APPROVING RETAINER AGREEMENT WITH MARONEY, PONZINI, & SPENCER i I 00� 76� MINUTES OF A SPECIAL MEETING VILLAGE OF RYE BROOK BOARD OF TRUSTEES VILLAGE OFFICES 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK MARCH 30, 1993 CONVENE MEETING The Meeting was called to order by Mayor Cresenzi at 5:45 p.m. in the Meeting Room and the Pledge of Allegiance followed. The following members of the Board were prate Mayor Salvatore M. Cresenzi Trustee Michele R. Daly Trustee Joseph Pellino Trustee Randy A. Solomon f Trustee Gary J. Zuckerman I i Also present were: Christopher J. Russo, Village Administrator Kenneth E. Powell, Village Attorney Allan Bader, President, Risk Management Services 0O+r7 Orl March 30, 1993 RESOLUTIONS APPROVING RETAINER AGREEMENT WITH MARONEY, PONZINI, & SPENCER Mayor Cresenzi asked if a "Request for Proposal" needed to be put out since we changed the hours required. There being no interest in going out for RFP's, Mayor Cresenzi called for a motion and second with one change to paragraph three to remove the word "Necessary" and replace it with "Requested." On Motion made by Trustee Zuckerman, seconded by Trustee Pellino, the following Resolution was hereby adopted: RESOLUTION APPROVING RETAINER AGREEMENT WITH MARONEY, PONZINI & SPENCER RESOLVED, that the Village Administrator be hereby authorized to enter into agreement with the Law firm of Maroney, Ponzini & Spencer of Tarrytown, NY for Legal Services for the year commencing April 1, 1993 through March 31, 1994; and be it FURTHER RESOLVED, that an annual retainer in the amount of$70,000 be hereby approved with accompanying provisions as outlined in the retainer agreement dated March 12, 1993 and amended in Paragraph three by the Village Board. (Retainer agreement made part of official record.) TRUSTEE DALY VOTING AYE TRUSTEE PELLINO VOTING AYE TRUSTEE SOLOMON VOTING AYE TRUSTEE ZUCKERMAN VOTING AYE MAYOR CRESENZI VOTING AYE OD4 -7Ug March 30, 1993 ADOPTION OF FINAL VILLAGE ASSESSMENT ROLL A brief discussion ensued requesting that a copy of our Grievance Day settlements be sent to the Chairperson of the Town Board of Assessment Review. On Motion made by Trustee Pellino seconded by Trustee Solomon, the following Resolution was hereby adopted: RESOLUTION FINAL VILLAGE ASSESSMENT ROLL RESOLVED, that the Assessment Roll for the Village of Rye Brook, County of Westchester, State of New York, has been completed, reviewed, corrected and adopted by the Board of Trustees of the Village of Rye Brook at a special meeting held on Tuesday, March 30, 1993 and is filed in the office of the Village Clerk of the Village of Rye Brook, New York, as of 4 April 1, 1993; and be it f FURTHER RESOLVED, that said Assessment Roll will be open to public inspection at the C Office of said Clerk of the Village of Rye Brook, New York, for fifteen (15) days after the date hereof. TRUSTEE DALY VOTING AYE TRUSTEE PELLINO VOTING AYE TRUSTEE SOLOMON VOTING AYE r TRUSTEE ZUCKERMAN VOTING AYE MAYOR CRESENZI VOTING AYE j AWARDING A WORKERS COMPENSATION INSURANCE TO LOVELL SAFETY GROUP Allan Bader, Risk Manager to the Village was present and discussed the March 18, 1993 report making a recommendation to award Workers Compensation Insurance to Lovell Safety Group. Mr. Bader's report will be made part of the official record of the meeting. On Motion made by Trustee Solomon, seconded by Trustee Pellino, the following Resolution was hereby adopted by the vote indicated below: RESOLUTION NEW YORK STATE MUNICIPALITIES WORKER'S COMPENSATION STATE FUND SAFETY GROUP #496 .WHEREAS, the Village of Rye Brook, through it's Risk Manager has solicited three proposals for Worker's Compensation Insurance; and 001410 �} March 30, 1993 WHEREAS, the proposals have been reviewed and evaluated as per the March 18, 1993 letter from Risk Management Services Inc. of which the Lovell Group has been found to be the lowest bidder meeting all requirements for admission to the program. NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook go on record with The State Insurance Fund as becoming a participant in the Municipalities Safety Group x/496 comprised of municipalities in New York State, and will abide by its rules, regulations, and by-laws; and be it FURTHER RESOLVED, that it is understood that this group has been formed for the basic purpose of: (1) immediate savings; (2) bringing about a greater degree of safety within the Municipality; and (3) surplus earnings within the Group will be paid as dividends to the participating municipalities; and be it FURTHER RESOLVED, that Risk Management Services Inc. be directed to take all actions necessary to affect this change and secure proper documentation that all claims incurred through March 31, 1993 be the responsibility of the current carrier, the State Insurance Fund.
