DESIGNATING POLLING PLACES FOR VILLAGE OF RYE BROOK ELECTION MARCH 17, 1992 On Motion made by Trustee Ravich, seconded by Trustee Pellino, the following Resolution was adopted: RESOLUTION DESIGNATION OF POLLING PLACES FOR VILLAGE ELECTION MARCH 17, 1992 RESOLVED, that voting machines owned by the Town of Rye shall be used at the next Village Election held on Tuesday, March 17, 1992; and be it FURTHER RESOLVED, that if said voting machines are not available, the use of paper ballots is hereby authorized; and be it FURTHER RESOLVED, that the polls in each of the seven Election Districts shall be opened. at 7:00 A.M. inthe morning and remain open until 9:00 P.M. in the evening of said day; and be it FURTHER RESOLVED, that the polling places be, and they hereby are, designated for the respective Election Districts as follows: #20 Port-Chester Middle. ADOPTING PROCUREMENT POLICY FOR THE VILLAGE. OF RYE BROOK On Motion made by Trustee Pellino, seconded by Trustee Daly, the following Resolution was adopted: RESOLUTION PROCUREMENT POLICY REGARDING BIDDING REQUIREMENTS RESOLVED, thatin accordance with recently adopted N.Y. State Law governing the bidding and purchasing requirements for Villages in the State, the Village Board of Trustees of the Village of Rye Brook hereby approves the attached Procurement Policy in accordance with. the State's new guidelines;. and be it FURTHER RESOLVED, that such policy shall be effective immediately. Trustee Solomon questioned if this is the minimum and if this prevents us from doing anything additional as far as amending to our procurement policy. Administrator Russo stated that there was a change that to this, Public Works contracts in the amount of $7,000 or more had to go to bid. Currently, the amount is $20,000 or more. Purchase contracts that were at $5,000 are now at $10,000 and require bidding. Trustee Solomon questioned if we preferred to put something out to bid for a lesser amount than that. I Administrator Russo stated that we could do that, as we have in the past, but we can also receive written proposals as we didforthe renovations that were done in the Police Department. Mayor Cresenzi stated that we try to substantiate as much as we can in writing where other governments are not as concerned. PROCUREMENT POLICY FOR THE VILLAGE OF RYE BROOK 1. Every purchase to be made must be initially reviewed to determine whether it is a purchase contract or a public works contract. Once that determination is made, a good faith effort will be made to determine whether it is known or can reasonably be expected that the aggregate amount to be spent on the item of supply or service is not subject to competitive bidding, taking into account past purchases and the aggregate amount to be spent in a year. The following items are not subject to competitive bidding pursuant to Section 103 of the General Municipal Law: purchase contracts under $10,000 and public works contracts under $20,000, emergency purchases, certain municipal hospital purchases, goods purchased from agencies for the blind or severely handicapped, goods purchased form correctional institutions, purchases under state and county contracts, and surplus and second-hand purchases from another governmental entity. - 4 - January 14, 1992 The decision that a purchase is not subject to competitive bidding will be documented in writing by the individual making the purchase. This documentation may include written or verbal quotes from vendors, a memo from the purchaser indicating how the decision was arrived at, a copy of the contract indicating the source which makes the item or service exempt, a memo from the purchaser detailing the circumstances which led to an emergency purchase, of any other written documentation that is appropriate. 2. All goods and services will be secured by use of written requests for proposals, written quotations verbal quotations, or any other method that assures that goods will be purchased at the lowest price and that favoritism will be avoided, except in the following circumstances: purchase contracts over $10,000 and public works contracts over $20,000, goods purchased from agencies for the blind or severely handicapped pursuant to Section 175-b of the State Finance Law, goods purchased from correctional institutions pursuant to 186 of the Correction Law, purchases under state contracts pursuant to Section 104 of the General Municipal Law, or purchases pursuant to subdivision 6 of this policy. 3. The following method of purchase will be used when required by this policy in order to achieve the highest savings: ESTIMATED AMOUNT METHOD OF PURCHASE CONTRACT $250 - $2,999 Verbal Quotations $3,000 - $9,999 Written/Fax Quotations Written Request for Proposals ESTIMATED AMOUNT METHOD OF PUBLIC WORKS CONTRACT $250 - $2,999 Verbal Quotations $3,000 - $4,999 Written/Fax Quotations $5,000 - $19,999 Written/Fax Quotations or Written Request for Proposals A good faith effort shall be made to obtain the required number of proposals of quotations. If the purchaser is unable to obtain the required number of proposals or quotations, the purchaser will document the attempt made at obtaining the proposals. In no event shall the failure to obtain the proposals be a bar to the procurement. 4. Documentation is required of each action taken in connection with each procurement. - 5 - 0031041 January 14, 1992 5. Documentation and an explanation is required whenever a contract is awarded to other than the lowest responsible offeror. This documentation will include an explanation of how the award will achieve savings or how the offeror was not responsible. A determination that the offeror is not responsible shall be made by the purchaser and may not be challenged under: any circumstances. 6. Pursuant to General. Municipal Law Section 104-b(2) (f), the procurement policy may contain circumstances when, or types of procurement for which, in the sole discretion of the governing body, the solicitation of alternative proposals or quotations will not be in the best interest of the municipality. In the following circumstances it may not be in the best interest of the Village of Rye Brook to solicit quotations or document the basis for not accepting the lowest bid: A. Professional services or services requiring special or technical skill, training or expertise. The individual or company must be chosen based on accountability, reliability, responsibility, skill, education and training, judgment, integrity and moral worth. These qualifications are not necessarily found in the individual. company that offers the lowest price and the nature of these services are such that they do not readily lend themselves to competitive procurement procedures. In determining whether a service fits into this category the Board of Trustees shall take into consideration the following guidelines: (a) whether the services are subject to state licensing or testing requirements, (b) whether substantial formal education or training is a necessary prerequisite to the performance of services, and (c) whether the services require a personal relationship between the individual and municipal officials. Professional or technical services shall include but not be limited to the following: services of an attorney, services of a physician, services of an architect, technical services of an engineer engaged to prepare plans, maps and estimates, securing insurance coverage and/or services of an insurance broker, services of a certified public accountant, investment management services, printing services involving extensive writing, editing or art work, management of municipally owned property, and computer software or programming services for customized programs, or services involved in substantial modification and customizing of pre-packaged software. B. Emergency purchases pursuant to Section 103(4) of the General Municipal Law. Due to the nature of this exception, these goods or services must be purchased immediately and a delay in order to seek alternate proposals may threaten the life, health, safety, or welfare of the residents. This section does not preclude alternate proposals if time permits. - 6 - 0030 January 14, 1992. C. Purchases of surplus and second-hand goods from any source. If alternate proposals are required, the Village is precluded from purchasing surplus and second-hand goods at auctions or through specific advertising sources where the best prices are usually obtained. It is also difficult to try to compare prices of used goods and a lower price may indicate an older product.. D. Goods or services under $250. The time and. documentation required to purchase through this policy may be more costly than the item itself and would, therefore, not be in the best interests of the taxpayer. In addition, it is not likely that such de minimus contracts would be awarded based on favoritism. 7. This policy shall be effective immediately. Trustee Solomon questioned if this is the minimum according to the State. Administrator Russo stated that prior to this, the Public Works contracts of seven thousand dollars or more had to go to bid and now it is twenty thousand dollars or more. Purchase contracts which were five thousand are now ten thousand. For the renovations in the Police Dept, we received some written proposals prior to contracting anyone. TRUSTEE DALY VOTING AYE TRUSTEE PELLINO VOTING AYE TRUSTEE RAVICH VOTING AYE TRUSTEE SOLOMON VOTING AYE MAYOR CRE.SENZI VOTING AYE 5. AMENDING EMPLOYEE BENEFITS & POLICIES PACKAGE On Motion made by Trustee Solomon, seconded by Trustee Ravich, the following Resolution was adopted: RESOLUTION AMENDMENT TO EMPLOYEE BENEFITS & POLICIES PACKAGE RESOLVED, that the Rye Brook Employee Benefits and Policies Package adopted by the Village Board of Trustees on September 27, 1988, and amended on June 26, 1990, and February 26, 1991, be hereby further amended with regard to Section 29 entitled Professional Development to include the following: - 7 003 10 January 14, 1992 "The Village of Rye Brook will pay $500 towards the membership fee per year for employees who join Therafit, which is a health, fitness and physical therapy facility located at 4 Gannet Drive, White Plains, New York. It is a Work Hardening Program. The Village will make payment on a reimbursement. basis upon completion of each year of membership. An employee must attend Therafit at least three (3) times per month for a twelve consecutive month period. Payment will be upon completion of each. year. This membership fee is considered part of Professional Development." Administrator Russo explained that this is not something new as the Professional Development benefits are currently available to employees. This just adds to the allowable uses. It is a therapeutic facility, riot a health club. Time is very structured and an appointment must be made before attending. Trustee Daly questioned if this package included Police and Highway. Administrator Russo explained that this includes Highway but not Police. Police contracts must be negotiated. Skip Latella, our contact person, will provide us with records of how often our !, employees attend per month. Trustee Pellino stated that since this is an amendment to our Benefits and Policies Package, if we find that the utilization is not high what is the procedure to withdraw this option? Administrator Russo stated that we will. amend the package again. Trustee Solomon questioned what the outcome would be if the place is closed down? Administrator Russo stated that the program would not be offered any longer. TRUSTEE DALY VOTING AYE TRUSTEE PELLINO VOTING AYE TRUSTEE RAVICH VOTING AYE TRUSTEE SOLOMON VOTING AYE MAYOR CRESENZI VOTING AYE 6. RATIFYING PLACEMENT AUTO & LIABILITY INSURANCE Administrator Russo stated that we were able to obtain an additional 5 million dollar umbrella coverage, bringing the total to 1.0 million dollars in liability umbrella coverage, which is an additional 10 thousand dollars in premium. Roger Herman of 25 Lincoln Avenue questioned what is going on with the Risk Manager and how the Village is saving money. _ g _ �CJa� 1t? i January 14, 1992 Administrator Russo stated that in December of 1990 we retained Mr. Alan Bader, as a Risk Manager to review our insurance coverages and make recommendations as to bidding out our insurance. The rates were fairly low and we have never had a problem having plenty of coverage until rates started to escalate. He solicited proposals from other brokers and we have ended up increasing our coverage especially in the area of our Umbrella coverage. We have increased our coverages in all the correct areas, which will reduce our rates conservatively. Mr. Herman questioned who the actual carrier is. Administrator Russo replied that the actual carrier is Traveler's Insurance as of December 31, 1991. RESOLUTION AUTO & LIABILITY INSURANCE On Motion made by Trustee Solomon, seconded by Trustee Daly, the following Resolution was adopted. WHEREAS, the Village of Rye Brook had retained Risk Management Services Inc. to review, prepare specifications and solicit proposals to meet the auto and liability insurance needs of the Village; and WHEREAS, Risk Management Services, Inc. over the past several months has conducted such a process which has resulted in the future savings of approximately $16,000 annually for Automobile liability, and approximately $40,000 savings from the combined reduced premium for general liability and umbrella liability coverage; and li WHEREAS, coverage on the excess liability program has increased from 2 million per occurrence to 5 million per occurrence, with broader terms and conditions. NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook Board of Trustees hereby ratify the placement of the Villages' liability insurance coverage, including, but not limited to, automobile and liability with the Travelers Insurance Company, brokered by the Alliance Brokerage Corporation, Westbury, N.Y, effective: January 1, 1992, such placement shall be for an interim period to expire on the Villages' fiscal year (May 31, 1992) and subsequent coverage to be based upon the June 1 - May 31st fiscal year. EAST CONSORTIUM 1992 INTER-MUNICIPAL. AGREEMENT On Motion made by Trustee Daly, seconded by Trustee Ravich, the following Resolution was adopted: RESOLUTION 1992 SOUTH EAST CONSORTIUM FOR SPECIAL SERVICES, INC. INTER-MUNICIPAL AGREEMENT RESOLVED, that the Village Administrator, of the Village of Rye Brook is hereby authorized to enter into an Inter-Municipal Agreement with the South East Consortium for Special Services, Inc. for the 1992 calendar vear for an amount of $3,186.00 to provide a collective program of special recreation services for disabled individuals through participation in sponsored programs. APPOINTING REGISTRAR OF VITAL STATISTICS On Motion made by Trustee Solomon, seconded by Trustee Daly, the following Resolution was adopted: RESOLUTION REGISTRAR OF VITAL STATISTICS VILLAGE OF RYE BROOK. RESOLVED, that Frances C. Nugent, Town Clerk of the Town of Rye, is hereby appointed as Registrar of Vital Statistics for the Village of Rye Brook this 14th day of January, 1992; and be it FURTHER RESOLVED, the said term of office shall be for a period of two years, commencing on the 1st day of January, 1992 and concluding on the 31st day of December, 1993. CIRCOSTA Administrator Russo read a letter from Mark & Ellen Harmon and explained that Mrs. Harmon had accidentally dumped a wallet in with the recyclables at the curb. The wallet contained a substantial amount of cash_ Through Mr. Circosta's efforts and the work of people at Suburban Carting, the wallet along with the cash was retrieved. The Mayor and Board of Trustees commended Mr. Circosta for his efforts. Administrator Russo stated that the Board also received a thank you letter from Mr. Ken Heller at Lincoln Avenue for the outstanding job done on the apron area of his driveway which was related. to the Lincoln Avenue resurfacing project. DECEMBER 17, 1991 - 11 - 00311U January 14, 1992 Mr. Herman questioned if the Registrar of Vital. Statistics is a salaried position? Mayor Cresenzi replied that the Register of Vital Statistics issues Death Certificates, Marriage licenses, Dog licenses, etc. for the Village and Ms. Nugent is not paid a salary for this service. Trustee Solomon inquired if there was anything new going on with the Anthony J. Posillipo Community Center? Administrator Russo stated that it is moving along fine. Steve Yaraback has started the environmental review under. the S) QRA Law. Mr. Moore is busy working on the plans and will be returning to the Center to keep the Seniors updated.. The target day for the completion of the architectural drawings is April 1, 1992. Mayor Cresenzi stated that he had hoped the actual construction could start in October. Trustee Pellino questioned if Mr. Moore's designs would be confined to the new building and if so could we sometime soon come to conclusions and entertain further suggestions from the Board regarding the parking situation? Mayor Cresenzi stated that when we originally completed the parking project three years ago, it was considered the first phase of the rebuild of the center. We are now in the second phase, which is the design and eventual construction of the facility. Then we will be looking into the different alternatives for a parking area, such as the corner lot, etc. Trustee Solomon questioned if Mr. Moore could include plans for parking. Mayor Cresenzi stated that we could do that in house. Trustee Solomon questioned if we could remove the grate out of the children's area, in Garibaldi Park as it is very dangerous. Mayor Cresenzi stated that this would need to he looked into to see exactly what is involved. Roger Herman questioned if there was any movement on the swimming pool? Mayor Cresenzi stated that as of now we have only accepted the report. Trustee Daly stated that she heard from someone in the Village that a rumor is going around that we are building three pools in various areas of the Village of Rye Brook. - 12 - 00 1 11 January 14, 1992 i Trustee Solomon questioned if we have received documentation requested from Rye Town. Administrator Russo stated that he spoke with the new Supervisor and will be getting together to discuss things. He has already received an inventory of the Villages' Recreation needs at Crawford Park. Mayor Cresenzi stated that we will be receiving their Agenda and each month will be sending the Town our Agenda. Attorney Beane requested that when we have a meeting we include the Village and Town Counsel. Administrator Russo agreed with Attorney Beane. Trustee Solomon suggested that we adjourn into Fxecutive Session to discuss the Village Attorney position. ADJOURNMFNT On Motion made by Trustee Ravich, seconded by Trustee Solomon, the Meeting was adjourned into Executive session for personnel litigation at 8:35 p-m.
