AUGUST 15, 1989 NEXT MEETING DATES REGULAR MEETING - SEPT. 19, 1989 AGENDA MEETING - OCT. 10, 1989 *** RECYCLE -- WE'RE WORTH IT! *** 00-AG8 MINUTES OF AN AGENDA MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF RYE BROOK, HELD ON THE 12th DAY OF SEPTEMBER, 1989 IN THE VILLAGE OFFICES 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK CONVENE MEETING The meeting of the Board of Trustees was called to order by Mayor CreSenzi at 8:05 P.M. in the Meeting Room and the Pledge of Allegiance followed. At this time, Police Chief Frank Gendalia presented the Board with his written response to the Police Study. Present were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Michele R. Mendicino Trustee Francis L. Filipowski Trustee Robert J. Ravich Trustee Jane Saffir Smith Also present were: Christopher J. Russo, Village Administrator Rocco V. Circosta, Director of Public Works Edward F. Beane, Village Attorney Jean A. Marra, Deputy Village Clerk 00. 46 September 12, 1989 WRITTEN COMMUNICATIONS A. RESIGNATION OF PLANNING BOARD MEMBER ANGELO CARDINALI Even though Angelo Cardinali only served a short time on the Planning Board, he served the Village well, Mayor Cresenzi stated. B. U.S. CONSTITUTION BICENTENNIAL The next item on the agenda is for Sunday's Flag Raising Ceremony, Mayor Cresenzi announced, and on motion by Trustee Smith, seconded by Trustee Ravich, with a unanimous vote of the Board, the following Proclamation was adopted: U.S. CONSTITUTION BICENTENNIAL WHEREAS, after four long months of debating and compromising, delegates to the Constitutional Convention signed a bold new document on September 17, 1787: the United States Constitution; and WHEREAS, the major purpose of this "Document" was to provide a political framework for uniting the then 13 states in the Union under one federal system; and WHEREAS a compromise breakthrough - one of the Constitution's 9 cornerstones - was the establishment of a checks and balances system among the three federal government branches: the Legislative, Judicial and Executive; NOW, THEREFORE, BE IT RESOLVED, that I, Salvatore M. Cresenzi, Mayor of the Village of Rye Brook, on behalf of "We the People of the United States," do hereby proclaim the 17th day of September, 1989 as NATIONAL CITIZENSHIP DAY & U.S. CONSTITUTION DAY throughout the Village of Rye Brook and strongly urge all residents to join together "in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of Liberty to ourselves and our Country." /s/ Salvatore M. ROYAL EXECUTIVE PARK - ACCEPTING SUPPLEMENTAL FEIS AS COMPLETE SET PUBLIC HEARING DATE - FINAL SITE PLAN APPROVAL: OCT. 10, 1989 This item will not be heard this evening; it will be on the agenda for September 19th instead, Mayor Cresenzi said. D. AMENDMENT TO LOCAL LAW #7-87 - FLOOD DAMAGE PREVENTION SET PUBLIC HEARING DATE - OCTOBER 24, 1989 Thereafter, on motion by Trustee Ravich, seconded by Trustee Filipowski, with a unanimous vote of the Board, the following resolution was adopted: AMENDMENT TO LOCAL LAW #7 - 87 FLOOD DAMAGE PREVENTION RESOLVED, that this Board hereby sets Tuesday, October 24, 1989, at 8:00 P.M. , at the Village Offices, 90 South Ridge Street, Rye Brook, NY, as the date, time and place for a Public Hearing to consider amending Local Law #7 - 87, Flood Damage Prevention, by repealing same and replacing it with Local Law #4 of 1989. BE IT FURTHER RESOLVED, that the Clerk is hereby authorized to publish the Notice of Public Hearing in the Official Newspapers of the Village of Rye Brook. APPOINTMENTS E. RECREATION LEADER - ANDREA JACOBY There will be a new addition to the Recreation Department's staff, Mayor Cresenzi announced, and Thomas Hroncich, the Superintendent of Parks & Recreation proceeded to introduce Andrea Jacoby. Thereafter, on motion by Trustee Smith, seconded by Trustee Filipowski, with a unanimous vote of the Board, the following resolution was adopted: RECREATION LEADER RESOLVED, that Andrea Ann Jacoby is hereby appointed to the position of Recreation Leader with the Rye Brook Department of Parks and Recreation; and be it FURTHER RESOLVED, that this provisional appointment be effective September 14, 1989 at the starting salary of $22,500 as specified in the previously approved step plan for this position. 3 - 00141 .t. September 12, 1989 PLANNING BOARD REFERRAL F. SPECIAL USE PERMIT - 248 SOUTH RIDGE STREET / BROCCOLO On motion by Trustee Mendicino, seconded by Trustee Ravich, with a unanimous vote of the Board, the following resolution was adopted: SPECIAL USE PERMIT APPLICATION 248 SOUTH RIDGE STREET SECTION 1, BLOCK 22B, LOTS 4AB10 & 4AB11 PLANNING BOARD REFERRAL WHEREAS, an application for a Special Use Permit was received from Edward & Marcia Broccolo to use the premises located at 248 South Ridge Street for an Accounting Office. Said premises being known on the Tax Assessment Map of the Village of Rye Brook as Section 1, Block 22B, Lots 4AB10 & 4AB11 ; NOW, THEREFORE, BE IT RESOLVED, that this matter is hereby referred to the Planning Board this 12th day of September, 1989 for their review and recommendations. AUGUST 15, 1989 Mr. Ken Heller, of Lincoln Avenue, spoke about the wall in front of the office building being constructed at 211 South Ridge Street. He said the wall is too high and causes a visual obstruction. Also, that he didn't recall seeing any wall in the plans. - 4 - 0014 2 September 12, 1989 Mr. Heller then mentioned some problems at the Brook II (now known as Hidden Falls) project on North Ridge Street. The trees which were planted are extremely small, he said, and insufficient to shield Mrs. Shirley Rothenberg's home. Also, he said the workmen are parking all over the place and especially under the tress where the tree roots will be destroyed and eventually the trees will be killed. Mr. Heller then pointed out that a fence in Deer Run was over the maximum height permitted by Village law and it should not be allowed. He added that the top line of a fence should be even and not have ups and downs as it does when fencing follows the contour of the land. The Chairman of the Planning Board, Bernard Klem, said he reviewed the plans of the building, (211 South Ridge) and no where was a wall shown higher than a curb. It should be looked at from a safety point of view and he recommended that the height of the wall be lowered to the height of a curb. Mayor Cresenzi said that these items will be reviewed and reported on at the next Board meeting. Mr. Heller then mentioned that the parking in front of the building at 211 South Ridge would not accommodate the six cars which it's supposed to. On paper, that parking arrangement looked fine, but it's not going to work, he added. Mrs. Shirley Rothenberg, of 88 North Ridge Street, said she was very discouraged about the development going on near her. The model home nearest her was built up about ten feet higher than it should be; the workmen parking their cars and vans under the trees are going to damage the roots and kill the trees; there were no hay bales placed for soil erosion and the black plastic used instead was not anchored down; water was coming down onto her property and creating a mud road. She said she would take some photos of these conditions and show them to the Board. Mrs. Rothenberg continued by saying that the dust and noise is endless but now this and she should be protected. The Mayor responded that he would get back to Mrs. Rothenberg with the information after he has had an opportunity to review everything. As far as what has been built, he said, it has been approved by the Architectural Review Board. Trustee Smith mentioned that she was at the site today and the basement of one house was level with the pond and she did not think it was high up. Mayor Cresenzi asked Mrs. Rothenberg to provide him with a list of the items mentioned and said he would respond to them at the next meeting. Mr. Heller claimed that on many of these subdivisions, one of the problems was that grading and elevations were left to the decision of the ARB. 5 - 00147qj September 12, 1989 Years ago, houses were built into the topography, now they are built above it, Mr. Heller said, adding that new areas should be kept in some type of conformity with the surrounding area. Trustee Ravich emphasized that there would be no variety in design. Mayor Cresenzi said when a parcel of land was subdivided, there were guidelines and regulations to be followed and these homes conform to those regulations. He added that he sympathized with what neighbors have to go through when there was construction going on. The other issues will be addressed next week, the Mayor stated, as he could not further respond to them until he has had an opportunity to review them. ADJOURNMENT There being no further business to come before the Board, on motion of Trustee Smith, seconded by Trustee Ravich, it was unanimously resolved that the Board recess into Executive Session at 8:40 P.M. to discuss personnel matters.
