Present: Mayor Kabcenell, Trustees Meiskin, Harris, Zak Clerk Smith, Attorney Kramer Absent: Trustee Nardi Mayor Kabcenell opened the meeting with a discussion on parking regulations in the Village during November 15 and March 15, and the attendance of a large number of residents who had received warning notices on their cars during the last few days. He had also requested that the Police Chief and Highway Superintendent be present, and the Chairman of the Traffic Commission. He noted that the Vehicle & Traffic Law which covers parking was the subject of much discussion and meetings of the Traffic Commission and the Village Board. He quoted two sections of the Law No. 7-84 — Section 18. All night parking. A. The parking of any vehicle is hereby prohibited on all public streets or highways within the Village of Rye Brook between 2.00 a.m. and 6.00 a.m., from November 15 to March 15, except West Street. B. No all—night parking of trucks or other commercial vehicles will be permitted at any time on the streets of the Village of Rye Brook. Section 21. Plowing and clearing highways. During plowing and clearing of snow from the public streets or highways, or in the event a snow emergency has been declared in Westchester County,- no vehicle shall be parked on any side of any public street or highway in the Village of Rye Brook, with the exception of the following streets or highways: West Street. Mayor Kabcenell said the reason for both of these sections strictly relate to snow clearing. Traffic Commission Chairman Joe Pellino, Highway Superintendent Donald Brown and Police Chief Gendalia were asked to comment on the situation, and there was a suggestion that perhaps alternate side of the street parking could relieve the overcrowded situation of cars and no place to put them. The Mayor asked the Traffic Commission, to review this law in light of tonight's discussion, with the cooperation of the Police Chief and Highway Superintendent, and in the meantime told the residents that tickets would not be issued in this respect until we had their report. PUBLIC HEARING SUBDIVISION APPLICATION MAGID PROPERTY, LINCOLN AVENUE. The environmental impact form indicates that there is negative impact, and the Town of Harrison, since a small section of this land is in Harrison, issued a Notice of Determination with a negative declaration, and the Planning Board recommended approval at its meeting of June 22, 1983. therefore, - On the motion of Trustee Harris, seconded by Trustee Zak, RESOLVED that the Environmental Form submitted in connection with the application for subdivision of the Magid Property on Lincoln Avenue, Rye Brook, be accepted. Trustee Meiskin voting AYE Trustee Harris voting AYE Trustee Zak voting AYE Mayor Kabcenell voting AYE Trustee Nardi ABSENT 00042 On the motion of Trustee Harris, seconded by Trustee Zak, RESOLVED that the subdivision application of Sanford Magid for property on Lincoln Avenue be approved, subject to payment of a fee to the Rye Brook Recreation Trust Fund in the amount of Fifteen hundred dollars ($1500.00). Trustee Meiskin voting AYE Trustee Harris voting AYE Trustee Zak voting AYE Mayor Kabcenell voting AYE Trustee Nardi ABSENT SUBDIVISION APPLICATION LUNCARIELLO PROPERTY ROANOKE AVENUE. Attorney William Holden explained that this was a realignment of the side line dividing the two lots after a porch was added to a house on one of the lots, to make it conform. The lot which now has a swmming pool on it (to be removed) is 7,000 s.f. and the requirement is 5,000 s.f. Several neighbors were present, and in response to a statement that they had not all been notified, although we had mailed notices, Attorney Kramer stated that it is required that we publish, but it is not required that we send notices individually. They registered opposition because of the tight parking situation. Trustee Harris asked for a delay so that he could look at the location, and Mayor Kabcenell said his inclination was to adjourn the hearing to- December 18th so that neighbors could be notified and those who choose to appear could do so. This is a request foi a change of side line and it does constitute a legal building Lot. There is a whole separate process if the owner goes forward and applies for a building permit, and necessary conditions will be imposed. On the motion of Trustee Harris, seconded by Trustee Meiskin, RESOLVED that the hearing on the subdivision application for the Lungariello property on Roanoke Avenue be adjourned until December 18th, 1984 at 8 p.m. Trustee Meiskin voting AYE Trustee Harris voting AYE Trustee Zak voting .AYE Mayor Kabcenell voting AYE Trustee Nardi ABSENT BOND ANTICIPATION NOTE No. 1.— $385,668.00. Treasurer Cortese stated that this Bond Anticipation Note became due and that with Trustee Mario Nardi had worked on the renewal for one year at the rate of 5.75%. The Treasurer arranged payment for the Capital Note of $11,790. On the motion of Trustee Harris, seconded by Trustee Zak, RESOLVED that the Village of Rye Brook renew Bond Anticipation Note No. 1 in the amount of $385,668 for a period of one year at 5.75% with the Bank of New York. On the motion of Trustee Meiskin, seconded by Trustee Harris, - RESOLVED that the Public Hearing on the adoption of local laws be adjourned until December 18, 1984 at 8 p.m. Trustee Meiskin voting AYE Trustee Harris voting AYE Trustee Zak voting AYE Mayor Kabcenell voting AYE Trustee Nardi ABSENT. Discussion of Governmental Structure for the Village. The meeting was adjourned at 10.15 p.m. and the Board moved into executive session for discussion of union contracts.
