OF THE BOARD OF TRUSTEES AND A
JOINT MEETING WITH THE PLANNING BOARD OF THE
VILLAGE OF RYE BROOK, HELD ON THE
8th DAY OF SEPTEMBER, 1988 IN THE

CONVENE AGENDA MEETING
The agenda meeting of the Board of Trustees was called to order
fby Mayor Cresenzi at 7:40 P.M. in the Meeting Room and the
Pledge of Allegiance followed.
Present were the following members of the Board:

I. PROPOSED LOCAL LAW #8-1988 - AUXILIARY POLICE
On motion by Trustee Ravich, seconded by Trustee Smith, with a
unanimous vote of the Board, the following resolution was
adopted:
PUBLIC HEARING
PROPOSED LOCAL LAW #8 - 1988
AUXILIARY POLICE
RESOLVED, that this Board hereby sets
Tuesday, September 27, 1988, at 8:00 P.M. , at
the Village Offices, 90 South Ridge Street,
as the date, time and place for a Public
Hearing to consider the approval of proposed
Local Law #8 - 1988, entitled Auxiliary
Police of the Village of Rye Brook; and
BE IT FURTHER RESOLVED, that the Deputy Clerk
is hereby authorized to publish the Notice of
Public Hearing in the Official Newspapers of
f the Village of Rye Brook.

II. PROPOSED LOCAL LAW #9-1988 - CODE ENFORCEMENT
On motion by Trustee Smith, seconded by Trustee Ravich, with a
unanimous -vote of the Board, the following resolution was
adopted:
PUBLIC HEARING
PROPOSED LOCAL LAW #9 - 1988
CODE ENFORCEMENT
RESOLVED, that this Board hereby sets
Tuesday, September 27, 1988, at 8:00 P.M. , at
the Village Offices, 90 South Ridge Street,
as the date, time and place for a Public
Hearing to consider the approval of proposed
Local Law #9 - 1988, entitled Code
Enforcement of the Rye Brook Village Code;
and

BE IT FURTHER RESOLVED, that the Deputy Clerk
is hereby authorized to publish the Notice of
Public Hearing in the Official Newspapers of
the Village of Rye Brook.
III. DEIS - HERITAGE AT RYE BROOK
On motion by Trustee Smith, seconded by Trustee Filipowski, with
a unanimous vote of the Board, the following resolution was
adopted:
PUBLIC HEARING
DRAFT ENVIRONMENTAL IMPACT STATEMENT
HERITAGE AT RYE BROOK
RESOLVED, that this Board hereby sets
Tuesday, September 27, 1988, at 8:00 P.M. , at
the Village Offices, 90 South Ridge Street,
as the date, time and place for a Public
Hearing to consider the approval of the Draft
Environmental Impact Statement submitted by
Heritage of Rye Brook; and
BE IT FURTHER RESOLVED, that the Deputy Clerk
is hereby authorized to publish the Notice of
Public Hearing in the Official Newspapers of
the Village of Rye Brook.
IV. DGEIS - RYE BROOK NORTH
On motion by Trustee Smith, seconded by Trustee Filipowski, with
a unanimous vote of the Board, the following resolution was
adopted:

DRAFT GENERIC ENVIRONMENTAL IMPACT STATEMENT
RYE BROOK NORTH
RESOLVED, that this Board hereby sets
Tuesday, September 27, 1988, at 8:00 P.M. , at
the Village Offices, 90 South Ridge Street,
as the date, time and place for a Public
Hearing to consider the approval of the Draft j
Generic Environmental Impact Statement for
Rye Brook North, prepared by Frederick P.
Clark Associates, and dated August, 1988; and

BE IT FURTHER RESOLVED, that the Deputy Clerk
is hereby authorized to publish the Notice of
Public Hearing in the official Newspapers of
the Village of Rye Brook.

p V. UNITED WAY WEEK: SEPTEMBER 25th, 1988
Mayor Cresenzi stated that United Way is an extremely worthwhile
cause and therefore he was very happy to proclaim the week of
September 25th as United Way Week in the Village.
Former Trustee Stan Zak inquired if Rye Brook was still
affiliated with the Rye/Port Chester campaign to which Mayor
Cresenzi responded that for the first time this year, Rye Brook
was going "solo" in its campaign, with Rye Town Supervisor Don
Gioffre handling it. Rye Brook will have its own logo, and the
Village Seal will be on the sign installed at the Rye Ridge
Shopping Center, the Mayor added.
Thereafter, on motion by Trustee Ravich, seconded by Trustee
Filipowski, with a unanimous vote of the Board, the following
resolution was adopted:
UNITED WAY WEEK
SEPTEMBER 25th, 1988
WHEREAS, the United Way is celebrating its 26th
Anniversary in September of 1988; and
WHEREAS, the United Way supports over 100 health and
human service agencies and programs in the
Westchester County area; and
WHEREAS, all decisions regarding the allocation of
funds to the various agencies are made
strictly by volunteers; and
WHEREAS, to arouse greater community interest and
support for the United Way; it is
RESOLVED, that I, Salvatore M. Cresenzi, by the power
invested in me as Mayor of the Village of Rye

Brook, do hereby proclaim the week of
September 25th, 1988 as
UNITED WAY WEEK
in the Village of Rye Brook and urge the
community's support in helping to make the
111988-89 United Way Campaign" the most
successful one ever!

VI. BROOK II VENTURES - HERITAGE AT RYE BROOK
Administrator Russo explained that in conformance with the SEQR
regulations, the resolutions passed by the Board at the August
23rd meeting regarding Brook II and Heritage, had to be slightly
modified. He then stated that the environmental timetable would
now be running and suggested that the Board consider setting a
Public Hearing date for Brook II.
Mr. Circosta added that aside from the timetables, there were
also closing dates for comments after the Public Hearings were
held and the affected agencies had to be notified, so dates
should be established.

On motion by Trustee Filipowski, seconded by Trustee Ravich,
with a unanimous vote of the Board, the following resolution was
adopted:
BROOK II VENTURES
RESOLVED, that the Resolution adopted by
this Board of Trustees on the 23rd day
of August, 1988 regarding the acceptance
of the DEIS for Brook II Ventures, be
and it hereby is, amended to read as
follows:
RESOLVED, that the Revised and Updated
Draft Environment Impact Statement
(DEIS) prepared by Parish & Weiner Inc. ,
dated August, 1988 and submitted by
Brook II Ventures be, and it hereby is,
accepted by the Board of Trustees as
being complete for distribution.
Thereafter, on motion by Trustee Smith, seconded by Trustee
Ravich, with a unanimous vote of the Board, the following
resolution was adopted:
PUBLIC HEARING
DRAFT ENVIRONMENTAL IMPACT STATEMENT
BROOK II VENTURES
RESOLVED, that this Board hereby sets
Tuesday, October 11, 1988, at 8:00 P.M. , at
the Village Offices, 90 South Ridge Street,
as the date, time and place for a Public
Hearing to consider the approval of the Draft
Environmental Impact Statement submitted by
Brook II Ventures; and

BE IT FURTHER RESOLVED, that the Deputy Clerk
is hereby authorized to publish the Notice of
Public Hearing in the Official Newspapers of
the Village of Rye Brook.
Thereafter, on motion by Trustee Filipowski, seconded by Trustee
Smith, with a unanimous vote of the Board, the following
resolution was adopted:
HERITAGE AT RYE BROOK
Anderson Hill Road
RESOLVED, that the Resolution adopted by
this Board of Trustees on the 23rd day
of August, 1988 regarding the acceptance
of the DEIS for Heritage at Rye Brook,
be and it hereby is, amended to read as
follows:
RESOLVED, that the Draft Environment
Impact Statement (DEIS) prepared by
Frederick P. Clark Associates, dated
August, 1988 and submitted by Heritage
at Rye Brook, be and it hereby is,
accepted by the Board of Trustees as
being complete for distribution.

VII. 211 SOUTH RIDGE STREET - LARIZZA
Administrator Russo explained that Attorney Kramer suggested
adding two items to the Larizza (Site Plan Approval) resolution
the Board approved at the August 23rd meeting.
Administrator Russo proceeded to read the proposed resolution
and Trustee Smith then asked about the "owner" being responsible
for the sidewalks when it would be condo ownership and Mr.
Circosta explained that there would be a condo board who would

be held responsible.
On motion by Trustee Filipowski, seconded by Trustee Ravich,
with a unanimous vote of the Board, the following resolution was
adopted:

211 SOUTH RIDGE STREET
AMENDMENT TO SITE PLAN APPROVAL
SECTION 1, BLOCK 25, LOTS 1, 26
$ WHEREAS, at a Public Hearing held on August
23, 1988 by the Board of Trustees of the
Village of Rye Brook, Site Plan Approval was
granted for 211 South Ridge Street; and
WHEREAS, additional specifications are
required for said Site Plan Approval;
NOW, THEREFORE, BE IT
RESOLVED, that Item #5 of said Approval be
amended as follows: Sidewalks shall be
4 installed and maintained by the property
owner on the northerly side of the property
line on Ellendale Avenue and on the westerly
side of the property line on South Ridge
Street; and be it
FURTHER RESOLVED, that Item #8 of said
Approval be amended as follows: Recreational
Fees, in lieu of land, shall be in the amount
of $15,750 and will be due and payable before
a Building Permit is issued; and be it
FURTHER RESOLVED, that these two items be
incorporated into the Resolution for said
Site Plan Approval.

Law #7 - 1985)
Attorney Kramer stated that the Village does not grant any new
(Boarding House) permits under its existing law, so Item #4 was
put on hold.

` Mr. Ken Heller said he saw an article on the Youth Employment
Service in the Recreation and Parks Department Fall Newsletter,
f where it stated that information on YES was available at the
Blind Brook High School, and he suggested that this notice also
be placed on bulletin boards in the other schools. Mayor
Cresenzi said if permission was granted and space was available,
notices would be placed there.
Fritz Wiedel, of Frederick P. Clark Associates, suggested that
the Board consider amending the PUD Ordinance at the same time
as the other SEQR Public Hearings were held.

unanimous vote of the Board, the following resolution was
adopted:
PUBLIC HEARING
AMENDMENT OF PUD REGULATIONS
VILLAGE OF RYE BROOK
RESOLVED, that this Board hereby sets
Tuesday, September 27, 1988, at 8:00 P.M. , at
the Village Offices, 90 South Ridge Street,
as the date, time and place for a Public
Hearing to consider amending the PUD (Planned
Unit Development) Regulations of the Village
of Rye Brook; and
BE IT FURTHER RESOLVED, that the Deputy Clerk
is hereby authorized to publish the Notice of
Public Hearing in the Official Newspapers of
the Village of Rye Brook.
ADJOURNMENT
On motion duly made and seconded, the Agenda Meeting was
adjourned at 8:00 P.M. and a Joint Meeting with the Planning
Board followed.
