March 22, 1988 NEXT MEETING DATES April 26, 1988 - Regular MeeLi.ng May 10, 1988 - Agenda Meeting Rve Brook Village Offices are Handicapped Accessible 001034 MINUTES OF THE BUDGET HEARING, REORGANIZATIONAL MEETING and AGENDA MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF RYE BROOK, HELD ON THE 12th DAY OF APRIL., 1988 IN THE VILLAGE OFFICES, 90 SOUTH RIDGE STREET RYE BROOK, NEW YORK CONVENE MEETING The meeting of the Board of Trustees was called to order by Mayor Cresenzi at 8:00 P.M. in the Meeting Room and the Pledge of Allegiance followed. Present were the following members of the Board: Mayor Salvatore M. Cresenzi Trustee Francis L. Filipowski Trustee Robert J. Ravich Trustee Michele R. Mendicino Also present were: Christopher J. Russo, Village Administrator Georgia Kramer, Village Attorney Rocco V. Circosta, Director of Public Works Frank P. Sesta, Village Accountant Jean A. Marra, Deputy Village Clerk x x w x w 0010R3u April 12, 1988 PUBLIC HEARING 1. PROPOSED 1988/89 BUDGET On motion by Trustee Mendicino, seconded by Trustee Eilipowski, it was unanimously RESOLVED, that the Public Hearing be, and it hereby is, declared open. Mayor Cresenzi turned the discussion on the proposed budget over to the Budget Officer, Christopher Russo, who then presented a synopsis of the budget items which were changed from the previous year. Some of the items Mr. Russo reported on were the obligations of the Village to pay for the Town of Rye retiree benefits, the hiring of a Village Accountant, increased rent for the Village Offices due to the acquisition of additional space, new purchases for the highway and police departments, decreased costs for outside data processing fees because of new in-house computer services, expenses for the newly organized auxiliary police force, the hiring of another recreation leader, an increase in funding for the library, an anticipated significant decrease in refuse collection charges, and a 60% increase in medical and dental benefits for Village employees. Another reason for the proposed tax hike, Mr. Russo stated, was the decrease in corporate taxes which was due to assessment reductions granted by the courts as well as personal tax assessment reductions to the residents of Candy Lane. Citing an increase in vandalism in the area, Mayor Cresenzi asked that the Budget Officer find money in the proposed budget to add an additional police officer to the force, and Mr. Randy Solomon strongly agreed with the Mayor. Also addressed by Mr. Russo was the deteriorated street and poor storm drainage system on Osborn Place. Mayor Cresenzi concurred by stating that a good look should be taken at the Village's sewer system for long-range plans. - 2 - 00:1036 April 12, 1988 Mr. Ken Heller suggested that employees contribute towards their medical insurance in order to keep the cost down. He then asked if the Village-owned property on King Street couldn't be put to use and Mayor Cresenzi replied that the property possibly would be used as the site for a future Village Fire House but that other possibilities could be looked at in the interim. On motion by Trustee Ravich, and seconded by Trustee Filipowski, it was unanimously RESOLVED, that the Public Hearing be, and it hereby is, declared closed. RESOLUTIONS 2. FRANEL - ESTABLISHING RECREATION FEES Mayor Cresenzi proposed that this matter be delayed so the neighboring residents could be met with first. When Trustee Mendicino questioned if the residents would be personally notified, Mayor Cresenzi responded in the affirmative. Ms. Viola Nelson then produced some pictures of Loch Lane which depicted the serious flooding problems in the area. REORGANIZATIONAL MEETING DECLARATIONS/APPOINTMENTS 3. DECLARATION OF MAYOR AND TRUSTEES On motion by Trustee Filipowski, seconded by Trustee Mendicino, with Mayor Cresenzi abstaining, it was - 3 - 00103 i April 12, 1988 RESOLVED, that Salvatore M. Cresenzi, of 13 Holly Lane, be, and he hereby is, declared elected to the office of Mayor of the Village of Rye Brook for a two-year term of office; and be it FURTHER RESOLVED, that said term of office is effective on the 4th day of April, 1988 at 12:00 Noon. On motion by Trustee Filipowski, seconded by Trustee Mendicino, with Trustee Ravich abstaining, it was RESOLVED, that Robert J. Ravich, of 6 Hunter Drive, be, and he hereby is, declared elected to the Office of Trustee of the Village of Rye Brook for a two-year term of office; and be it FURTHER RESOLVED, that said term of office is effective on the 4th day of April, 1988 at 12:00 Noon. On motion by Trustee Filipowski, seconded by Trustee Ravich, with Trustee Mendicino abstaining, it was RESOLVED, that Michele R. Mendicino, of 9 Phyllis Place, be, and she hereby is, declared elected to the Office of Trustee of the Village of Rye Brook for a two-year term of office; and be it FURTHER RESOLVED, that said term of office is effective on the 4th day of April, 1988 at 12:00 Noon. 4. APPOINTMENT OF DEPUTY MAYOR Mayor Cresenzi appointed Trustee Francis L. Filipowski as Deputy Mayor for the next ensuing official year. 4 - 00.1.036 April 12, 1988 5. APPOINTMENT OF VILLAGE CLERK On motion by Mayor Cresenzi, seconded by Trustee Ravich, with a unanimous vote of the Board, it was RESOLVED, that Christopher J. Russo, of 14 Jennifer Lane, be, and he hereby is, appointed as Village Clerk for the Village of Rye Brook for the next j ensuing official year. I 6. APPOINTMENT OF DEPUTY VILLAGE CLERK On motion by Mayor Cresenzi, seconded by Trustee Filipowski, with a unanimous vote of the Board, it was RESOLVED, that Jean A. Marra, of 12 Robbins Avenue, Elmsford, be, and she hereby is, appointed as Deputy Village Clerk for the Village of Rye Brook for the next ensuing official year. 7. CORPORATION COUNSEL On motion by Mayor Cresenzi, seconded by Trustee Filipowski, with a unanimous vote of the Board, it was RESOLVED, that the Village Board of Trustees hereby establishes the position of Corporation Counsel for the Village of Rye Brook this 12th day of April, 1988. On motion by Mayor Cresenzi, seconded by Trustee Mendicino, with a unanimous vote of the Board, it was RESOLVED, that Georgia Kramer, of 200 Country Ridge Drive, be, and she hereby is, appointed as Corporation Counsel for the Village of Rye Brook for the next ensuing official year at a salary to be determined by the Board of Trustees. 5 - t 0103aJ April 12, 1988 8. VILLAGE TREASURER. On motion by Mayor Cresenzi, seconded by Trustee Ravich, with a unanimous vote of the Board, it was RESOLVED, that Joseph Cortese, of 10 Deer Run, be, and he hereby is, appointed as Village Treasurer for the Village of Rye Brook for the next ensuing official year at a salary to be determined by the Board of Trustees. 9. REGISTRAR OF VITAL STATISTICS On motion by Trustee Filipowski, seconded by Trustee Mendicinc, with a unanimous vote of the Board, it was RESOLVED, that Frances C. Nugent, Town Clerk, of the Town of Rye, be, and she hereby is, appointed as Registrar of Vital Statistics for the Village of Rye Brook for a two-year term; commencing on the lst day of January, 1988 and con- cluding the 31st day of December, 1989. 10. RECEIVER OF TAXES On motion by Trustee Filipowski, seconded by Trustee Ravich, with a unanimous vote of the Board, it was RESOLVED, that James Jackson, of the Town of Rye, be, and he hereby is, appointed as the Receiver of Taxes for the Village of Rye Brook for the next ensuing official year. 11. DESIGNATION OF OFFICIAL NEWSPAPERS On motion by Trustee Ravich, seconded by Trustee Filipowski, with a unanimous vote of the Board, it was - 6 - 001040 April 12, 1988 RESOLVED, that The Daily Item and The Westmore News are hereby designated as the Official Newspapers of the Village of Rye Brook for the next ensuring official year; and it be FURTHER RESOLVED, that all legal notices shall hereby be published in The Daily Item and if, in the discretion of the Clerk, timely publication can also be made in The Westmore News (a weekly newspaper) , then the Clerk shall also publish in that newspaper. 12. DESIGNATION OF BOARD OF TRUSTEES MEETING NIGHT On motion by Trustee Filipowski, seconded by Trustee Ravich, with a unanimous vote of the Board, it was RESOLVED, that the fourth (4th) Tuesday of each and every month be, and it hereby is, designated as the Regular Meeting night of the Board of Trustees of the Village of Rye Brook; said meetings to commence at 8:00 P.M. 13. DESIGNATION OF DEPOSITORIES On motion by Trustee Mendicino, seconded by Trustee Ravich, with a unanimous vote of the Board, it was RESOLVED, that the Bank of New York (County Trust Region) , Barclay's Bank of _ New York, and Chase/NBW, be, and they hereby are, designated as depositories for the Village of Rye Brook for the ensuing official year. 14. DESIGNATION OF SIGNATORIES On motion by Trustee Filipowski, seconded by Trustee Ravich, with a unanimous vote of -the Board, it was - 7 - 001. 04 April 12, 1988 RESOLVED, that the Mayor, Village Administrator, Village Treasurer and the Village Accountant be, and they hereby hereby are, authorized to sign checks on behalf of the Village of Rye Brook for the next ensuing official year; and be it FURTHER RESOLVED, that bank transfers from one account to another can be made by telephone by any one of the above- named signatories or by Catherine Spinosa, Bookkeeper, followed by written confirmation to the bank. i I AGENDA MEETING Mayor Cresenzi placed the following items on the agenda for the April 26, 1988 meeting: PUBLIC HEARINGS (Continued) 1. Rye Ridge Shopping Center/Merritt & Holby - Rezoning Approval and Preliminary Site Plan Approval 2. The Establishment of Regulations re: Floor Area Ratio Proposed Local Law #2 - 1988 Mr. Bernie Klem, a member of the Planning Board, stated that a second meeting has not yet been held by the Planning Board regarding Floor Area Ratio and he would like this matter postponed; however, Mayor Cresenzi said he would like to keep it on so it does not have to be re-advertised. Since this matter has been dragging on for so long, Mr. Ken Heller suggested a moratorium be placed on all building in the Village until this has been settled. There is nothing (no major building) pending right now that would affect this, Mayor Cresenzi offered, adding that if that were the case, it would be grandfathered in. Some discussion followed regarding the number of building permits not issued as yet in the Deer Run Subdivision. - 8 - 0010 Sad April 12, 1988 3. Kiewit Industrial - request to install Cable Line It was stated by Mr. Circosta that Kiewit Industrial withdrew their application to install a cable line through the Village. SET PUBLIC HEARING DATE - May 24, 1988 4. Noise Law - Proposed Local Law #3-1988 APPOINTMENTS/AUTHORIZATION 5. Check Register Authorization APPROVAL OF MINUTES 6. March 22, 1988 NEXT MEETING DATES April 26, 1988 - Regular Meeting May 10, 1988 - Agenda Meeting May 24, 1988 - Regular Meeting At this time, on motion by Trustee Filipowski, seconded by Trustee Ravich, with a unanimous vote of the Board, the following resolution was pleasurably adapted: JACK L. KABCENELL WHEREAS, Jack L. Kabcenell has served as the First Mayor of the Village of Rye Brook from 1982 through 1988; and WHEREAS, Jack L. Kabcenell now holds the distinct honor of being the only retired "First Mayor" of a municipality in Westchester County; and WHEREAS, Jack L. Kabcenell has seen the Village through its formative stages and has demonstrated a sincere concern for the future of this Village; NOW, THEREFORE, BE IT RESOLVED, that Jack L. Kabcenell is hereby appointed as "Mayor Emeritus" of the Village of Rye Brook. - 9 - 001043 April 12, 1988 On motion by Trustee Filipowski, seconded by Trustee Ravich, it was unanimously RESOLVED, that this Board meet in Executive Session to discuss personnel matters. A local resident questioned the parking situation in the City of Rye and Mayor Cresenzi stated that Mayor Kabcenell had appointed Mort Smith to the Task Force to investigate this and hopefully they will be reporting back to the Board on May 24th. Administrator Russo added that the City has agreed to extend the date (to exclude nonresident parking) until May 15th and that they have not removed the meters (from the parking lot) . Mr. Ken Heller questioned the inadequate job the contractor did on the slurry seal and Mayor Cresenzi reported that the contractor has agreed to come back and repair it at no cost to the Village. Mr. Jules Harris complimented the Budget Officer and remarked on the excellent presentation he gave.
