June 28, 1988 NEXT MEETING DATE August 09, 1988 - Agenda Meeting August 23, 1988 - Regular Meeting Rye Brook Village Offices are Handicapped Accessible Flr 00 11.0 MINUTES OF AN REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF RYE BROOK, HELD ON THE 26th DAY OF JULY, 1988 IN THE VILLAGE OFFICES, 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK CONVENE REGULAR MEETING The regular meeting of the Board of Trustees was called to order by Mayor Cresenzi at 8:00 P.M. in the Meeting Room and the Pledge of Allegiance followed. Present were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Francis L. Filipowski Trustee Michele R. Mendicino Trustee Robert J. Circosta, Director of Public Works Joseph Cortese, Village Treasurer Frank P. Sesta, Village Accountant Jean A. Marra, Deputy Village Clerk July 26, 198801] PUBLIC HEARINGS 1. Site Plan Approval - 211 South Ridge Street/Larizza On motion duly made and seconded, it was unanimously RESOLVED, that the Public Hearings be, and they hereby are, declared open. John Colangelo who appeared for the applicant, Lou Larizza, indicated that this matter was before the Planning Board and they had concerns relating to the traffic on Ridge Street, parking in front of the building, the side yard setback and the height of the building. He explained that there would only be six parking spaces in front of the building; two of which would be for handicapped parking. Also, the building was moved in four feet off the property line. As for the height of the building, Mr. Colangelo pointed out that it met every zoning requirement. When asked about the height of the rear elevation by Mayor Cresenzi, Mr. Ralph Mastromonaco the Consulting Engineer, displayed a drawing of Ridge Street showing the County Office Building, a bank and travel agency. Mr. Mastromonaco mentioned that this property was purchased from the person residing in the home to the rear of the property on Ellendale Avenue and that the building was designed so no variances would be necessary. Trustee Mendicino asked about the tenancy of the building and Mr. Mastromonaco said that there would be five as condominium offices to be used by accountants, lawyers, etc. In answer to Mayor Cresenzi's question, Mr. Circosta explained that the Planning Board was concerned about the additional curb cut on Ridge Street and also the appearance of parking in front of the building; they wanted more of a "street-scape." Evergreens could be planted for screening, Mr. Colangelo stated, but some questions were raised regarding visibility. Trustee Filipowski questioned the rear elevation and Mr. Mastromonaco stated the building would be 34 feet high in front and about 20 feet higher in the back. The parking area under the building will be open -- not closed in -- so the measurement started with the first floor of the building. 2 - July 26, 198800 1 i 1.2 Trustee Ravich suggested that any cars exiting from the building be permitted a right-hand turn only and Mayor Cresenzi agreed. Mr. Logan, a local resident, questioned the setbacks and Mr. Mastromonaco complied by stating the building would be set back 46 feet from the curb on Ridge Street and when Mr. Logan raised objections to the proposal because of increased traffic, the Mayor explained that this land was zoned for commercial use and the applicant was entitled to build on it. Mr. Mastromonaco continued that there was parking for 22 cars on the basement level; 19 underneath the building, and spaces #18, #20 and #1 were out from under the building. Mr. Ken Heller stated that the overflow parking would wind up on Ellendale Avenue and he suggested making Ellendale a one-way street so it could not be used as a shortcut for traffic coming from the shopping center. Some local residents stated that the present "No parking from here to corner" regulations were not being enforced and they didn't need any added traffic problems. Mayor Cresenzi contended that the traffic issues were valid and would require further study. Trustee Smith noted that Ellendale goes through .into Port Chester and Bill Aughavin contributed that the ambulance corps was on Ellendale and they would need the necessary access. In answer to Trustee Filipowski's question, Mr. Circosta stated the zoning requirements, which called for one space for each tenant and one space per 300 feet of floor area, have been met. To answer Mr. Heller's question, Mr. Mastromonaco said water runoff would be handled. The site is graded down to two catch basins which will go into the storm system on Ellendale. When a resident complained that the existing storm drains could not handle the water runoff now, Mr. Mastromonaco mentioned that the problem could be because the catch basins were clogged. The resident said that the catch basins were cleaned constantly by the public works department and Mr. Mastromonaco stated that the proposed building would not contribute to any existing water runoff problems. - 3 - July 26, 1988 0°I j With the questions regarding the height of the building, and the traffic concerns about parking in front, a right-hand turn only when exiting from the building, the possibility of a one-way street and drainage matters, Mayor Cresenzi suggested that this application be deferred. Thereafter, on motion duly made and seconded, with a unanimous vote of the Board, the following resolution was adopted: RESOLVED, that the application of Lou Larizza for Site Plan Approval at 211 South Ridge Street, be and it hereby is adjourned to August 23, 1988. 2. Subdivision Approval - Beechwood Blvd./Helbing Jeff Cohen, Esq. , appeared on behalf of the applicants and explained the proposed subdivision. The existing line juts to the right in Lot B and what is being requested would straighten the mid lot line in the rear, Mr. Cohen stated, adding that the applicants would like to be able to build a home on Lot A. Mayor Cresenzi asked if the left rear corner of the existing home met the rear yard setback requirement and Mr. Circosta explained that the rear yard setback requirement came off the rear of the house; that the 15 feet depicted on the map was a side yard setback_ When Trustee Filipowski questioned the driveway location, Mr. Cohen said the driveway at the existing house would be changed and that it would be eliminated over the new Lot A. To answer Trustee Mendicino' s question, Mr. Cohen stated that modifications to the existing house were not planned at the present time -- the parents of Mrs. Helbing will occupy it in the future. Since Lot A will become nonconforming, Mayor Cresenzi asked if a variance would be required to which Attorney Kramer responded that the applicants would not have to go before the ZBA. t - 4 -- July 26, 1988/�r� g g q ll U y_i...14 When asked by a resident how far back the house would sit from the street, Mr. Cohen replied approximately the same as the existing house -- about 75 feet. In order for Attorney Kramer to draft a proposed resolution for the Helbing Subdivision, Mayor Cresenzi deferred this matter to the end of the agenda. 3. Local Law #6-1988 - Animal Control Mayor Cresenzi explained that this law incorporated a much needed "pooper scooper" provision into the existing law. Bill Aughay.in suggested that an enforcement officer be appointed -- aside from the police department -- to effectuate this law. Thereafter, on motion by Trustee Filipowski, seconded by Trustee Ravich, with a unanimous vote of the Board, the following resolution was adopted: WHEREAS, this Board has met on this date at the time and place specified in the Notice of Public Hearing to consider the adoption of proposed Local Law #6-1988 and has heard all persons desiring to be heard; NOW, THEREFORE, BE IT RESOLVED, that this Board hereby adopts Local Law #6-1988, entitled Animal Control, and orders that said law, as so adopted, be herein inserted and made a part of the minutes of this meeting. VILLAGE OF RYE BROOK LOCAL LAW #6 - 1988 A Local Law Entitled ANIMAL CONTROL BE IT ENACTED, by the Board of Trustees of the Village of Rye Brook, as follows: 5 - July 26, 1988 00i I 15 1. PURPOSE 2. DOGS AT LARGE 3. NUISANCES BY DOGS 4. IMPOUNDING, CLAIMING AND DISPOSING OF DOGS 5. KEEPING OF POULTRY PROHIBITED 6. HOUSING/HARBORING OF CERTAIN ANIMALS 7. SETBACK REQUIREMENTS 8. KEEPING OF HORSES OR EQUINE LIVESTOCK 9. NONCONFORMING USES 10. ENFORCEMENT 11. SEVERABILITY 12. EFFECTIVE DATE 1. PURPOSE I The purpose of this local law is to include provisions for the removal and disposal of filth deposited by dogs, and to amend by repealing Local Law #21 of 1984, entitled "Animals" and to replace said law with this Local Law. 2. DOGS AT LARGE Dogs, whether licensed or not, shall be subject to the following restrictions: A. No person owning, harboring or having the care, custody or control of any dog shall permit such dog to be at large in the Village of Rye Brook other than on the premises of the owner, except to be on the premises of another person with the knowledge and consent of such other person. B-. The person owning, harboring or having the care, custody or control of any dog in the Village of Rye Brook which is not on the premises of the owner, or on the premises of another person with the knowledge and consent of such person, shall control and restrain such dog with a chain or leash not exceeding five (5) feet in length. C. No person owning, harboring or having the care, custody or control of any dog shall permit such dog to defecate or dig on any common thoroughfare, sidewalk, passageway, public street, play area, or park; or any place where people congregate, walk, or upon any school or public property whatsoever, or upon any private property, without the permission of the owner of said property. - 6 - July 26, 1988 �1 yy flfl__ 3. NUISANCES BY DOGS A. REMOVAL OF FILTH - It shall be the duty of any person owning, harboring or having the care, custody or control of any dog to promptly remove any feces left by such dog on any common thoroughfare, sidewalk, passageway, public street, play area, or park; or any place where people congregate, walk, or upon any school property or any private or public property whatsoever. B. METHOD OF REMOVAL - Feces shallbe removed by the person having custody or control of said dog by picking it up with a scoop, shovel, broom, tong, or other similar implement and depositing same directly into an airtight container; plastic or otherwise. C. DISPOSAL OF FILTH - The feces removed from the afore- mentioned designated area(s) shall be disposed of by depositing same in a container used for the disposal of refuse. In no event shall any feces be deposited in storm or sanitary sewers or drains. D. GUIDE DOGS EXCEPTED - The provisions of this Local law shall not apply to blind persons while actually using a guide dog licensed as such pursuant to the Agriculture and Markets Law, Sections 109 and 110. 4. IMPOUNDING, CLAIMING AND DISPOSING OF DOGS A. Any dog running at large shall be liable to be impounded by the police or the person or agency duly appointed pursuant to the Agriculture and Markets Law of the State of New York. The procedure to be followed for impounding and for destroying a dog shall be in accordance with the provisions of the Agriculture and Markets Law, Sections 114 and 114-a in that dogs so seized must be held, redeemed and disposed of as set forth therein. B. If a seized dog is tagged (licensed) , the seizing officer must give personal notice in writing to the owner or a member of his family who is at least eighteen (18) years of age. The owner may redeem the dog within twelve (12) days by paying to the Village Clerk the current cost-of-seizure fee; the cost of care and feeding must be borne by the Village. If not so redeemed, the seizing officer shall sell or destroy the dog. The cost-of-seizure fee and money collected from the sale of seized dogs must be remitted to the Commissioner of Finance of Westchester County on a monthly basis, together with other dog license fees. - 7 - July 26, 1988 C)J_1 � :1s C. If a seized dog is not tagged (unlicensed) , the provisions of the Agriculture and Markets Law, Section .114, shall apply. The conditions set forth above must be followed except that no notice must be given to the owner, the cost-of-seizure fee may be higher, and the redemption period .is five (5) days. 5. KEEPING OF POULTRY PROHIBITED A. No building or structure shall be erected, or plot of ground be used .in the Village of Rye Brook, for the purpose of maintaining or raising chickens, ducks, turkeys, pigeons or poultry of any kind. B. A nonconforming use may not continue and mustterminate immediately. 6. HOUSING/HARBORING OF CERTAIN ANIMALS No building, structure or premises shall be erected, altered or used in any residential district for the housing or harboring of swine, goats, bovines, rabbits, foxes or mink, except where authorized by Special Permit from the Village of: Rye Brook. 7. SETBACK REQUIREMENTS No accessory building or structure or part thereof, used for the housing of animals other than dogs, shall be less than fifty (50) feet from any lot line in any district. 8. KEEPING OF HORSES OR EQUINE LIVESTOCK A. The housing or harboring of horses or equine livestock shall only be permitted in any residential district on the following conditions: 1. Such housing or harboring shall be accessory to the principal use of the property. 2. Such activity shall be conducted for the use of residents only. 3. The boarding or rental of horses or other equine livestock shall not be permitted. 4. No horse or other equine livestock shall be housed or harbored on any plot less than two (2) acres in size, and no more than two (2) horses or other type of equine livestock shall be permitted per one (1) acre or major fraction thereof, and in no event to exceed eight (8) horses or other equine livestock. 8 - July 26, 1988 001118 B. No barns, stables or other roofed structure or accessory building for the sheltering of horses or equine live- stock shall be located within fifty (50) feet of any side or rear yard line, nor shall any structure be located within the front yard which lies between the principal residential structure and the street. C. All corrals, runs or other open areas shall be enclosed by a fence at least five (5) feet in height. Such fence shall be located more than five (5) feet from any side or rear yard line and shall not be located within any front yard which lies between the principal residential structure and the street. D. There shall be at least one hundred ten (110) square feet of stall area for each horse or equine livestock. E. Manure shall be kept in weatherproof containers at least fifty (50) feet from all adjoining property lines. F. All premises where horses or equine livestock are housed or harbored shall conform to all of the standards and requirements of the Westchester County Department of Health and the Westchester County Sanitary Code. G. Every owner of a horse or other equine livestock shall keep the animal(s) under restraint at all times and shall not permit said animal(s) to be at large on any street, sidewalk, or public place in the Village of Rye Brook. A horse or equine livestock shall be deemed at large when it is off the property of its owner and not under the restraint and obedient to the orders of a competent person of suitable age and discretion. No horse or equine livestock shall be permitted on the sidewalks within the Village of Rye Brook. 9. NONCONFORMING USES A nonconforming use may not continue and must terminate immediately. 10. ENFORCEMENT Any person in violation of this Local Law shall be subject to a fine not to exceed Two Hundred Fifty ($250) Dollars per day for each offense, or by imprisonment not to exceed Fifteen (15) Days, or by both such fine and imprisonment. 9 - July 26, 1988 dl 1 3t 11. SEVERABILITY 0 0 y+ If any part or parts of this Local Law are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this Local Law. 12. EFFECTIVE DATE This Local Law shall become effective immediately upon filing with the Secretary of State. 4. Local Law #7-1988 - Vehicle & Traffic Law (Commercial Vehicles) Mayor Cresenzi stated that for the safety of little children playing in the streets, commercial vehicles would be banned from using certain streets in the Village as through streets. When questioned about the signage by the Mayor, Administrator Russo said the signs were ordered and will hopefully arrive within 30 days. DEFINITIONS All terms not specifically defined herein shall have the same definitions as provided in the New York State Vehicle & Traffic Law. 2. APPLICATION Every person propelling any push cart or riding a bicycle or an animal upon a public highway, or any person driving any animals, shall be subject to the provisions of this local law; applicable to the operator of any vehicle, except those provisions of this local law with reference to the equipment of vehicles and except those provisions which by their nature can have no application. 3. EXCLUSIONS The provisions of this local law regulating the movement, parking or standing of vehicles shall not apply to ambu- lances, fire or police apparatus, police, military and Civil Defense vehicles, US Mail or emergency vehicles of public service corporations, while in the performance of duty. This exemption shall not, however, protect the driver of any such vehicle from the consequences of a reckless disregard of the safety of others. 4. POWER OF PEACE OFFICER It shall be unlawful for any person 'to refuse or fail to comply with any lawful order, signal or direction of a peace officer, or to disobey the instruction of any traffic sign or signal, unless directed to do so by a peace officer. Peace officers shall include police officers and other individuals appointed or hired by the Village to direct traffic. 5. SPEED LIMITS A. No person shall operate a vehicle on any public highway within the Village at a rate of speed in excess of thirty (30) miles per hour, except on the sections of the State roads called a portion of King Street where the speed limit is established by the State at forty (40), ,.miles per hour and the portion of Westchester Avenue, between the Village line with Harrison and the Rye Town Hilton driveway, where the speed limit shall be forty (40) miles per hour. - 12 - July 26, 1988 ®01122 B. No person shall operate a vehicle at a speed in excess of forty (40) miles per hour on the section of the State roads known as the portion of King Street where the speed limit 9.s established by the State at forty (40) miles per hour, and the portion of Westchester Avenue, between the Village line with Harrison and the Rye Town Hilton driveway at a speed in excess of forty (40) miles per hour. C. No person shall operate a vehicle within three hundred (300) feet of a school building line at a rate of speed in excess of fifteen (15) miles per hour, on school days between 7:00 A.M. and 6:00 P.M. D. The Board of Trustees may, by resolution, establish reduced speed limits on other public highways within the Village. 6. TRAFFIC SIGNALS A. Wherever traffic at an intersection is alternately directed to proceed and to stop by the use of signals exhibiting colored lights or the words "go", "caution" and "stop", said lights and terms shall indicate as follows: 1. Green or "go" shown alone: Traffic facing the signal may proceed, except that vehicular traffic shall yield the right-of-way to pedestrians and vehicles lawfully within a crosswalk or the intersection at the time such signal is exhibited. 2. Yellow or "caution": When shown following the green or "go", traffic facing the signal shall stop before entering the intersection unless so close to the intersection that a stop cannot be made safely. 3. Red or "stop": Traffic facing the signal shall stop and remain standing until green or "go" is shown alone, except that at a crossing where right turns on a red light are not prohibited by properly posted signs, vehicles in the lane nearest the curb may make a right turn after first coming to a full stop. 4. A traffic light controls traffic only at the intersection at which it is located. - 13 - July 26, 1988 001121 7. NO PARKING/STANDING I A. No Parking: When parking is prohibited by this law, it shall be unlawful for any person to park a vehicle', whether occupied or not, but a person may stop or stand temporarily for the purpose of, and while actually engaged in, loading or unloading merchandise or passengers. B. No Standing: When standing is prohibited by this law, Lt shall be unlawful for any person to stand or park a vehicle, whether occupied or not, but a person may stop temporarily for the purpose of, and while actually engaged in, receiving or discharging passengers. 8. STANDING, STOPPING OR WAITING A. A vehicle shall not be permitted to: 1. Stand unless halted by traffic on any street, except at the curb. 2. Stop with its left side to the curb, except on a one-way street. 3. Occupy any street so as to obstruct traffic. 4. Stop so as to obstruct a crossing. 5. Stand backed up at an angle to the curb, except while actually loading or unloading said vehicle. 6. Stand in such a position as to prevent another vehicle stopped or parked at the curb from moving away. 7. Stand within ten (10) feet of a fire hydrant, crosswalk or corner. 8. Stand within twenty-five (25) feet of any street excavation or obstruction; except that when such excavation or obstruction is at or close to the curb, vehicle may stand at the curb, but not so as to obstruct traffic. B. A vehicle, when left unattended or parked on a grade or incline, shall have the brake effectively set and the wheels turned at an angle against the curb, and not parallel to the curb. - 14 - July 26, 1988 0011.24 I 9. SIDEWALKS No vehicle shall be driven in, over, or upon any sidewalk or that portion of the public highway set aside for a sidewalk', except as a permanent driveway, or temporary driveway for which permission has been granted. 10. PLAY STREETS A. The Village Board shall have authority to declare any Village street, or part thereof, a play street and to place appropriate signs or devices in the same roadway indicating and helping to protect the same.. B. Whenever authorized signs are erected indicating any such street or part_ thereof as a play street, a person shall not drive a vehicle upon any such street or portion thereof, except drivers of vehicles having business or whose residences are within such closed j area, and then any said driver shall exercise the greatest care in driving upon any such street or portion thereof. C. Designated Play Streets: The following streets are hereby designated play streets by the Village Board of the Village of Rye Brook: 1. From the point where Meadowlark Road intersects with Oriole Place to the dead end of Meadowlark Road. 11. PARKING A. The Village Board may, by resolution, establish and enforce such regulations governing the parking of vehicles on public highways within the Village as they consider necessary for public convenience and which do not unduly restrict the orderly movement of traffic or endanger the public safety. B. Special parking restrictions in a specified area shall be indicated by signs authorized by 'the Village of Rye Brook, and drivers must at all times comply with the directions thereon. C. A vehicle shall not be parked on any street or highway for the purpose of making repairs, except those of a minor nature in a case of emergency. - 15 - July 26, 1988 001126 D. A vehicle shall not be parked or left unattended on any street in front of a driveway. E. In any parking space where the area to be occupied by any vehicle is indicated by lines on the pavement or curbing, a vehicle must be parked within such lines. 12. PROHIBITED PARKING A. The following regulations prohibiting parking in areas are hereby established: I. West William Street, Ellendale Avenue, and Franklin Street a. North side - no parking one hundred fifty (150) feet east of South Ridge Street. 7.. Bowman Avenue a. On the south side - between South Ridge Street and Barber Place. b. On the north side - between South Ridge Street and Division Street. C. On either side - from Village of Rye Brook border with Port Chester, to a point seventy (70) feet west of Osborne Place. 3. South Ridge Street a. On either side - from Westchester Avenue, south to Rye City line. 4. North Ridge Street a. On either side from Westchester Avenue, north to King Street. 5. Division Street a. On the west side - between Bowman Avenue and Westchester Avenue. 6. Barber Place a. On the west side - between Bowman Avenue and Franklin Street. - 16 - July 26, 1988 rr�lrrll 1126 7. Wilton Road a. Along the east and west sides, beginning at the dead end at Crawford Park and continuing ninety (90) feet south along both sides. b. Along the entire width of the dead end at Crawford Park. 8. Sunset Road a. Along the north and south sides, beginning twenty-seven (27) feet from the curb line of Lincoln Avenue and extending westerly one hundred eighteen (118) feet on both sides. b. SNOW EMERGENCIES During plowing and clearing of snow from the public streets or highways, or in the event a snow emergency has been declared in Westchester County, no vehicle shall be parked on any side of any public street or highway in the Village of Rye Brook, with the exception of the following streets or highways: West Street. 15. FIRE LANES A. Clear, unobstructed roadways shall be maintained in areas established by the Building Inspector and the Fire Chief, or their designated representatives, in areas necessary for access to places of public assembly, structures of public access and office buildings and parking lots of ten (10) or more, and residential subdivisions of ten (10) or more units of housing. Such roadways shall be designated, by the Building Inspector and the Fire Chief, or their designated representatives, as Fire Lanes. B. Fire Lanes shall be of two types: 1. Fire Lane "A" Emergency access area, located in the immediate vicinity of structures and fire hydrants for emergency use only. 2. Fire Lanes shall be marked in the following manner: 1. Fire Lane "A" a. Curb sides and top painted traffic yellow. Paved area crosshatched out four (4) feet from curbs. b. Crosshatching shall have six (6) inch wide lined at a 45 degree angle to curb extending outward in the direction of oncoming traffic; lines shall be two (2) feet apart. C. Standard "NO PARKING FIRE LANE" signs shall be placed every fifty (50) feet. d. Signs shall be no more than two (2) feet from curb, no lower than six (6) feet and no higher than eight (8) feet from street grade to bottom edge of sign. e. Signs shall be at an angle of thirty (30) degrees to forty-five (45) degrees to oncoming traffic, where practicable. 2. Fire Lane "B" a. Designated emergency route -- curb side and top shall be painted traffic yellow on side of street leading to structure and Fire Lane "An b. Standard "NO PARKING FIRE LANE" signs shall be placed every one hundred (100) feet. C. Signs shall be no lower than six (6) feet and no higher than eight (8) feet from street grade to bottom edge of sign. D. In residential areas designated Fire Lane "B", signs spaced every fifty (50) to seventy-five (75) feet can be substituted for yellow curb, with the approval of the Building Inspector and/or Fire Chief. E. Parking in a Fire Lane shall be a violation and shall be punishable by a fine of not less than Fifty ($50) Dollars and no more than Two Hundred Fifty ($250) Dollars, and/or by imprisonment, not to exceed fifteen (15) days. F. Any individual or company who owns or manages a place of public assembly, public access or an office building shall complete the markings required herein within fifteen (15) days of receiving notice of the designated Fire Lanes from the Building and the Fire Chief, or their designated representatives. - 21 - July 26, 1988 0, 1 1.31 G. Any individual or company who owns or manages a place of public assembly, public access or an office building, who fails to keep appropriate markers on the designated Fire Lanes, shall be guilty of a violation. Said individual or company shall be punishable by a fine of Two Hundred Fifty ($250) Dollars and/or by imprisonment, not to exceed fifteen (15) days. Each day on which the Fire Lanes remain unmarked shall be considered a separate violation. 16. PARKING PROVISIONS APPLICABLE TO TRUCKS, TRAILERS, OMNIBUSES, ETC. A. Notwithstanding any other provisions of this local law, it shall be unlawful for the operator, owner or lessee of a truck, trailer, semi-trailer, tractor, house coach or omnibus to stand, stop or park on any public highway within the Village and leave such truck, trailer, semi- trailer, tractor, house coach or omnibus unattended by a person capable of operating or removing it, for a period longer than necessary to load or unload passengers or freight. B. The provisions of this section, however, shall not apply in the case of an emergency, to state, county, village and town highways, nor apply to agents or employees of public service corporations when engaged in the erection of poles, the stringing of wires or the repair, construction or inspection of lines, conduits or other structures along the state, county, village or town highways, or persons engaged in the construction, reconstruction or repair of the state, county, village or town highways or roads. 17 . B. When any vehicle is found unattended on any public street or highway within the Village of Rye Brook where said vehicle constitutes an obstruction to traffic, said vehicle may be ordered removed by the Mayor or Chief of Police of the Village of Rye Brook or peace officer in charge, and the cost of such removal shall be charged against the owner. C. When any vehicle is parked or abandoned on any public street or highway within the Village of Rye Brook where stopping, standing or parking is prohibited, said vehicle may be ordered removed by the Mayor or Chief of Police of the Village of Rye Brook or peace officer in charge, and the cost of such removal shall be a charge against the owner. 21. TRUCKS Every vehicle shall be so constructed or loaded as to prevent any portion of the contents from escaping there- from. No vehicle used to transport dirt or soil shall be operated or driven so as to permit dirt or mud to adhere to the wheels and be deposited in the public streets of the Village of Rye Brook. 7.2. COMMERCIAL VEHICLES PROHIBITED A. Motor trucks, except those delivering merchandise, other items, or services along and in the vicinity of the following streets of the Village of Rye Brook, are forbidden the use of, and travel upon the following streets: 1. Garibaldi Place 2. West Street B. The Board of Trustees may, by resolution, establish additional no-through-traffic streets for commercial vehicles. - 27 - July 26, 198800113T/ 23. PARADES All parades in the streets of the Village of Rye Brook and the playing of bands of music and exhibitions of any kind in said streets are prohibited, without a written permit from. the Chief of Police who shall issue same if it is not dangerous to public safety and if there is not unreasonable interference with traffic. 24. VIOLATION AND PENALTIES Any person, firm or corporation violating any provision of this local law, may, upon conviction, be punished for the first offense by a fine not exceeding one Hundred ($100) Dollars; and for the second offense, by a fine of not less than Twenty- Five ($25) Dollars nor more than Two Hundred ($200) Dollars or by imprisonment for no more than fifteen (15) days, or both; and the third or any subsequent offense within eighteen (18) months may be punishable by a fine not exceeding Five Hundred ($500) Dollars or by imprisonment, not exceeding six (6) months, or by both such fine and imprisonment. 25. SEPARABILITY If any clause, sentence, paragraph or part of this local law or the application thereof to any person or circumstances shall be adjudged by any court to be invalid, such judgment shall not effect, impair or invalidate any remainder thereof or the application thereof to other persons and circum- stances, but shall be confined in its operation to the clause, sentence, paragraph or part thereof and the persons and circumstances directly involved in the controversy in which such judgment shall have been rendered. 26. REPEALER This local law shall be entitled the Vehicle & Traffic Law of the Village of Rye Brook and shall supersede Local Law #7 - 1984, Local Law #3 - 1987, and Local Law #8 - 1987, and any amendments thereto. 27 . EFFECTIVE DATE This local law shall become effective immediately upon filing with the Secretary of State. - 28 - July 26, 1988001138 DISCUSSIONS/REPORTS 5. Westerleigh Court - Dedication of Road (Iorio Subdivision) Mr. Circosta explained that the developer did not have all the necessary items as yet and Mayor Cresenzi adjourned this matter to August 23, 1988. 6. Accessory Apartments - Discussion Trustee Smith stated there was a need for affordable housing by older persons on a fixed income as well as young people in the Village and thought that by allowing accessory apartments, that need could be met. A resident asked what the difference would be between an accessory apartment and a two-family house, and Trustee Smith replied the size of it; the accessory apartment would be small. A speaker said that would eliminate the one-family zoning and Mayor Cresenzi stated that under the present zoning code, two boarders could be taken in in a one-family home; the addition of kitchen facilities makes it a two-family home. Trustee Smith stated that both families lose their privacy in the "boarder" situation. Mayor Cresenzi said that lot sizes would have to be considered as far as the impact was concerned. Another speaker said that it would need a great deal of study before Rye Brook was turned into a two-family area. Bill Aughavin suggested that accessory apartments be limited to a single person or a couple, if the tenant was not a family member. Randy Solomon asked how this could ever be enforced and Mayor Cresenzi said that was a concern as well as that it could change the character of the area. - 29 - July 26, 1988001131 Trustee Smith said this would be done by a Special Use Permit and there would be certain requirements that had to be met; one of them being parking. Mr. Heller said there was already a problem with parking; in some areas of the Village it would work fine, but in others it would be terrible, he stated. A speaker said that this should be researched very carefully and Mayor Cresenzi was in total agreement, adding that it was a very interesting concept but needed a lot of study. At this time, Mayor Cresenzi set the discussion aside for further review. 7. Deer Run Subdivision - Discussion Mr. Circosta stated that presently eight building permits have - been issued as well as four certificates of occupancy. He continued by saying that the recent rains have caused some complaints and inspections revealed that some deficiencies to the swales as they were constructed on Lots 3, 5 and 10. Mayor Cresenzi asked what the time frame was and Mr. Circosta replied that the residents were notified on Friday and they were asked to expeditiously correct the situation. Mayor Cresenzi then asked Mr. Circosta to stay on top of the situation and requested a report on Friday (7/29/88) afternoon. Mr. Ken Heller stated that trees still have not been planted and the builder promised to finish the stone wall along Lincoln Avenue. He also said that the area between Lincoln Avenue and the stone wall needed cleaning up. Mr. Randy Solomon asked why the Deer Run problems come after the fact and not before, and Mayor Cresenzi explained that the project was not complete -- neighbors have removed trees, curbs are not in and the Army Corps of Engineers has control over the stream bed. i 30 - July 26, 1988 0 9 1 001140 4 0 Mr. Solomon said he did not think that preventative steps were V V L l taken, and Mayor Cresenzi stated there were problems with two homes on that site where certain items were not put into their deeds, and those problems are being looked into, he concluded. 8. Anthony J. Posillipo - Parking Report Mr. Circosta presented a sketch he drew from the tax maps of proposed parking for 14 cars on Garibaldi Place and 10 additional spaces which would access off Ridge Street. Many objections were raised to this proposal from the residents of Garibaldi Place and they requested to see an alternate plan. j Administrator Russo explained that he had written a letter to New York State regarding a right-of-way over their land near the Posillipo Center but he had not as yet heard back from them. Mayor Cresenzi stressed that this land was purchased for the park and if that meant providing parking for the park, that is what it would be used for. Gloria Bevonia stated that cars would be parked up against her fence and it now took her ten minutes just to get out of her driveway. Bill- Aughavin asked what the parking would be used for and Mayor Cresenzi explained that it would not be for overnight parking; it would be strictly for the park and building which at present cannot be used because of the existing parking situation. This would make the park more usable and relieve the residents at the same time, he concluded. RESOLUTIONS/AGREEMENTS 9. Contract Award #88-02 - 4 Wheel Drive Vehicle w/Plow i i Trustee Mendicino asked what this vehicle would be used for and Mayor Cresenzi explained that aside from snow removal, it would be used for site inspections, emergency commutation and to assist the police. Trustee Mendicino then asked if it would be used as a car and Mayor Cresenzi replied that it would be used in place of a car and provide transportation in inclement weather. Tocci Re: Airport Expansion Mayor Cresenzi stated that he would like to publicly thank Assemblyman Tocci for "going to bat" regarding expansion at the Westchester County Airport. Randy Solomon suggested that Rye Brook support the Airport Consortium, and Mayor Cresenzi said that he has had save al meetings with Donny Gioffre, who is working as coordinator, regarding the proposed expansion plans. - 35 - OU11M) July 26, 1988 Ili 15. Request from NY American Water to Reduce Water Usage Administrator Russo stated that with the recent rains, the letter received from NY American Water was kind of after th2 fact, Y however, the had requested that the residents voluntarily reduce their water usage. And, as Mayor Cresenzi stated, perhaps where NY American obtains their water, there has been no rain, so this was a good thought to keep in mind. APPROVAL OF MINUTES 16, June 28, 1988 On motion duly made and seconded, the Minutes of June 28, 1988 were unanimously approved as presented. SECTION 1, BLOCK 10, LOT SA WHEREAS, a Public Hearing on the Helbing Subdivision, located at 9 Beechwood Blvd. , Was held thi.� 26th day of July, 1988; NOW, THEREFORE BE IT RESOLVED, that the Mayor be and hereby is authorized to sign the Resubdivision Map of loot 2, Block C of Byram Ridge, prepared by Aristotle Bournazos, completed on June 10, 1988, and also known on the Tax Assessment Map of the Village of Rye Brook, New York as Section 1, Block 10, Lot 5A; and be it - 36 - July 26, 1988 001146 FURTHER RESOLVED, that as a condition of l this Subdivision, the encroachment of the j driveway of Lot B onto Lot A be removed and that the driveway of Lot B may never encroach on Lot A.
