THE BOARD OF TRUSTEES OF THE
VILLAGE OF RYE BROOK, HELD ON THE
8th DAY OF DECEMBER, 1987 IN THE
VILLAGE OFFICES, 90 SOUTH RIDGE STREET
RYE BROOK, NEW YORK
CONVENE MEETING
The meeting of the Village Board was called to order by
Mayor Kabcenell at 8:05 P.M. ; the Pledge of Allegiance
followed.
Present were the following members of the Board:
Mayor Jack L. Kabcenell
Trustee Milton Meiskin
Trustee Salvatore Cresenzi
Trustee Frank Filipowski
Trustee Mario J. Nardi was not in attendance for this
meeting.
Also present were:

Rye Brook Auxiliary Police - Swearing In Ceremony
Mayor Kabcenell announced that the members of the Rye Brook
Auxiliary Police were sworn in earlier this evening and
their signed Oath of Office will remain on file in the
Clerk's Office. "It's nice to know that these gentlemen
are willing to put forth this effort on behalf of the
Village," Mayor Kabcenell offered.

PUBLIC HEARINGS
1. Enabling Legislation to enact 57-738 of the Village Law
On motion by Trustee Meiskin, seconded by Trustee
Filipowski, it was unanimously
RESOLVED, that this Board hereby sets
Tuesday, January 26, 1988 at 8:00 P.M. ,
in the Village Offices, 90 South Ridge
Street, as the date, time and place for a
Public Hearing to consider enabling
Legislation to enact Section 7-738 of the
Village Law: Approval of plats; condi-
tions for changes in zoning provisions;
and be it
FURTHER RESOLVED, that the Deputy Village
Clerk is hereby authorized to publish the
Notice of said Public Hearing in the
Official Newspapers of the Village of Rye
Brook.

2. Rye Ridge Shopping Center/Merritt & Holby -
a) Rezoning Approval
b) and Preliminary Site Plan Approval
On motion by Trustee Cresenzi, seconded by Trustee
Filipowski, it was unanimously
RESOLVED, that this Board hereby sets
Tuesday, January 26, 1988 at 8:00 P.M. ,
in the Village Offices, 90 South Ridge
Street, as the date, time and place for a
Public Hearing to consider the appli-
cation of Merritt & Holby for rezoning a
portion of the premises known as Rye
Ridge Professional Offices, Bowman
Avenue, and known on the Tax Assessment
Map of the Village of Rye Brook as
Section 1, Block 22, Lots 4A-H, 39, from
an R2-F zone to a C1-P zoning classifi-
cation; and be it
FURTHER RESOLVED that at said Public
Hearing, the Board will also consider the
application of Merritt & Holby for
Preliminary Site Plan Approval to allow
the construction of an addition for
professional offices at the premises
above-described, and known on the Tax
Assessment Map of the Village of Rye
Brook as Section 1, Block 22, Lot 3A; and
be it
FURTHER RESOLVED, that the Deputy Village
Clerk is hereby authorized to publish the
Notice of said Public Hearing in the
Official Newspapers of the Village of Rye
Brook.
Mayor Kabcenell then requested that the Planning Board be
informed of the January 26th date for the Public Hearing.

REFERRALS TO THE PLANNING BOARD
3. Brook II Ventures -
a) Withdrawal of Application for Rezoning
b) Submission of new Application for Preliminary
Subdivision Approval
A letter from Berner and Evans, Attorneys for Brook II
Ventures, Inc./Alamit Properties, was read into the record
by Mayor Kabcenell.
Thereafter, on motion by Trustee Meiskin, seconded by
Trustee Cresenzi, it was unanimously
RESOLVED, that the application of Brook
II Ventures for Preliminary Subdivision
Approval be referred to the Planning
Board for their review and recommenda-
tions.
Stan Zak, a former Village Trustee, voiced his upset over
the fact that the developers were withdrawing their original
application for cluster housing, and Mayor Kabcenell
explained that the owner had the right to submit whatever
plans they wanted; it did not mean that they would be
necessarily be accepted.
When questioned about the DEIS by Trustee Cresenzi, Attorney
Kramer replied that the developers have requested permission
to amend their original submission. However, Bernie Klem of
the Planning Board, stated that the original DEIS will
actually be null and void and that they will end up having
to submit a new one by the time all the changes are made.
4. Heritage at Rye Brook - Rezoning & Development Proposal
This was formerly the hotel property of LaReserve and the
owner is now requesting a zoning change so the property can
be used for residential purposes.

Thereafter, on motion by Trustee Cresenzi, seconded by
Trustee Filipowski, it was unanimously
RESOLVED, that the application of Brook
II Ventures for Preliminary Subdivision
Approval be referred to the Planning
Board for their review and recommenda-
tions.
At this time, Mayor Kabcenell read the following resolution
which, on motion by Trustee Cresenzi and seconded by Trustee
Filipowski, was unanimously adopted:
HERITAGE AT RYE BROOK
ANDERSON HILL ROAD & KING STREET
SECTION 1, BLOCK 4, LOTS 5, 6, 7A & 7A1
WHEREAS, this parcel represents one of
the few remaining large tracts of land
within the Village of Rye Brook; and
WHEREAS, the Village of Rye Brook is
dedicated to ensuring the safety, health
and well-being of those residing in the
area and surroundings; and
WHEREAS, the environmental impact of
this proposed development must be
considered in context with the develop-
ment potential of the area; and
WHEREAS, the developers have agreed to
cooperate by providing further for an
environmental impact study to be
conducted by the Planning Consultants of
the Village;
NOW, THEREFORE, BE IT RESOLVED, that
this Board, in acknowledgment of the
significance of any development in this
area and any environmental impact
therefrom, hereby directs the Village
Planning Consultants, Frederick P. Clark
Associates, to conduct all environmental
studies necessary to consider both the
proposed development and any subsequent
proposal which may be presented for the
subject property; and

BE IT FURTHER RESOLVED, that this study
be funded by the developer through the
Village Environmental Impact Account
with the Village Administrator hereby
being authorized to negotiate with the
developer to determine said amount of
contribution.
William V. Cuddy, Attorney for the Heritage Development,
stated for the record that on behalf of the developer, he
was in total agreement with the terms of this resolution.

RESOLUTIONS/DISCUSSION
5. Arrowwood Certiorari - Approval of Settlement
A letter from the Assessor, Barbara Chase, recommending
acceptance of the tax reduction was read by Mayor Kabcenell.
The Deputy Clerk, Jean Marra, stated that she received a
phone call from Victor Hade, the Attorney for Arrowwood, and
that he was in agreement with the proposed changes on page
three of the Consent Judgment.
Thereafter, on motion by Trustee Meiskin, seconded by
Trustee Cresenzi, with a unanimous vote of the Board, the
following resolution was adopted:
ARROWWOOD REALTY CORP.
WHEREAS, pursuant to Article 7 of the
Real Property Tax Law, Arrowwood Realty
Corp. served and filed a Petition and
Notice to review the tax assessment fixed
by the Village of Rye Brook for the
assessment year 1987 upon certain real
property located on Anderson Hill Road
and designated as Section 1, Block 3, Lot
5A on the Official Assessment Map of the
Village of Rye Brook;

NOW, THEREFORE, BE IT RESOLVED that, on
the recommendation of the Village
Assessor and in accordance with the terms
as explained by the Village Attorney and
set forth in the Consent Judgment, this
Board hereby authorizes a settlement of
the certiorari proceedings -- KSB
ARROWWOOD REALTY CORP. v. VILLAGE OF RYE
BROOK -- for assessment year 1987; and
BE IT FURTHER RESOLVED, that the Village
Attorney is hereby authorized to execute
said Consent Judgment.
6. Church of the Advent Subdivision -
Extension of Time to Build
Following a brief explanation by Mayor Kabcenell, and on
motion by Trustee Cresenzi, seconded by Trustee Meiskin,
with a unanimous vote of the Board, the following
resolution was adopted:
CHURCH OF THE ADVENT SUBDIVISION
EXTENSION OF TIME TO BUILD
WHEREAS, the Board of Trustees has
approved the subdivision plat for the
development of three homes off Comly
Avenue; which subdivision plat is
entitled "Subdivision Map Prepared for
Anglican Church of the Advent by
Aristotle Bournazos" and filed with the
County of Westchester, Division of Land
Records, on September 25, 1987; and
WHEREAS, an extension of time within
which to start building has been
requested; and
WHEREAS, this Board is in agreement that
additional time is appropriate to com-
mence development of said subdivision;

NOW, THEREFORE, BE IT RESOLVED, that the
time within which a Building Permit may
be issued to begin development of said
subdivision is hereby extended to the 1st
day of January, 1989.

7. Lot Coverage
It was explained by Mayor Kabcenell that the Village
Engineer did some careful review of what other munici-
palities have done regarding placing restrictions on lot
density/coverage, and Mr. Circosta requested that the Board
review the information just furnished them. He further
stated that this information would be furnished to the
Planning Board and Zoning Board for their review and
recommendations as well. Mr. Circosta then recommended
that this matter be set for a public hearing.
Thereafter, on motion by Trustee Meiskin, seconded by
Trustee Filipowski, it was unanimously
RESOLVED, that this Board hereby sets
Tuesday, January 26, 1988 at 8:00 P.M. ,
in the Village Offices, 90 South Ridge
Street, as the date, time and place for a
Public Hearing to consider establishing
regulations for controlling the maximum
permitted coverage on parcels of property
by amending the Zoning Law of the Village
of Rye Brook; and be it
FURTHER RESOLVED, that the Deputy Village
Clerk is hereby authorized to publish the
Notice of said Public Hearing in the
Official Newspapers of the Village of Rye
Brook.
Trustee Meiskin requested that he be furnished information
on deck coverage and Trustee Cresenzi requested that similar
information on accessory buildings be included as well.

APPOINTMENTS/AUTHORIZATION
8. Appointment of Patricia Pagli - Recreation Department
Mrs. Pagli has worked for the Village as an hourly employee
on and off for four years, Mayor Kabcenell stated, adding
that he was delighted to make this particular appointment.
Thereafter, on motion by Trustee Meiskin, seconded by
Trustee Filipowski, it was unanimously
RESOLVED, that Patricia Pagli, of
19 Elm Hill Drive, Rye Brook, be, and
she hereby is, appointed as Typist for
the Village of Rye Brook, Department of
Parks and Recreation; and be it
FURTHER RESOLVED, that she be
compensated at the annual salary of
$16,000 effective December 24, 1987.

9. Appointment of Village Accountant - Frank Sesta
Administrator Russo announced that he was delighted to
recommend the appointment of Mr. Sesta as the Village
Accountant. If anything, Mr. Sesta is "over qualified" for
the position, Mr. Russo stated, adding that the accountant
is a native of this area, via Port Saint Lucie, Florida
where he worked for the County Sheriff's Department.
Thereafter, on motion by Trustee Meiskin, seconded by
Trustee Filipowski, it was unanimously
RESOLVED, that Frank Sesta, of
225 Murray Avenue, Yonkers, be, and he
hereby is, provisionally appointed as
Village Accountant for the Village of
Rye Brook; and be it
FURTHER RESOLVED, that Mr. Sesta
be compensated at the annual salary of
$32,000 effective January 4, 1988.

Administrator Russo proceeded to introduce Frank Sesta and
his wife, Mary, to Mayor Kabcenell and the members of the
Board. A warm welcome was extended by Mayor Kabcenell and
the Board to Mr. Sesta and his lovely wife.

10. Planning Board - Resignation of Morton Corwin
Mayor Kabcenell stated it was with sincere regret that he
read the following letter of resignation from Planning
Board member, Morton Corwin:
"With extreme regret, I herewith submit my resignation
from the Rye Brook Planning Board effective the end of
1987. I have been a member of the Rye Town and Rye
Brook Planning Boards for more than sixteen years and
appreciate the opportunity to have served both
communities.
"I believe that Rye Brook has made a fine beginning,
and I wish you continued success in the future.
"Sincerely yours,
"/s/ Morton Corwin"
"We are all sorry that Mort will no longer be with us,"
Mayor Kabcenell added.
11. Snow Removal Agreement with Westchester County
Mayor Kabcenell announced that this was standard procedure,
and on motion by Trustee Meiskin, seconded by Trustee
Cresenzi, with a unanimous vote of the Board, the following
resolution was adopted:

SNOW REMOVAL - COUNTY ROADS
1987/88 WINTER SEASON
RESOLVED, that Mayor Kabcenell be, and
he hereby is, authorized to execute an
agreement with the County of Westchester
for the removal of Snow & Ice from
County Roads located within the Village
of Rye Brook.
APPROVAL OF MINUTES
12. November 24, 1987
The Minutes of November 24, 1987 were presented and, on
motion duly made and seconded, were unanimously approved.
Trustee Cresenzi requested that a letter be written to the
Westchester County Executive expressing the Village's
opposition to any expansion at the Westchester County
Airport. Trustee Meiskin stated that letters have gone out
on behalf of the Village but Trustee Cresenzi said he would
still prefer that the Administrator send a personal letter.
ADJOURNMENT
At this time, on motion by Mayor Kabcenell, seconded by
Trustee Meiskin, it was unanimously resolved to adjourn the
meeting at 8:35 P.M.
