Present: Mayor Kabcenell,Trustees Meiskin, Nardi, Barris,
Zak, Treasurer Cortese, Attorney Kramer, and
Clerk Smith. -
Minutes of the October 25th Regular Meeting and November
7th Special and Agenda Meetings were accepted as presented.
CORRESPONDENCE.
Mayor Kabcene.11 read the following letter from Ed Lorch
who was injured while he was helping someone.
"Although I am unable to attend this evening's meeting,
-- I wish to take this opportunity to give expression to my
thoughts on my recent accident and its aftermath.
Nothing is more important in this communication than that
the Village Board understand the feelings of gratitude
which I, and my family, have toward those members of the
Rye Brook Police Department and the Volunteer Ambulance
Corps of Port Chester - Rye, who responded as I lay at the
accident scene. First, I am proud of the Police Officers
as a citizen of the Village, second, and on a more emotional
level, I am proud of those Police Officers as a 17 year
member of the extended Police family. As for the Ambulance
Corps, nothing I can say will be sufficient. They are a
part of this community, uniquely dedicated to others, which
cannot ever be properlythankedor adequately praised.
Although thisoccurrence may leave me with some permanent
Physical reminder, in a strange way it was worth the pain
to truly discover my community. It will never leave my
-- mind for long that as quickly as I was injured, so did my
neighbours rally. They surrounded me protectively while
I lay in the street, they cared for my family while I was
- - hospitalized, and they have gone out of their way to lend
aid and comfort upon my return.
It may be a long time before I regain full strength in my
legs, but the time will never come when I will be able to
walk away from this Community, this Village, these people,
my home."
The Mayor commented that Ed Lorch has given many years of
service to the community, and we look forward to his return.
The Mayor said we probable receive two or three letters every
week commending the Police Department and we are glad that
we have been able to increase their rescue training so that
they are better able to respond, and are grateful to them
that we have this kind of excellent service.
Two more letters were received this week, one from Resident
Bob Quat commending the quick action of Officers Bottali and
Heil in an emergency situation with Mrs. Quat,, and a letter
from Senator Joseph Pisani congratulating Officer Peter
_ Ramundo who was responsible for saving a woman's life at the
Rye Ridge Shopping Center. The Mayor added that this was
the second time in recent weeks that Officer Ramundo had
saved a life.
ROYAL EXECUTIVE PARK - Application for Subdivision.
Letter of November 17 addressed to the Village Board from
Joel H. Sachs, Attorney, was read by Mayor Kabcenell, copy
of which is annexed hereto.

WHEREAS, the Village Board of the Village of Rye Brook
has previously designated itself as lead agency for all
future actions related to the development of Royal Executive
Park project located off upper King Street, north of
Anderson Hill Road in the Village of Rye Brook; and
WHEREAS, on November 17, 1983 Royal Executive Park has filed
an application with the Village Board of the Village of
Rye Brook for subdivision approval in order to subdivide its
property within the Village of Rye Brook into two parcels,
one parcel of approximately 25 acres to beknown as Royal
Executive Park I and one parcel of approximately 50 acres
to be known as Royal Executive Park II; and
WHEREAS, the instant application for subdivision approval is
merely for the purpose of enabling the principals of Royal
Executive Park to refinance the project and such subdivision
approval will not allow any further development of the Royal
Executive Park Site;
THEREFORE, BE IT RESOLVED, that in regard to the subdivision
application of Royal Executive Park, the Village Board of
the Village of Rye Brook hereby determines that the proposed
subdivision of the Royal Executive Park Property located
in the Village of Rye Brook will not have a significant
effect on the environment and thus directs that a "Negative
Declaration" be issued pursuant to the requirements of the
New York State Environmental Quality Review Law and the laws
of the Village of Rye Brook; and
IT IS' FURTHER RESOLVED, that the reason for this determination
.As that the granting of the subdivision approval application
will merely result in the subdivision of the Royal Executive
Park parcel into two parcels and will not authorize any
further development on the site; and
BE IT FURTHER RESOLVED, that the Village Clerk of the Village
of Rye Brook is hereby authorized to prepare a negative
declaration and have such declaration published and posted as
required by law.
The Mayor explained that in substance this is a request from
Royal Executive Park to divide their property into two parcels,
one of 2S acres, and one of 50 acres, the 25 acre parcel being
the one which now has three completed buildings. This is
because they want to refinance, the bank needs a separate parcel.
Joel Sachs, Attorney for Royal Executive Park stated that
under the laws of the State and Village, there will have to
be a Public Hearing, and if anyone has any questions they
can be asked at that time, at the December Board Meeting.
Trustee Nardi asked if .the density would be greater than it
is now, Mr. Sachs suggested that be part of the subdivision
agreement.
It was decided that the Public Hearing be set for the next
Regular Board Meeting on December 20th.

Trustee Meiskin suggested that we return to the old formula
of moving the Board meetings around the community so that we
might encourage other people to attend. It was agreed that
the December 13th Agenda Meeting be held at Posillipo Center
and the December 20th Regular Meeting be held at the Ridge
Street School Cafeteria.

WHEREAS, Harry Howard Hook & Ladder Co. No. 1 was formed in 1858 by a group
of young men who raised funds, and for $90 purchased haul equipment to start
a Mode and ladder company, and
WHEREAS, on october 13, 1858 the rawly formed fire ompany elected officers
and chose the company name, and
WHEREAS, on November 11, 1858 the stockholders petitioned the Board of Trustees
of the Port Chester Fire Department to accept their equipment and unite than
with the Port Chester Fire Department, and
WHEREAS, on December 3, 1858 the Hoard of Trustees of the Port Chester Fire
Department voted to accept the fire equipment, to confirm Harry Howard Hook &
Ladd er Co. No. 1 (the new of the new organization) and to make it a permanent
part of the Port Chester Fire Department, and
WHEREAS, the new fire company oontinuW to grow, as did its association with
the man whose name it bore, Chief Barry Howard, the famed Chief Engineer of
the New York City Fire Department, and
WHEREAS, this growth extended to the purchase of a horse drawn American Is
France aerial ladder truck in 1908 and a motorized tractor in 1913.to replace
the horses that pulled the truck to fires, and finally to a second ladder truck
in 1927, all of which have been replaced by the present two ladder trucks that
have been kept in service by the volunteers of Harry Howard Hook & Ladder Co.
No. 1, and
WHE1401AS, for 125 years, 579 men havu not only volunteered their time, efforts
and expertise in service to the Villages of Port Chester and Rye Brook, but
have also served our Country in its wars and conflicts from the Civil War to
Viet Nam, and -
WHEREAS, ten men of Harry Howard Book & Ladder Co. No. 1 have served as
Chief of the Port Chester Fire Department, while many others have earned
medals of valor, citations and distinguished service awards in the line
of duty,
On the motion of Trustee Harris seconded by 'Trustee Meiskin,
THEREETM BE IT RESOLVED, that the Mayor and Trustees of the Village of
Rye Brook extend to the makers of the Harry Howard Hook & radder Co. No. 1,
the gratitule and appreciation of all the residents of Rye Brook for 125
years of dedicated fire service, and -
BE IT FURTHER RESOLVED, that the Village of RyeBrook officials and citizens
honor the past and present volunteers by taking an active part in the
year long celebration of 125 years of excellent volunteer service.

RECREATION DEPARTMENT REPORT.
Tom Ilroncich, Director of Recreation and Parks, made the
following report on Recreation Programs.
Brochure. Mailed to residents November 30th/December 1st.
Programs include skiing, co-sponsored by Westchester Ski Teen,
starts December 11th thru March 17th, 1984. Ladies Aerobics,
Youth Basketball, Ice-skating, Karate and Special Events,
Holiday Sing-a-long and Snowman Building Contest.
Budget_. After much review of the inherited $252,000.00 budget
and projecting costs for the remaining 6! months of programs
and park expenditures, I have estimated enough funds are
available through the fiscal year. However, we have not gone
through a full year's experience and have added some new
programs, altered the structure of others, and have begun to
restore, replace and evaluate maintenance equipment; a true
factual budget cannot be identified until the Spring.
Programs. Fall programs have operated well. Soccer with over
200 participants was a special success, due to the restructure,
organization and instruction of skills and techniques provided
throughout the program. Severaladditionsto the soccer
program enhanced it's total quality.
For Kindergarten, 1st and 2nd grades, "HARVEY", our Bunny
mascot posed for team pictures and visited with the children.
Since District 85 school video program is not yet established,
-we were able to have a: member of the community donate his time
to videotape and edit the championship games to be shown at - ..
the awards presentation, on December 10th. However, monitors
are needed to complete this effort and we wish to use those
monitors that were supposed to be received from UA Columbia
to set up the studio at Rye.Ridge Shopping Center and others
sent to Ridge Street School, in order to show the tape.
Special guest Nyan Jong Abuto, 1983 Guiness Book of World
Records holder in juggling a soccer ball, appeared for a
demonstration of his skills. (85,295 consecutive touches!)
Holiday Sing-a-long.- George Trautwein, Musical Director for
Blind Brook High School has been contacted to request a portion
of the school choir lead this special community event with
holiday songs. Scheduled for December l8th, at Crawford Park.
Men's Softball. Contacted District k4 School Board to request
use of existing Adult Men's Softball field, since our
Department is faced with inheriting approximately 12 teams
that were previously permitted to play in Port Chester's
Recreation League. Rye Brook Recreation does not have an
adult men's field, both Pine Ridge and Garibaldi fields' dimensions
are inadequate for adult play. Crawford's ball field, a town
park shared with Port Chester Rec, is used two weekdays and
weekends for youth play and Ridge Street School's one softball
field is also used for youth play seven days per week.
It is estimated to accommodate 12 adult teams, a field .is
necessary to schedule 140 games between April and September,
1984. Without the use of a field, Rye Brook men may be without
a league this summer.
Seniors. 22 Rye Brook residents participate in the Port Chester
Recreation Senior Citizen program, which meets at the Port
Chester YMCA, three weekdays between 10 AM and 2 PM. The
development of aRye Brook Senior Citizen Recreation program is
presently being _explored.
Trustee Harris asked Tom Hroncich if records for each program
are being kept - Tom responded "absolutely",
Trustee Meiskin said he is disturbed that there is a possibility
that the Softball League will not function. . What about
varsity baseball fields? Games start mid April and run through
mid September.
Tom received 176 names from Port Chester Rec. Dept.
Trustee Meiskin suggested possible use of subdivided lands
not yet being developed. Trustee Nardi asked if the playing
fields belonged to the school districts. - yes.
Tom lironcich said we would need one field, seven days a week,
and perhaps since Port Chester has 12 fewer teams now, Rye
--- Brook should be able to be accommodated.
-- Resident Ken Heller ofLincolnsaid the District 4 School Board
-- met last night and discussed it. The soccer program uses the
Junior High fields - could possibly construct a diamond which
does not exist. Mayor Kabcenell said it was our intention to
use existing facilities. Trustee Meiskin suggested that we
discuss the matter with the District 4 School Board, and the
Mayor agreed.
BUS SERVTCE - ROYAL EXECUTIVE PARK.
The Mayor said that we had a request from some people who were
working for MCI that they were forced to walk on King Street
from Anderson Bill Road and in bad weather it could be quite
dangerous since there are no sidewalks. We had written to the
Department of Transportation and received a letter from Com-
missioner R. Raleigh D'Adamo dated October 31st that they will
be able to provide bus service by slightly rerouting. and existing
bus route N 1.2 to pass the facility at 6. 25 am and at about
5.10 jam. The Mayor said that we did respond to the needs of
people who work in the Village and Perhaps they will need to -
- - put on additional buses. Commissioner D'Adanm said it may become
necessary at some time in the future to operate directly on the
Royal Executive Park property, which would require their permission.
Joel Sachs, attorney for Royal Executive Park said that MCIhad
written to them asking them to allow the bus to go onto their
property to make a turn around and, and that REP is of course
disposed to look favorably on mass transportation, they did state
earlier they would encourage bus transportation, car pools and
metropools.
Trustee Harris said there apparently was opposition from REP
to bus turnarounds on the property - Mr. Sachs said it was only -
a question of liability. Mayor Kabcenell said it becomes
increasingly obvious. that cooperation between the Village, .
County and the corporations will be very necessary. George
Morrow, Special Assistant to the Mayor, said that Mr. Patafio of
REP said that while this was a help to have the bus pass the
property, it would not solve the problem entirely, since the
occupants of Building 2 leave at 5. 30, and Trustee Zak said that
the Telephone Co. leaves at 4.30.
TRAFFIC COMMISSION REPORT.
Mayor Kabcenell read the following report - dated November 19th
Since our last report, the Rye Brook Traffic Commission has acted on a num-
ber of items, as follows;
1. Met Jointly with the Rye Brook Recreation Commission to for-
mulate parking alternatives in and around the Posillipo Center.
2; Made recommendatlons.to.the Village Board In the Brook Lane/
Sunset Road area, In response to residents complaints.
3. Made recommendations to the Village Board regarding the in-
tersection of Talcott Road and Mohegan Lane, to improve
safety for a homeowner and the general public.
4. Recommended 'No Parking/No Standing' at the end of Wilton _
Road near Crawford Park to reduce gathering of people and
harrassment of homeowners on the dead end.
S. Made recommendations on 'No Parking/No Standing' on
Bowman Avenue and Osborne Place, in an effort to relieve
congestion and Inconvenience to people in the area.
Still pending in our file are the following:
1. Research and make recommendations on turning movement into
the Bowman Avenue Shopping Center.'
2. Request by a resident regarding hazard at Winding Wood Road
and North Ridge Street mail box.
3. Research and make recommendations on pedestrian safety at
Westchester and Lincoln Avenue as per resident request.
4. Look into requesting the New York State Department of
Transportation to re-sign the Hutchinson River Parkway to make more
efficient use of the entrances to the parkway.
5. We are planning to divide the commission into teams to do
a detailed study of the vehicle and traffic code in the
Village of Rye Brook, and, along with recommendations from
our Police Department and Village Attorney, report back to
the Board.
6. Awaiting final recommendations from the County on the Rye Ridge
Shopping Center.
-. 7. We are awaiting responses from the New York State Department
of Transportation on requests for:
a. Uniform speed limit on Westchester Avenue from
the Rye Brook/Harrison border to the Rye Brook/ -
Port Chester border.
b, Installation of sun shields on Westchester Avenue
traffic lights.
c. Upgrade maintenance status of light on Westchester
Avenue and Ridge Street.
d. A study on computerized timing of four traffic lights
on Westchester Avenue from the Rye Town Hilton/
General Foods to Webb Avenue in Harrison.

IVe are grateful for the tremendous amount of work done by
Joe Pellino and the members of the Traffic Commission.
Bowman/Ridge Intersection - this has been a topic of study
and discussion for ton years or more, and in order to get us
off their back because we have not, let them rest, we finally
have a recommendation.
1) to widen approximately 200 feet on Bowman Avenue, southwest
of Ridge Street, for a right turn lane, and
2) realign the South Ridge entrance to the Shopping Center -the aim is to get the owners to do something. -The County feels that they will be able toprovidethe money
for the widening of Bowman Avenue even though it was not in
their plans for 1984,. they feel they can do it. The owners
of the Shopping Center indicated a desire to upgrade.
On signalization at Franklin Avenue and Bowman Avenue, the
County felt the Village should pay for the one at Bowman, but
-- some of you may remember, we had an offer of $35,000 from the
developer of 2B7/Bowman Plaza to pay for it, to start in 1984
and be completed in 1985. The county will pay for the one
at Franklin Street.

Dave O'Brien raised the problem of speeding on Lincoln Avenue
and Jennifer Lane area and the dangerous situation existing
when someone wants to make a left turn into Jennifer because
of a view problem. 'rhe Mayor said this question had been
addressed and we should see some changes -inthe next few weeks.
Mr. Tanzillo asked if we could have the light sequence at
Westchester and Lincoln adjusted, since people speed in order to
make the light. The Mayor said we have already asked the
State to consider that, and hope that they will be responsive.
Resident Joe Zaccagnino said he thinks the No 'turn on Red sign
at Betsy Brown is too far from the corner - people don' t see it.
Water Utilization Council.
On October 26, 1983 Mayor Kabceuel.l addressed a letter to the
Chief Executive Officer of the Town of Greenwich, City of Rye
and Village. o£ Port Chester, in which he proposed a Water
Utilization Council to establish procedures so that all four
communities could act in unison in determining a water shortage
and 'in response to such a shortage. The other communities
responded positively, and a meeting has been scheduled for
Friday December 9, 1983. This initial meeting will bring
together representatives of the four communities to implement
the formation of the councilandestablish guidelines under
which it will operate.
Joe Pellino asked if the Mayor knew whether there is any
plan by Port Chester Water Works or Greenwich to increase
their reservoir capacity in light of drought conditions.
The Mayor did not think so. We are now getting one million
---- gallons per day from Westchester Joint Water Works, and will
soon be getting two million.
BOARDING HOUSES AND LODGING HOUSES.
The Mayor said he had asked the Village Attorney to check
the present Town of Rye Code and that of neighboring
communities.
Ms. Kramer reported that 2 boarders are permitted anywhere
in the Village, and that in addition in 2-Family Zones,
rooming houses are permitted, which means that up to 10 persons
who pay are permitted to reside in them. The Board has to
determine whether we should have perhaps more than two boarders
in some areas. I believe that rooming houses, where there
might be a problem with parking, should be a discretionary use.
We also might consider reducing the number of persons allowed
in a rooming house, also set guidelines for parking, and even
noise. We should also consider a stiff fine for violations,
rather than a misdemeanor charge, since the penalty is too
much for the offense and judges are unwilling to sentence.
The new State Fire Code could make things more restrictive.
-- The type of building determines the fire exits.
Mayor Kabcenell asked Building Inspector Fidelibus to look
- into the new New York State code, there are a lot of areas
where the Village will have to adapt.
Trustee Meiskin said it is typical to have rooming houses
in 2-Family zones. 'Trustee Nardi asked if there are any
rooming houses in Rye Brook, Ms. Kramer said there were.
Mr. Fidelibus said they have not been brought to the attention
of the Building Department or the Village, and there are no
provisions in our code regarding licensing. -
Mayor Kabcenell thought it should not be a matter of right
but should be licensed. Ile asked Ms. Kramer if we can enact
coding in terms of health and fire in excess of what now
exists. There was agreement by the Board that something be
done in this area - in review —there should be no rooming
houses, or they must be licensed, number of boarders, and
if we do, then a violations shall not be a misdemeanor, at
least not the first one - rather a fine.
Resident Nancy Horton suggested grandfathering to require
licensing and registration of existing ones, even if we
don't permit any more.
HIGHWAY DEPARTMENT. Don Brown reported that we are behind in
lea pie up ecause of weather, the leaves haven't been falling,
andsewerbreaks, which is inconvenient, but we now have 12
men working on it. 'Trustee Nardi said that perhaps the news-
paper could publicize. this.
We have had discussions relating to problems of all-night parking
and have referred the matter to the 'traffic Commission.
Joe Pellino said that at the last meeting we said we would like
to have an explanation of the No Parking Ordinance possibly in
the next Rye Brook Newsletter - Frank Sinicola was working on
a draft to review with Bob Santoro of the Police Department.
61-18 ordinance says they must comply with signs so posted.
61-22 clearly covers snow removal and plowing.
The Mayor would like to be able to deal with snow removal

without making itaninconvenience all year for the three
streets which are a hardship as far as parking is concerned.
Ms. Kramer said that new legislation makes it possible for
a -Village to -declare a snow emergency.
Don Brown suggested leaving it alone this year and come up
with a new solution for next year.
At the last meeting there were recommendations from the - -
Traffic Commission that some changes to take care of the problems '
around the areas related to the Osborne Place/Bowman Avenue
triangle. The presentation by the Traffic Department deals
with changing some of the signs on Bowman Avenue on the north
side of the street to read No Parking - No Standing, and
another one further west, between Osborn Place and Ridge Street
to implement the passage of traffic in the westbound lane.
Concurrent with this is a recommendation to have No Parking on
Osborne Place on the east side. We would need a Public Hearing
to deal with these changes.
SENIOR CITIZEN TAX ABATEMENT.
The State increased the limits to $13,500, but also reduced
abatement over $10,500, including Social Security and retir ement.
Trustee Harris stated that there were34 taxpayers in Rye Brook
who claimed the exemption, now there probably will be more
Mayor Kabcenell suggested that we make a proposal to conform
with the new law, for the next Board Meeting.
GARBAGE COLLECTION. -
Mayor Kabcenell stated we are going to revise our bidding

On the motion of Trustee Nardi seconded by Trustee Meiskin,
WHEREAS the Village Verk advertised for bids for Garbage and
Refuse Collection for 1984 on October 27th 1983, and
WHEREAS, one bid was received and opened on November 7, 1983,
and
WHEREAS the bid received was significantly different from
the bid specifications in that it was a lump sum price for
3 years although the Bid specification specified a one year
bid renewable at the-option of the Village Board for four
additional years.
NOW THEREFORE BE IT RESOLVED that the bid received from
Carlucci Sanitation on November 7th 1983 be rejected, and
BE IT FURTHER RESOLVED that the Village Clerk be authorized
to advertise for bids for Garbage and Refuse Collection to
be received and opened at the Agenda Meeting to be held on
December 13 1983 atPosillipo Center at 8 PM.

contract could be - the Mayor responded 5 years.

SNOW REMOVAL. - County and State.
On the motion of Trustee. Zak, seconded by. Trustee Harris,
WHEREAS the County desires to obtain services for the removal of
snow and ice from designated County roads within the Municipality
to provide for reasonable passage and movement of vehicles
over such roads, and
Whereas the Municipality is willing to furnish such services -
and the County desires to purchase same subject to the terms
of the attached agreement,
NOW THEREFORE BE IT RESOLVED that the Mayor be authorized
to enter into an agreement with the County of Westchester
for snow removal from the 4.55 miles of County roads within
the Village of Rye Brook based on the rate structure passed
by the Board of Legislators on November 3, 1983.

designated State highways within the County in order to provide
reasonable passage and movement of vehicles over such highways,

WHEREAS, the County, in accordance with the provisions of said
contract, is desirous of entering into a subcontract with the
Municipality for the removal of snow and ice from designated
State highways within the Municipality.
NOW THEREFORE BE IT RESOLVED that the .Mayor be authorized

WHEREAS, the Devel-oper has made application to the
Village of Rye Brook for approval of proposed development,
and,
WHEREAS, the Village desires to engage an independent
consultant to review the Ilnv(ronmentai Impact Statement
provided by the Developer, and
WHEREAS, it is permitted for the Village to require
the Developer to pay for the independent review of the
Environmental Impact Statement,
On the motion of Trustee Harris, seconded by Trustee

NOW THEREFORE BE IT RIiSOLVI:D, that the Village of Rye
Brook will engage Frederick 11. Clark Associates as
consultant to review Environmental Impact Statements
offered by the Developer and that the Developer shall
pay all costs OC the review, and
BE IT FURTHER RESOLVED, that an initial payment of
$10,000 each shall be required from Royal Executive Park

OPPOSITION TO INCREASED JET AIRLINE TRAFFIC.
On the motion of Trustee Meiskin, seconded by Trustee Nardi,
WHEREAS United Airlines has announced their intention to '
commence flights from Westchcstor County Airport, and
WHEREAS the County Board of Legislators must approve the
application of United Airlines, and
WHEREAS, the addition of airlines and/or flights would be
detrimental to the welfare of the residents of Rye Brook,
THEREFORE 13E IT RESOLVED that the Village Board is firmly
opposed to the increase in scheduled jet aircraft
activities at Westchester County Airport, and
BE IT FARTHER RESOLVED that by copy of this resolution, the
Board's opposition and concern regarding the recent request of
United Airlines to operate in and out of Westchester County
Airport be expressed to the County Board of Legislators.

It was explained that United does not now fly out of or into
Westchester - these would be additional flights by another
airline. Trustee Meiskin explained that United had applied
to use the airport for 737's and Jetamcrica had applied for
UC 9's, and were turned down by the airport management
on the basis that the main runway could not handle the weight
and that ramp facilities were inadequate. Then United
Airlines announced that they were coming in with 727',.
The County Executive and County Board are appalled that they
were never consulted and United airlines say they have a
right to come in, and hope they will get permission. Rye
Brook should insist that the County Board deny the request.
Trustee Ploiskin said the main question is who owns the airport.
the FAA stated that the County took money in the form of grants
from the Government and that makes it an open airport.
Harrison and North Castle passed similar resolutions, Port
Chester will, and Armonk, Chappaqua, Greenwich have all been
alerted. It has not been before the County and we should send
copies of our resolution to Congressman Ottinger and County
Legislator Pierre to get them involved.
