MINUTES OF A REGULAR MEETING OF
THE BOARD OF TRUSTEES OF THE
VILLAGE OF RYE BROOK, HELD ON
THE 24th DAY OF FEBRUARY, 1987 IN THE
VILLAGE OFFICES, 90 SOUTH RIDGE STREET
RYE BROOK, NEW YORK
CONVENE REGULAR MEETING
The Regular Meeting of the Village Board was called to
order by Mayor Kabcenell at 8:00 P.M.
Present were the following members of the Board:

1. APPROVAL OF MINUTES
The Minutes of January 13th and January 27, 1987 were
presented and on motion by Trustee Meiskin, seconded by
Trustee Nardi, were unanimously approved as submitted.
3. LOCAL LAW: RESPONSIBILITIES OF VILLAGE ADMINISTRATOR
Mayor Kabcenell explained that within ninety days of the
appointment of a Village Administrator, a local law must be
entered delineating the responsibilities of that office.
This proposed law does that as well for employees of the
Village and also for outsiders; it clearly establishes the
statutory rights of the Board of Trustees, he added.
In answer to a question posed by Trustee Meiskin, Attorney
Kramer replied that legally, the Mayor and the Board of
Trustees equals the Board of Trustees
Administrator Russo answered Trustee Nardi's question by
stating that he was quite satisfied with the contents of the
proposed local law.
Mayor Kabcenell then requested that the proper legal notice
be made in order for a public hearing to be held on March
24, 1984 regarding the enactment of this proposed law.
4. DAY CAMP FEES
It was explained by Mayor Kabcenell that summer day camp was
subsidized a little better than 50% by the Village of Rye
Brook and in order to maintain the high quality of the camp
and keep the same proportion of supervision, it would be
necessary to raise the salaries of the camp workers. In
order to offset the increase, it was recommended that camp
fees be increased from $80 - $20 to $100 - $30, and to also
have a totally separate program for 8th and 9th graders at a
fee of $350; $400 for non-residents, and that charge would
also include day trips, the Mayor added.

There was also a recommendation for a sports camp at the fee
of $30 for residents and $40 for non-residents. In all
instances, Mayor Kabcenell stated, there would be an
increase of cost for those who registered after May lst.
Trustee Nardi stated that he was of the opinion that in
order to make this move from a 50% Village-supported
endeavor to a 25% endeavor in one year would be a heavy
burden, but Mayor Kabcenell explained that the programs
would still be 50% supported by the Village; it was only the
increase in costs that was being addressed.
The Superintendent of Recreation & Parks, Thomas Hroncich,
said the effort was to keep pace with the salary increases
for the day camp personnel which would be increased from
$2.50 to $3.35 an hour.

The issue here was how much of the cost would get picked up
by those who do not send their children to day camp, Mayor
Kabcenell offered.
An amendment that "all children in the day camp qualify for
the second-child discount" was proposed by Trustee Meiskin;
Trustee Cresenzi seconded the motion, and it was unanimously
RESOLVED, that a second-child discount
be honored for children in kindergarten
through 7th grade in the Village of Rye
Brook Day Camp Programs; and
BE IT FURTHER RESOLVED, that the
increase in fees, as recommended by the
Recreation Commission, be and they
hereby are approved.
5. UNNECESSARY NOISE (CONTINUATION OF PUBLIC HEARING)
Mayor Kabcenell explained that the present law outlines what
times certain noise can take place: such as the use of power
tools, gardening equipment, tree trimming, etc.; this is an
attempt to ascertain what constitutes unnecessary noise.

Attorney Kramer summarized the changes as follows:
1. The change in hours: from 10:00 P.M. to 8:00 P.M. and
from 8:00 A.M. on weekends to 9:00 A.M.
2. As to unnecessary noise: one proposal delegates
authority to the Building Inspector to promulgate
regulations as to what decibel levels shall be permitted
during various hours; the other proposal sets specific
decibel levels that are not permitted and that is very
confusing, she added.
Thereafter, on motion by Trustee Zak, seconded by Trustee
Cresenzi, it was unanimously
RESOLVED, that Local Law #37-84,
Unnecessary Noise, be amended by
changing the hours in which unnecessary
noise not be permitted, to wit: from
10:00 P.M. to 8:00 P.M. and from 8:00
A.M. on weekends to 9:00 A.M.; and
BE IT FURTHER RESOLVED, that the
Building Inspector is hereby authorized
to ascertain what decibel levels shall
be permitted during various hours.
On motion duly made and seconded, the Public Hearing was
closed after which Mayor Kabcenell requested that this
amendment be put in its proper form and filed with the
Secretary of State.
2. RYE BROOK TOWNHOUSES - LUNDELL
A review of alternate plans for the Lundell/Rye Brook Town-
houses was conducted by the Board pursuant to previous
recommendations to have this proposed development be more
aesthetically pleasing to the present homeowners in the
area, Mayor Kabcenell stated.
The Chairman of the Planning Board, Herb Adler, addressed
the Board and reported that the members of the Planning
Board reviewed the two alternate plans submitted: Scheme A
and Scheme B.

Considering the topography of the land it was a difficult
decision, Mr. Adler stated, because it also came down to a
certain amount of aesthetics; but the Planning Board does
recommend Scheme A. While there was nothing wrong with
Scheme B, he said, the long corridor entranceway would be
eliminated if Scheme A was used and, therefore, it would be
much more aesthetically pleasing.
Also, as one entered the development, the eye would focus on
the courtyard/village green area rather than turning the eye
toward the side of the development, Mr. Adler pointed out,
adding that the solid looking appearance would be eliminated
by staggering the building and roof lines and increasing the
setbacks along the northerly boundaries. It was too early
to address landscaping, but that particular border would
require very extensive landscaping for screening purposes,
Mr. Adler offered.
Since parking has always been a concern, the developer has
proposed using "grasscrete" in the parking areas, Mr. Adler
mentioned, and Scheme A was favored in order to avoid the
necessity of cars being parked on the actual roadway, which
was the case in some other cluster developments and has
proven to be unsightly, as well as posing a hazard in terms
of ingress and egress for emergency vehicles.
If anything particular about the topography of the land or
the drainage system developed, one could decide favorably
of Scheme B; but the problem has not presented itself, Mr.
Adler noted.
Mr. Adler continued that the Village Board should note it
was recommended by the Planning Board that a drainage expert
be retained, at the expense of the developer, to assist in
addressing any drainage problems.
A separate consultant, different than the consultant for the
developer, would be retained to review this project in order
to achieve that goal, Mayor Kabcenell donated.
Another issue addresed by the Planning Board and Traffic
Commission, Mr. Adler related, were the traffic exits. The
choices were to exit on Wyman Street or else use the present
exit on Mundell. It was everyone's reconmendation, including
the County, not to have the two exits so close together as
it would present a significant danger; therefore, the use
of Wyman Street was recommended as the appropriate means of
ingress and egress for this complex.

Trustee Zak stated he was in disagreement with the Planning
Board's recommendation, and said that he preferred Scheme B
as the parking spaces would be too close to the houses along
Wyman Street in Scheme A.
When asked by Trustee Nardi if there would be heavy
screening in that particular location, Mr. Adler replied
that the landscape plans had to be worked out but they
would have to meet with the Village's approval.
Following some further discussion, on motion by Trustee
Meiskin, seconded by Trustee Nardi, with Trustees Cresenzi
and Zak voting nay, it was
RESOLVED, that this Board hereby accepts the
recommendations of the Planning Board and
supports Scheme A together with the caveats
that have been presented in the Planning
Board Minutes and as previously discussed;
and
BE IT FURTHER RESOLVED, that the applicant
shall deposit the amount of $3,500 with the
Village of Rye Brook, and that said sum shall
be held in escrow until needed for consulting
fees on drainage and flood control relative
to this application; and
BE IT FURTHER RESOLVED, that if said sum
shall not be sufficient, then within fifteen
-days written request, applicant shall pay any
additional sums for said consultant.
6. SIGNAL LIGHT MAINTENANCE AGREEMENT WITH COUNTY
Mayor Kabcenell explained that the two signal lights the
Village was concerned with were the ones on South Ridge
Street/Bowman Avenue and the other on North Ridge Street/
Betsy Brown Road, and on motion by Trustee Zak, seconded by
Trustee Meiskin, it was unanimously
RESOLVED, that Mayor Kabcenell be, and he
hereby is, authorized to execute a contract
with Westchester County for the maintenance
of traffic signal lights in the Village of
Rye Brook, in the amount of $3,029.

8. USE OF VILLAGE STREETS FOR PORT CHESTER ROAD RACE
In response to a request by the Village of Port Chester, and
on motion by Trustee Zak, seconded by Trustee Nardi, it was
unanimously
RESOLVED, that the Village of Port
Chester is hereby granted permission to
use certain streets in the Village of
Rye Brook on April 12, 1987 for their
Annual Road Race.
9. RYE TOWN HILTON CERTIORARI - APPROVAL OF SETTLEMENT
Following Mayor Kabcenell's explanation and the recom-
mendation of the Assessor, Kenneth White, on motion by
Trustee Cresenzi, seconded by Trustee Meiskin, it was
unanimously
RESOLVED, that in accordance with the
terms recommended by the Assessor, this
Board hereby authorizes the settlement
of certiorari proceedings - Rye Town
Hilton v. Village of Rye Brook - for the
prior assessment year will remain as is
in the amount of $4,494,700; and be it
FURTHER RESOLVED, that in accordance
with the terms recommended by the
Assessor, this Board hereby authorizes
the settlement of certiorari proceedings
-- Rye Town Hilton v. Village of Rye
Brook -- in the amount of $4,047,800 for
the current assessment year and for the
1988 assessment year.
10. REVIEW OF TAX GRIEVANCES FILED FEBRUARY 17, 1987
This matter was rescheduled for March 10, 1987 in order for
the Assessor to be in attendance.

11. STREET LIGHTING REPORT
Administrator Russo stated that he had requested that
representatives from Con Edison attend the next Board
meeting in order for the Board to review the street lighting
report and make their evaluations. Mr. Russo added that he
was in contact with the street lighting contractor who will
be furnishing a report on next year's requirements.
7. FIRE LANES AT RYE TOWN HILTON
Public concern has developed over the need for clarification
of fire lanes in areas of public assembly, Mayor Kabcenell
said, and this matter has been reviewed by the Building
Inspector and Fire Chief and it is now in the process of
being compiled into specifics for various areas. Within the
next few weeks, a public hearing will be held regarding
this, the Mayor added.
12. CABLE TV REPORT
Since no report was available at this time, the matter was
deferred to the next meeting.
NOT ON THE AGENDA
Girl Scout Week
In answer to a letter received by Trustee Nardi, on motion
by Trustee Meiskin, seconded by Trustee Cresenzi, the
following resolution was unanimously adopted:
WHEREAS, the 75th Anniversay of Girl Scouting
is a celebration of the vitality of the
world's largest voluntary organization for
girls; and
WHEREAS, it is a celebration of a 75 year
commitment to meeting the changing needs of
girls; and

WHEREAS, it is a celebration of adventure
that challenges Girl Scouts to learn new
skills, to try new activities and to explore
other cultures; and
WHEREAS, it is a celebration of the Girl
Scouts gift of services and good citizenship
to our communities and neighborhoods; and
WHEREAS, it is a celebration of a bright
future for young women and for Girl Scouting;
and
WHEREAS, our community has been the direct
beneficiary of this 75 year tradition;
NOW, THEREFORE, I, Jack Kabcenell, by virtue
of the authority vested in me as Mayor, do
urge the citizens of the Village of Rye Brook
to support the Girl Scouts in their celebra-
tion; and be it
FURTHER RESOLVED, that I now proclaim the
week March 8th through March 14th, 1987 as
GIRL SCOUT WEEK
in the Village of Rye Brook.
Trustee Meiskin reports
1. Trustee Meiskin extended his thanks to the Village
Administrator for the Weekly Activity Reports he has
been submitting to the Board.
2. Since the Highway Department did such an outstanding job
on snow removal from the January 22nd storm, Trustee
Meiskin moved that a letter of commendation be sent to
them.
Trustee Zak seconded the motion, and it was unanimously

RESOLVED, that a letter of commendation be
sent to the Highway Department recognizing
the outstanding job they did in the removal
of snow following the January 22nd storm.
Mayor Kabcenell reports:
1. A request was received from Brook Two Ventures to submit
their Draft Environmental Impact Statement at the March
10th meeting, but Mayor Kabcenell recommended that it be
put over until the regular Board meeting on March 24th.
Attorney Kramer reports:
1. The Chief of Police was in contact with Attorney Kramer
and he recommended imposing a surcharge on the Burglar
Alarm system fee in order to defray some of the costs
incurred for a certified mailing, Mrs. Kramer noted.
At this point, the first order of business should be to
inform the local residents of this local law and then
the enforcement of it will be dealt with, Mayor
Kabcenell responded.
The past president of the Port Chester/Rye Brook Board of
Realtors, Ms. Goldie Soloman, read complaints into the
record regarding the posting of signs by local realtors.
Mayor Kabcenell apologized for the delay in responding to
the letter and advised her that a response would be forth-
coming and indicated that the matter would be taken under
advisement.

A local resident complained about the delivery of the
Pennysaver and the way the papers are throw about her
property, to which Mayor Kabcenell announced that the
Pennysaver will be called and requested to cancel delivery
of the paper to her home.
ADJOURNMENT
On motion duly made and seconded, it was unanimously
resolved that the meeting be adjourned.
