FURTHER RESOLVED, that the annual salary i.+ A
for Recreation Attendant, Frank Errigo,
be and it hereby is set at $21,000,
effective March 3, 1988.
RESOLVED, that in accordance with Civil
Service List, 475-984D, Police Detective
Eugene Matthews be, and he hereby is,
appointed as Sergeant for the Rye Brook
Police Department, effective March 17,
1988; and be it
FURTHER RESOLVED, that Mr. Matthews be
compensated at the annual salary of
$40,052.
ADJOURNMENT
Thereafter, on motion duly made and seconded, the meeting
adjourned at 9:40 P.M.

To the Mayor , Trustees and Building Department
of the Village of Rye Brook :
Gentlemen :
On Friday , February 19, 1988 , while driving to my residence
which is located at 22 Lincoln Avenue , I observed to my dismay
that the property adjoining mine on Lot 3 at Deer Run was
completely denuded of all trees and shrubs whatsoever .
How this complete deforestation and defoliation could have
taken place is beyond me and I , together with the other
residents of the Village of Rye Brook, whom you have sworn to
represent , are entitled to a full explanation of this matter .
When the Deer Run Subdivision was approved by the Village
Board on August 25 , 1986 , there was an entire section of the
approval devoted to tree preservation which is attached hereto
as Exhibit A. That this Board should have taken so much much
time to promulgate specific rules regulating the preservation of
trees in the Deer Run Subdivision and then not see to their
enforcement is a question to which the community at large is
entitled to a direct and complete answer and explanation.
At a meeting of the Rye Brook Planning Board on October 2 ,
1986 at which then members Adler, Corwin and Filipowski were
present , the tree locations for certain lots in Deer Run were
discussed and even additional trees to those designated were to
be planted by the developer. See Exhibit B.
On June 23 , 1987 , there was additional discussions and
decisions relating to the trees at the Deer Run project. There
were resolutions introduced by Trustee Milton Meiskin and
seconded by Trustee Salvatore Crezenzi , which resolution was
unamimously adopted , that still related to prohibition of the
removal of trees and even went so far as to require that digging
be done by hand to avoid destruction of trees . See Exhibit C.
At that same meeting , there were to be deed restrictions imposed
on the new owners of the property to maintain grades within the
swales or retention areas. See Exhibit D.
In view of all of the foregoing actions by the Board of
Trustees of this Village , there would appear ppear to he a violation
of the Village resolutions in the removal of the trees from the
said property . As was stated in Subdivision approval the then :
"Board of Trustees has noted that the site
contains numerous large and valuable trees
which over the years have helped to establish
the character of this part of the Village of
Rye Brook , Because of the importance of
these trees to the future inhabitants of the
subdivision as well as to the general
neighborhood , the following conditions shall
be complied with . . . " See Exhibit A.
While the Mayor and Board of Trustees are looking into the
foregoing matter , they might also consider determining what , if
anything , occured with respect to the investigation of the 15
foot wide emergency access walkway easement and the open dirt
ditch storm drain which is on the property which was raised by
me . See Exhibit E. The extent of any action taken by Mark Ten
Eicken, the Assistant Building Inspector or the Village Planning
Board in conformity with the request of Mayor Jack Kabcenell on
November 25 , 1986 is of interest since apparently here also
nothing was ever done although specifically requested by the
Mayor .
