MINUTES OF REGULAR MEETING HELD BY THE VILLAGE BOARD ON DEC, 17, 1985
at the Village Office, 111 South Ridge Street, Brook, at 8:00 p.m.
PRESENT: Mayor Kabcenell, Trustees Cresenzi, Meiskin, Nardi and Zak
Treasurer Cortese, Attorney Kramer, Clerk Smith
The minutes of the Agenda Meeting held on Tuesday, November 12, 1985
were approved as submitted.
PUBLIC HEARINGS:
DEEP LOT SUBDIVISION REGULATION AMENDMENT
Mayor Kabcenell advised that after careful review, it is the opinion of
the Village Board that this matter needs a total, thorough study. A
regulation is needed that will satisfy the needs of the community and
that will benefit existing residents as well as prospective builders.
On the motion of Trustee Nardi, seconded by Trustee Cresenzi,
BE IT RESOLVED that the amendment to the Subdivision Regulations
regarding Deep Lots be DENIED until further notice, pending a total,
thorough study.
The vote on the motion was as follows:

BETSY BROWN ROAD SUBDIVISION
Mayor Kabcenell advised that it was the sense of the Village Board that
the new plan submitted for the Betsy Brown Road property needs A full
review by the Planning Board.
Mr. Bruno Gioffre, attorney, spoke in defense of the plan submitted and
requested that it be considered and approved by the Board of Trustees
rather than being returned to the Planning Board.
Mr. Stewart Cohen, architect, also spoke in defense of the plan. He
feels that they have compiled with all requested changes and
alterations in good faith.
Mayor Kabcenell will try to have the Planning Board take action on the
new plan in a timely manner in the hopes that the plan can be
considered at the Agenda Meeting of the village Board to be held on
Tuesday, January 14, 1986.

On the motion of Trustee Nardi, seconded by Trustee Mei.skin,
BE IT RESOLVED that the new plan submitted for development of the Betsy
Brown Road property be referred back to the Planning Board and that
every effort be made to have it returned to the Board of Trustees by
January 14, 1986.
The vote on the motion was as follows:

DISCUSSION AND REPORTS:
DRAINAGE PROBLEM: 2 & 4 HOLLY LANE
Felix Fidelibus, Village Engineer, reported that he had visited the
site in question. A 12" catch basin on Mr. Kaplan's property flows
into a 18" pipe which increases to 24" as it goes down stream. It
would have to be cleaned out, the pipe repaired and a larger catch
basin installed on this property in order to solve the drainage
problems. The property in question is part of a larger drainage area
and legally could be maintained and serviced/repaired by the Village if
the Village accepts the easement.
The Board of Trustees instructed Mr. Fidel.ibus to secure the necessary
information regarding the cost repairing the pipe and the owner must
hire a surveyor to prepare a description of the necessary easement.
RESOLUTIONS:
CON EDISON APPLICATION FOR REFUND
On the motion of Trustee Nardi, seconded by Trustee Cresenzi,
WHEREAS, Consolidated Edison Company of New York has filed an
application for refund of Real Property Taxes in the amount of
$36,052.80 for 1983 and $75,977.88 for 1984, and
WHEREAS, these taxes were levied against Special Franchise Assessments
determined by the State Board of Equalization and Assessment, and
WHEREAS, the Village Assessor recommends denial of these applications,
THEREFORE BE IT RESOLVED, the Village Board of Trustees deny the two
applications for refund of Real Property Taxes based on the 1983 and
1984 Special Franchise Assessments in the respective amount of-
$36,052.80 and $75,977.88.

OTHER ITEMS:
- Mayor Kabcenell gave a brief report on the injured Highway Department
worker. The Board of Trustees is most saddened by what happened and
shares the concerns and prayers with his family.
- The condition of the pavement on Ridge Street is deteriorating and had
been scheduled for repavement in June of this year. The Board is in
the process of dealing with the County of Westchester on this matter
and get it rescheduled as soon as is feasible.
Georgia Kramer, Village Attorney, advised that parks deeded in the name
of the Town of Rye are new deeded to the Village of Rye Brook.
Transfer automatically came by Operation of Law and happened at the
moment of incorporation.
The Cable TV company is charging additional fees for VCR hook-ups. The
Board will send a letter of concern to UA Columbia and inform the
residents by the Village Newsletter.
The next Agenda Meeting will be held on Tuesday, January 14, 1986 at
8:00 p.m. The next Regular Meeting will be held on Tuesday, January
28, 1986 at 8:00 p.m.
The meeting was adjourned at 9:45 p.m.
