MINUTES OF REGULAR MEETING HELD BY THE VILLAGE BOARD O]V OCTOBER 15,1985
at the Village Office, 111 South Ridge Street, Rye Brook, at 8_00 p.m.
PRESENT: Mayor Kabcenell, Trustees Cresenzi, Meiskin, Nardi, Zak
Attorney Kramer
ABSENT: Treasurer Cortese, Clerk Smith
PUBLIC HEARINGS
FRANEL MANAGEMENT CORP. - continuation
Mayor Kabcenell advised those in attendance that this matter is really
a two-fold issue.
Franel Management Corp. original proposal for a deep lot subdivision
will require a change in the Zoning Law and therefore cannot be dealt
with by the Village Board until such time as the change is effected.
The report of Frederick P. Clark Associates recommends that
applications such as this be handled by the Board of Trustees on a
Special Permit, case by case basis so as to ensure safe and convenient
access, as well as reasonable degree of privacy. (Copy of report is
annexed hereto. )
After discussion, it was the sense of the Board of Trustees that this
proposal (or similar proposals made in the future) would require a
change in the Zoning Law.
On the motion of Trustee Zak, seconded by Trustee Nardi,
RESOLVED that the application for subdivision by Franel Management
Corp. of property on upper King Street be DENIED.
The vote on the motion was as follows:

The second aspect of this issue is the Zoning Law itself. After
discussion, it was the sense of the Board of Trustees that a Public
Hearing be held to consider a proposed change in the Zoning Law.
On the motion of Trustee Meiskin, seconded by Trustee Nardi.,
BE IT RESOLVED that the required Legal Notice be prepared and
advertised and the Village Attorney prepare the proposed change to the

Zoning Law, and
BE IT FURTHER RESOLVED that a Public Hearing be held at the next
Regular Meeting of the Board of Trustees on Tuesday, November 26, 1985
at 8:00 P.M.

NO RIGHT TURN FROM 287 BOWMAN PLAZA
Mayor Kabcenell read the Legal Notice published on October 9, 1985, and
advised those in attendance that all necessary signs will be posted in
connection with the Local Law amendment to the Vehicle and Traffic Law
prohibiting a right turn from 287 Bowman Plaza.
On the motion of Trustee Meiskin, seconded by Trustee Zak,
RESOLVED that the Vehicle and Traffic Law be amended to read that IT
SHA!L BE ILLEGAL TO MAKE A RIGHT TURN ONTO BOWMAN AVENUE FROM 287
BOWMAN PLAZA DURING THE HOURS OF 4:00 P.M. TO 6:00 P.M. MONDAY THROUGH
FRIDAY.

ALL NIGHT PARKING
Mayor Kabcenell read the Legal Notice published on October 9, 1985, and
advised that the audience that necessary signs will be posted in
connection the the Local law amendment to the Vehicle and Traffic Law
allowing all night parking in some areas of the Village of Rye Brook.
Discussion from the floor covered such matters as educa�ion of the
public as to which streets could be parked on, discrepancy of signs
within the Village of Rye Brook (some indicating that no all night
parking is allowed in the Village) .
Mayor Kabcenell stated that the safety of the Village and it's
residents is paramount and that streets must be cleared of snow for the
protection of everyone.
It was decided that a general mailing would go out to residen':s of the
Village advising which streets could be used for all night parking and

which could not. The police may also give out flyers to residents of
the area affected.
On the motion of Trustee Zak, seconded by Trustee Cresenzi,
BE IT ENACTED that Section 18 of Local Law 7-84 called Vehicle and
Traffic be repealed.
BE IT ENACTED by the Board of Trustees of the Village of Rye Brook that
the following Law be known as Section 18 of the Vehicle and Traffic Law
"All Night Parking":
A. The parking of any vehicle is hereby prohibited on all public
streets or highways within the Village of Rye Brook, between 2:00
a.m. and 6:00 a.m. , from November 15 to March 15, except that all
night alternate side of the street parking be permitted on the
following streets and highways:
Grant Street
Garibaldi Place
Wyman Street
Wyman Street North
Roanoke Avenue
Highview Avenue
Dixon Street
Westview Avenue
Crescent Place
Ellendale Avenue
Franklin Street
Barber Place
Lyon Street
Hillcrest Avenue
Whittemore Place
Woodland Avenue
Irenhyl Avenue
Hawthorne Avenue
Maywood Avenue
Alternate side of the street all-night parking shall be construed
to mean Monday, Wednesday, Friday and Sunday on the north or east
side of the street or highway, between 2:00 a.m. and 6:00 a.m. ; and
Tuesday, Thursday and Saturday on the south or west side of the
street or highway, between 2:00 a.m. and 6:00 a.m. , in accordance
with signs so posted in the affected areas.
Additionally, all night parking shall be permitted on the south,
west or east side of the following streets and highways between
2:00 a.m. and 6:00 a.m. , from November 15 to March 15:
west William Street - South Side
Division Street - East Side
West Street - West Side
Osborne Place - West Side

B. No trucks or other commercial vehicles shall park on any public
street or highway within the Village of Rye Brook between the hours
of 2:00 a.m. and 6:00 a.m. throughout the entire year.

DISCUSSION AND REPORTS:
CON EDISON - STREET LIGHTS RYE HILLS AREA
George Morrow, Special Assistant to the Mayor, advised that the Village
is still awaiting the promised report from Con Edison. The Village
itself has ordered some street light fixtures with delivery as soon as
possible. The Village of Rye Brook will erect the fixtures themselves.
However, Con Ed must then inspect them and energize the fixtures. Con
Ed has advised that these fixtures may not necessarily be placed in the
proper area and, as a result, may have to be moved. However, the
situation is critical in the Rye Hills area and something must be done.
ENTRANCE ROAD TO RYE HILLS PARK
This is a "land locked" park with no vehicular access at all. Over a
period of time the park has been vandalized seriously,. including bikers
riding through and destroying property. The Police Department is
unable to patrol the area A great deal of time and money has been
invested in restoring the park and to protect this investment (and any
future investments) an entrance road to Rye Hills Park is essential.
Mayor Kabcenell has written to the Town of Rye Supervisor requesting a
meeting to discuss a road from Crawford Park to Rye Hills Park, but to
date, this has not taken place.
CRAWFORD PARK
Complaints were registered by some people in attendance, as yell as
some of the Trustees, concerning the safety bumps now in place in
Crawford Park. Damage to private vehicles, as well as Police cars will
be considerable and plowing and sanding during the winter months will
be more than difficult.
RESOLUTIONS:
NO LEFT TURN ONTO RIDGE STREET FROM RYE RIDGE SHOPPING CENTER
On the motion of Trustee Nardi, seconded by Trustee Zak,
WHEREAS the Village has prohibited left turn (Local Law 11-85) from the
Ridge Street exits of Rye Ridge Shopping Center, and

WHEREAS the Rye Ridge Shopping Center requests additional time beyond
the October 15th effective date of the Local Law to realign the traffic
movement within and exiting from the Shopping Center.
THEREFORE BE IT RESOLVED that the effective date of Local Law 11-85,
passed August 27, 1985, be postponed to November 1, 1981.).

APPOINTMENT OF ASSISTANT BUILDING INSPECTOR
On the motion of Trustee Nardi, seconded by Trustee Cresenzi,
WHEREAS the 1985/85 Budget provides for an Assistant Building
Inspector, and
WHEREAS this position has been publicly advertised and the Civil.
Service List has been canvassed.
THEREFORE BE IT RESOLVED that Mark tenEicken, 5 South Lawn Avenue,
Elmsford, New York be employed as an Assistant- Building, Inspectnr
effective October 15, 1985, at a salary of 826,000 per year.

AWARD OF BIDS
This matter was deferred to a later date pending further study of the
lease on the office space at 90 South Ridge Street.
BOND RESOLUTION
This matter was not acted upon and deferred to a later date pending
further study of the lease on the new office space.
APPOINTMENT OF JUSTICES
This matter was deferred until the issues can be resolved.
The next Regular Meeting of the Board will be held on Tuesday, November
26, 1985, at 8:00 p.m.
The meeting was adjourned at 9:15 p.m.
