MINUTES OF THE BOARD OF ASSESSMENT REVIEW
AGENDA MEETING and CANVASS OF VOTES OF THE
BOARD OF TRUSTEES OF THE
VILLAGE OF RYE BROOK, HELD ON THE
16th DAY OF MARCH, 1988 IN THE
VILLAGE OFFICES, 90 SOUTH RIDGE STREET
RYE BROOK, NEW YORK
CONVENE MEETING - BOARD OF ASSESSMENT REVIEW
The meeting of the Board of Assessment Review was called to
order by Mayor Kabcenell at 6:35 P.M. in the Conference
Room.
Present were the following members of the Board:
Mayor Jack L. Kabcenell
Mayor Elect Salvatore M. Cresenzi
Trustee Milton Meiskin
Trustee Mario J. Nardi
Trustee Francis Filipowski
Also present were:
Christopher J. Russo, Village Administrator
Georgia Kramer, Village Attorney
Barbara Chase, Assessor
Trustee Elect Robert J. Ravich
Trustee Elect Michele R. Mendicino
Jean A. Marra, Deputy Village Clerk

Assessor Barbara Chase explained that all of the grievances
filed were reviewed and based on inspections she recommended
certain changes.
Avis Rent A Car requested a reduction from $765,100 to $9,000
she stated, and that matter was in litigation with the Town of
Rye. Ms. Chase added that there was a recent decision in
California regarding the tax status of rental car agencies on
publicly owned property and the court ruled in favor of the
rental agency.
Of the 14 homes on Candy Lane, 11 filed grievances, Ms. Chase
stated, and she met with all of them and discovered that there
were some drainage problems and flooding of basements in the
area.
Attorney Georgia Kramer suggested that if it was determined to
be a timely filing, then the next step ought to be proceeded
with. The Assessor said she would check the recent sale price
and Mayor Kabcenell suggested that the matter be held off for
now.
Two grievances were filed the night of the meeting, Ms. Chase
stated -- one was for an enlarged deck; not an additional one
and the other application was in error.
The Assessor was then requested by Mayor Kabcenell to review the
Candy Lane properties.
The last grievance to be discussed was the Ridge Bowman Building
(the building the Village Offices occupy) . Last year, Assessor
Chase stated, the building was assessed at $247,900 and she
added that she just received a copy of the lease for the State
Department of Taxation and Finance; and that lease was effective
as of February 13, 1988.
Mayor Kabcenell summarized by saying that Candy Lane, the status
of Brook II Ventures and Avis would be considered for budget
purposes.

At this time, since no one appeared to be heard, and on motion
duly made and seconded, the meeting of the Assessment Board of
Review was adjourned and the Board proceeded to canvass the
votes.
CANVASS OF VOTES
Mayor Kabcenell reported on the election results and on motion
by Trustee Nardi, seconded by Trustee Filipowski, the following
resolution was unanimously adopted:

WHEREAS, on the 15th day of March, 1988 there was held in the Village of
Rye Brook, New York, the Annual Village Election of said Village; and
WE, the undersigned Board of Trustees of the Village of Rye Brook, having
duly met at the Village Clerk's Office at 7:30 P.M. on this, the 16th day of
March, 1988, and the Village Clerk having produced at such meeting the returns
of the Inspectors of Election of the 20th, 21st, 22nd, 23rd, 26th, 27th and
29th Election Districts constituting all of the Election Districts in the
Village of Rye Brook, as tabulated above, do hereby certify by affixing our
signature, pursuant to Section 15-126 of the Election Law, that we have
canvassed the return of votes of said Village Election.

At this time, on motion duly made and seconded, the Board
adjourned into Executive Session to discuss personnel matters.

CONVENE AGENDA MEETING
Mayor Kabcenell called the Agenda Meeting to order at 8:05 P.M.
in the Conference Room and in the absence of a flag, the Pledge
of Allegiance was not said.
The Mayor then stated that the following items would be placed
on the agenda for the March 22, 1988 meeting:

At this time, Trustee Filipowski requested that the question on
the Noise Ordinance be reviewed so a decision could be reached.
' ADJOURNMENT
At 8:15 P.M. , on motion by Mayor Elect Cresenzi, seconded by
Trustee Filipowski, the Agenda Meeting was adjourned and the
Board reconvened into Executive Session to continue discussing
personnel matters.
Due to a prior commitment, Trustee Meiskin excused himself from
the meeting at 8:45 P.M.
