith, seconded by Trustee Filipowski, with a unanimous vote of the Board, the following Resolution was adopted: RESOLUTION i POLICE CONTRACT SETTLEMENT RESOLVED, that the proposed contract settlement between the Port Chester/Rye Brook P.B.A. and the Village of Rye Brook, providing for a 69 raise in 1990, and a 5.5% raise in 1.991, be hereby approved by the Village Board of Trustees. WRITTEN COMMUNICATIONS 6. LETTER FROM ELAINE PRICE, TOWN OF MAMARONECK COUNCILWOMAN RE: MAMARONECK SEWER TREATMENT PLAN Administrator Russo read the letter, which suggests that the Sewer Treatment Plans be upgraded to lower the level of nutrients in the discharge. This was determined to be a cause of the oxygen depletion on the Long Island Sound, which caused the fishkill in 1987 and still threatens the fish and other sea life in the sound. She is suggesting that other Municipalities follow and pass the same Resolution. It was decided that this issue be discussed at the next Agenda Meeting. -6- 0016 3� April 24, 1990 7. JAMES J. HOGAN, WES'TCHESTER COUNTY RECYCLING COORDINATOR RE: RECYCLING GRANT I After reading the letter from Mr. Hogan, Administrator. Russo informed the Board that we received a check in the amount of $6,353.00, which went towards the purchase of our woodchipper.' He also pointed out that based on our size, we had in percentage, the biggest reduction of tonage in Westchester County last year. APPROVAL OF MINUTES B. MINUTES OF MARCH 27, 1990 9. MINUTES OF APRIL 3, 1990 On motion by Trustee Smith, seconded by Trustee Fi.l. powski., the Minutes of March 27, 1990 and April. 3, 1990 were unanimously approved. Director of Public Works, Rocco Circosta reminded everyone that Friday, April. 27 was Arbor Day, on which a ceremony would be held on the Hawthorne Avenue Island at 10:30 in the morning �F for a Tree City Award for. the Village.
