R E C Y C L E ! ! ! ! ! ! 00i 8.11 MINUTES OF AN AGENDA MEETING BOARD OF TRUSTEES VILLAGE OFFICES 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK FEBRUARY 12, 1991 CONVENE MEETING The Agenda Meeting of the Board of Trustees was called to order by Mayor Cresenzi at 8:05 p.m. in the Meeting Room and the Pledge of Allegiance followed. Present were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Michele R. Daly Trustee Francis L. Filipowski Trustee Robert J. Ravich Trustee Jane Saffir Smith Also present were: Christopher J. Russo, Village Administrator Edward F. Beane, Village Attorney Rocco V. Circosta, Village Engineer Lori Ann DeMarco, Ass't. to the Village Administrator Elizabeth Czajkowski, Secretary to the Village Board - 1 - 00381 February 12, 1991 RESOLUTIONS 1. APPOINTMENT OF POLICE OFFICER RESOLUTION APPOINTMENT OF POLICE OFFICER On Motion made by Trustee Filipowski, seconded by Trustee Ravich, with a unanimous vote of the Board, the following Resolution was adopted: RESOLVED, that Robert Vogt, of 52 Harding Avenue, Lynbrook, New York be hereby appointed to the probationary position of Police Officer with the Rye Brook Police Department; and be it FURTHER RESOLVED, that the probationary period for the position shall be one - year effective on the commencement date of November 1, 1990. Administrator Russo introduced our new acting Chief of Police, Robert J. Santoro, who in turn introduced newly appointed Police Officer, Robert Vogt. 2. SETTING VOTER REGISTRATION DAY FOR VILLAGE ELECTION: MARCH 9, 1991 RESOLUTION VILLAGE OF RYE BROOK LEGAL NOTICE REGISTRATION OF VOTERS On Motion made by Trustee Smith, seconded by Trustee Ravich, with a unanimous vote of the Board, the following Resolution was adopted: WHEREAS, pursuant to Section 15-118, Sub. 3 (a,b & c) of the Election Law, the Board of Trustees is required to designate the hours for the Registration of Voters; the date of Registration being fixed by the law as the 10th day preceding the Election (March 9, 1991) ; and 2 - 00 .13 February 12, 1991 WHEREAS, the Board of Trustees has determined that more than one half of voters qualified to vote at the forthcoming Village Election were personally registered at the last preceding General Election, other than a Village Election, and registration in a single location will be accomplished more efficiently and economically; NOW, THEREFORE, BE IT RESOLVED, that in accordance with Section 15-118 (Sub. 9) of the Election Law, the locations where the Registration of Voters is normally held shall be consolidated into a single place, to wit: RYE BROOK VILLAGE OFFICE, 90 SOUTH RIDGE STREET and be it FURTHER RESOLVED, that a single Board of Elections shall be used for taking the Registration for each Election District; and be it FURTHER RESOLVED, that the Village Clerk is hereby authorized to appoint an Election Inspector and a Clerical Assistant, who shall also act as an Alternate Inspector if necessary, to serve on Registration Day; and be it FURTHER RESOLVED, that if said Inspector of Election or Clerical Assistant is unable to serve on Registration Day, the Village Clerk is authorized to appoint an Alternate Inspector; and be it FURTHER RESOLVED, that the Inspector of Election shall prepare a register for such Village Election in the manner provided by law and shall meet on the 10th day preceding the coming annual Village Election, to wit: March 9, 1991 at the Village Office, 90 South Ridge Street, between the hours of 12:00 Moon and 9:00 P.M. on that day, for the purpose of completing said register of the Village; and be it - FURTHER RESOLVED, that the Village Clerk shall furnish, at the Village's expense, the necessary blank books in connection with such Registration and Election; and it is FURTHER RESOLVED, that the Inspector of Election and Clerical Assistant shall each receive the sum of Eight ($8) Dollars per hour as their compensation. Administrator Russo explained that this resolution notices March 9, 1991 as Personal Registration Day in the Village of Rye Brook. 3 - February 12, 1991 3. RELOCATION OF THE ENVIRONMENTAL PROTECTION AGENCY REGIONAL OFFICE TO RYE TOWN PARK RESOLUTION RELOCATION OF THE ENVIRONMENTAL PROTECTION AGENCY REGIONAL OFFICE TO RYE TOWN PARK On Motion made by Trustee Smith, seconded by Trustee Ravich, with a unanimous vote of the Board, the following Resolution was adopted: WHEREAS, Long Island Sound is a precious asset for the people of the Village of Rye Brook and all of Westchester County; and WHEREAS, the Congress of the United States has established a Long Island Sound Conservancy within the Environmental Protection Agency to help preserve this precious asset and restore it to health; and WHEREAS, the EPA is looking for a location for this new office; and WHEREAS, a Westchester location would help this office in carrying out its mission because of convenience and also because it is part of the Sound that is most severely threatened; and WHEREAS, RYE TOWN PARK is located on the Sound and the Village of Rye Brook is highly supportive of the EPA's efforts, and Rye Town Park is easily accessible by interstate highway, rail and from the major metropolitan New York airports; NOW, THEREFORE BE IT RESOLVED, that the Village of Rye Brook heartily endorses the location of the EPA office in Rye at Rye Town Park and is willing to extend all of the support the EPA might need; and be it FURTHER RESOLVED, that specifically the Village of Rye Brook encourages the location of the office at the ADMINISTRATION BUILDING at Rye Town Park, which is both ideally suitable both by history and location, and where the necessary facilities can be made available at reasonable cost; and finally, be it RESOLVED, that the Village of Rye Brook supports the efforts of Representative Nita M. Lowey to persuade the EPA that the new office should be located in Westchester County and commends her for her leadership and initiative in getting the Long Island Sound Conservancy established; - 4 - 18.1i� February 12, 1991 Mayor Cresenzi stated that the Rye Town Park Commission has been working closely with Nita Lowey. The City of Rye and the Town of Rye have passed a similar Resolution. It would be a great asset to Rye Town Park to have the EPA located there. Mayor Cresenzi added that it is a beautiful setting consisting of 62 acres of natural land. 4. PROPOSED SALES TAX AMENDMENT RESOLUTION PROPOSED SALES TAX AMENDMENT On Motion made by Trustee Ravich, seconded by Trustee Smith, with a unanimous vote of the Board, the following Resolution was adopted: WHEREAS, Towns and Villages in Westchester County are severely restricted in their revenue base, with real property tax as their main source of revenue constantly rising and putting a disproportionate burden on the already high cost of housing, and WHEREAS, The County Executive and Board of Legislators are advocating distribution of the major part of a new sales tax levy to the Towns, Villages and School Districts, NOW, THEREFORE., BE IT RESOLVED, that the Village of Rye Brook in concert with other Villages and Towns in the Westchester County Municipal Officials Association, Petition the Legislature of New York State to amend Article 29, 1262B of the Tax Law, entitled "Disposition of Revenue from Sales and Use Taxes Imposed by Westchester County", to change the permissive distribution of sales tax revenues to Town, Villages and School Districts. AND BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the State Assemblyman and to the State Senator of this District; to the County Legislator of this District; to lend our support to the County Executive's Proposal, and BE IT ALSO FURTHER RESOLVED, that notification of our action be forwarded to the Administrative Assistant of WCMOA, and to the news media of this district. Mayor Cresenzi reinforced the point that if this proposal is passed by the State Legislature, any money derived from the sales tax would be used to reduce property taxes which would, in turn, be a great benefit to the community. - 5 - February 12, 1991 00181.0 5. YOUTH BUREAU RESOLUTION YOUTH BUREAU On Motion made by Trustee Ravich, seconded by Trustee Smith, with a unanimous vote of the Board, the fallowing Resolution was adopted: WHEREAS, the Village of Rye Brook and the Village of Port Chester have agreed to share the services of the Port Chester Youth Bureau; and WHEREAS, this service shall consist of approximately one day a week of the Youth Bureau's time to be concentrated on matters relating to the Village of Rye Brook, but not limited to the implementation of the Youth Court and assistance to the Rye Brook Youth Officer, NOW, THEREFORE, BE IT RESOLVED, that the Village Board of Trustees of the Village of Rye Brook hereby authorizes the Village Administrator to enter into agreement with the Village of Port Chester for a cooperative arrangement to share the services of the Port Chester Youth Bureau at a cost not to exceed $10,000 annually. Trustee Filipowski inquired what percent our $10,000 contribution would effect. Mayor Cresenzi stated that it would effect 200 of the cost. ITEMS FOR FEBRUARY 26, 1991 PUBLIC HEARING ADOPTION OF VILLAGE OF RYE BROOK CODE RESOLUTION KING STREET NURSING HOME SITE PLAN APPROVAL SECTION 1, BLOCK 8, LOT 3A DECLARING THE CANDIDATES FOR VILLAGE ELECTION, MARCH 19, 1991 6 - 00181, r February 12, 1991 NEXT MEETING DATES GRIEVANCE DAY - FEBRUARY 19, 1991 6:00 P.M. - 10.00 P.M. REGULAR MEETING - FEBRUARY 26, 1991 8:00 P.M. Ed Beane, Village Attorney stated that there are several matters that the Board should consider adding to the February 26, 1991 meeting agenda. The first item is the acceptance of the dedication of Candy Lane. The necessary documentation and title work, are available, therefore, it is appropriate that the Village now officially accept the dedication of Candy Lane. The second item concerns a Consolidation Resolution to incorporate all prior resolutions with respect to the lease of this building, and the square footage and the percentage of office space that we occupy. A Resolution should be passed to clarify the various square footages that comprise the total square footage that becomes office space in the event that the Village ceases to be a tenant. It is a technical resolution but it is an important one. It would better serve the Village to have one resolution, addressing this item rather than four or five resolutions. Trustee Filipowski suggested that Attorney Beane give a report on the status of the legal situation related to the High Point Hospital property at the next meeting. Mayor Cresenzi stated that the Meeting Dates for.
