MINUTES OF REGULAR BOARD MEETING HELD ON MAY 22nd 1984 AT THE
VILLAGE OFFICE, 111 SOUTH RIDGE STREET AT B.P.M.

Mayor Kabcenell reported that Trustee Zak bad been ill, but was recovering
and looking forward to being back for the next meeting. `
FIRE CONTRACT – PUBLIC HEARING. -
Mayor Kabcenell stated that the Public Hearing has been appropriately
announced to approve the Fire Contract between Rye Brook and the Village
of Port Chester and give the Mayor authorisation to sign the contract.
Approval was given some two months ago, however, the payments that we thought
had been agreed to, apparently were not agreed to and there has been a
revamping of the payment schedule by the Village of Port Chester, and they
have passed this. We had discussed dividing the 26–month period into two
13–month years, but Port Chester took 14 months in the first year and 12
months in the second year. The payments have also been divided into thirds
instead of in halves. All of the stipulations of the prior contract are
' still valid, the only correction will be the payment schedule, which will
now be as follows:

LOCAL LAW No. 2-1984. TAX EXEMPTION AND REDUCTION LAW – PUBLIC HEARING.
On the motion of Trustee Nardi, seconded by Trustee Harris, -
BE IT ENACTED, by the Village Board of the Village of Rye Brook as
follows:
1. Legislative Intent: The purpose of this Local Law is to provide
for the reduction of the percentum of the real property tax exemption
provided for in Section 4856, Subdivision 2(a) of the Real Property
Tax Law.

2. Short title: This Local Law shall hereafter be known and cited
as "Tax Exemption Reduction Law."
3. Definitions: As used in this Local Law, unless otherwise ex—
pressly stated, the definitions shall be the same as those applied in
Section 485E of the Real Property Tax Law.
4. The Real Property Tax Exemption percentage as set forth in Sub—
division 2a of Section 485B of the Real Property Tax Law be and the
same is hereby reduced to zero (0%) percentage.
5. This Local Law continues the Tax Exemption which applied to the
Village of Rye Brook by virtue of its existence in the Town of Rye as
the date of incorporation of the Village of Rye Brook.
6. This Local Law shall take effect immediately.
Mayor Kabcenell explained that absent this action, he cannot recall
how many how many corporations have applied for tax abatement, because
the Rye Town ordinance will run out, this then will continue the -
circumstances as before.
Mrs. Harriet Halsey commended the Mayor and the Board for having taken
this action in order to protect us.

COMMUNICATIONS.
Mayor Kabcenell read a request from Mrs. William Groglio requesting ,'.._...
permission to serve alcoholic beverages at a party to be held at AJP Center »f
on Garibaldi Place on August 12th 1984.
Trustee Harris questioned the necessity for the Board to act on each
separate application. Attorney Kramer said that AJP is a public place
and drinking in public is prohibited, and each application must come before
the Board.
Mayor Kabcenell suggested that we might enact legislation that it be an
executive decision. We should consider when we finalize the code.
On the motion of Trustee Meiskin, seconded by Trustee Nardi,
BE IT RESOLVED that Mrs. William Groglio of 5 Paddock Road, Rye Brook,
Rye Brook, be granted permission to serve alcoholic beverages at a private
party to be held on Sunday, August 12th, 1984 at Posillipo Center on
Garibaldi Place, Rye Brook.

Mayor Kabcenell read a letter dated May 18th 1984 from Camillo Pagano,
of 1 Betsy Brown Road, Port Chester expressing his opinion that the
request for permission to build cluster housing on the Hansen property on
Betsy Brown Road should he denied.
Mayor Kabcenell explained that the application in question was referred,
at our last meeting, to our consultants, because there is a great deal of
complexity in it. There are two zones in it, and some approvals were made
for the lots along Betsy Brown Road prior to the present zoning ordinance.

Therefore we referred it as a preliminary matter to our consultants to
provide us with factual information.
When Environmental Assessment Forms have been submitted - it is not a request
for rezoning - it will be referred to the Planning Board, they will hold
meetings and discussions. The subdivision approval must come from the
Village Board, not the Planning Board. Their recommendations will be
referred to the Village Board, at which time there will be a Public Hearing,
announced in the newspaper, and with notice to adjacent residents. For
some strange reason, there has been a lot of assumption that this was going
to be approved without due process.
This is a request for subdivision approval, but should it be determined
that it is a request for rezoning, it will have to go through the process
of rezoning, but none of that information is available yet, because we have
just turned it over to our consultants.
We encourage everyone to come here and make their presentations, and share
their feelings.
The Mayor added that a municipality can require cluster development,
with the requirement that the density conform to the density for single
family homes.
SUBDIVISION APPLICATIONS.
Two-lot subdivision, Lincoln Avenue & Westerleigh Road.
E.V. Iorio Construction Corporation.
Attorney Kramer disclosed that her law firm represents this applicant,
although not in this application, and opted out of this discussion.
George Morrow explained that this will require anEAF, although the
form will not have a great impact, and it would be proper to refer
the application tothe Planning Board.
Mayor Kabcenell said that we will require a formal application and
commented that the letter did not come from the owner, and a
subdivision application must come from the owner or a designee of the owner.
George Morrow said that the Town had always accepted subdivision
applications in letter form, but this Board has indicated that it would
like an application form, and we are designing a form that will have all
this additional information on it: "Alli '
The Mayor said he would accept that, but that the statute requires the
owner or a designee to make the application. Mr. Morrow said he would
arrange for this.
The above discussion covered the following applications:
Richard & Linda Varadian subdivision application, Woodland Drive,
Rye Brook for two lots.
Charlotte S. Belove, two lot subdivision application, at
20 Lincoln Avenue Rye Brook.

APPLICATIONS FOR SITE PLAN APPROVAL.
I. St. Paul Lutheran Church
2. United Cerebral Palsy Association
3. Royal Executive Park
4. Rye Brook Office Park
The statute requires that these all be referred to the Planning
Board for recommendation, and then back to the Village Board
for action.
Mayor Kabcenell said the EIS is not fully resolved in connection with
Royal Executive Park and Rye Brook Office Park, and we were supposed to
have had the information last Friday, and Attorney Kramer thought we
should ask the developers to hold these applications till the next
meeting. There was a time limit of 45 days from the close
of the Public Hearing, and Mayor Kabcenell said he would be agreeable
to extend the time, if they need it.
On the motion of Trustee Meiskin, seconded by Trustee Nardi,
BE IT RESOLVED that applications for Site Plan approval submitted
by St. Paul Lutheran Church and United Cerebral Palsy Association
be referred to the Planning Board for their recommendations.

TOWN OF RYE - MTA TAXES.
Trustee Meiskin reported on a Rye Town Council which he attended on Monday.
The newspapers this past week related to two news stories - Uncollected
taxes on the Capital Theatre and Uncollected taxes on the MTA.
The history of MTA taxes started in 1972 and continued to 1982.
During this period, the Town paid Port Chester village and school
district taxes levied on the MTA but which were never collected.
The courts of New York in 1982'ruled that these taxes are uncollectible
and in fact there is on file a notice dated in the mid-1970-s from the
State of New York stating that the'MTA taxes should not continue to be
levied. Town officials disregarded this information and continued
to "guarantee" and pay Port Chester these tax monies even though
these monies were never collected from the MTA. -
The burden of these-tax monies over the last ten years fell on Rye Neck
and the now Village of Rye Brook. This total amount is close to $900,000,
with interest computed. That is $440,000 in School taxes, and $220,000
in Village taxes, a total of $660,000 without any interest computed
for the last ten years.
Supervisor Don Gioffre now proposes a solution, on repayment of the
monies by using Federal Revenue Sharing funds to pay the above debt
of Port Chester. It is ethically correct that he seeks the return
of these monies to all the residents of the Town of Rye, but it is
highly questionable that the debts of Port Chester be paid for on
the backs of Rye Neck and Rye Brook taxpayers. This means that taxpayers
of Rye Neck and Rye Brook who since 1972 paid extra money to provide for
expenses of Port Chester village and school district.
Now these same people are being asked to pay extra taxes so that
Federal Revenue Sharing funds for the next four or five years, be
allocated to Port Chester. There is some question regarding the
legality of allocating Revenue Sharing funds in this matter.
The procedures for allocating these monies provide for an annual Public
Hearing and an annual vote by the elected officials of the Town.
the officials who would be acting now might not be the same ones who
would act one, two or four years from now. Annual is the key word,
since this proposal would try to eliminate this process, which is in fact,
a part of the Law of Federal Revenue Sharing that it be acted upon each
year.

It also seems that Supervisor Gioffre should be representing the
interests of all residents equally, and in an even—handed manner.
This proposal speaks of the prior history of the use of these monies
and Mr. Gioffre, as Councilman for a number of years voted for the past
distribution of these monies as being equitable, since Port Chester
received other equalizing monies and programs..
It must also be pointed out that as part of the discussion, Supervisor
Gioffre said he would attempt to have some balance in addressing this
question and try to do something so that the Federal Revenue Sharing
monies would not all go to Port Chester, but could be used to somewhat
alleviate the taxayers of Rye Brook and Rye Neck, but he alluded to this,
did not spell it out.
Another newspaper in a related story reported on the back taxes of the
Capitol Theatre. These back taxes are in the range of tens of thousands
of dollars; one resident present said it approaches the range of $100,000.
It also reported on non—payment of additional property taxes in Port
Chester. However, Port Chester received all of this tax money in full,
as guaranteed by the Town of Rye. Other taxpayers in other areas of the
community have to make up for this shortfall.
Again, the taxpayers and residents of Rye Neck and Rye Brook are forced
to pay additional taxes to support Port Chester's expenses of government,
and this guarantee.
This practice, the Guarantee of Taxes is a burden on Rye Neck and Rye
Brook residents and should in equity be removed. The guarantee of Port -
Chester tax money should be borne only by Port Chester, no others!
The Supervisor did allude Last night that the Town Council would seek to
create a Special Taxing District which would include only Port Chester
to try to pay this back.
Finally we question the use of Pedereal Revenue Sharing funds being used
to pay the debts of Port Chester without an annual hearing and vote.
We also urge that the guarantee of taxes be eliminated.
Attorney Kramer explained that the guarantee of taxes is discretionary.
Trustee Nardi wanted it made clear that this is at the option of the Town
and that they do not guarantee any of the taxes of the Village of Rye
Brook or any of Rye Neck's taxes.
Trustee Harris said the original news release on May 18th talked about
atentative settlement of litigation. Trustee Meiskin said that last night
the Supervisor was authorised to continue negotiations and reach an
agreement with the officials of the Village of Port Chester and approve
it. The request was made that since this affects the Village of Rye
Brook and the Village of Mamaroneck, they should be represented because
they are affected by what occurs in this agreement.
It was made clear that the negotiations are for return of principal
only, without computation of interest. Attorney Kramer said that Tax
Anticipation Notes were taken out so that interest must have been paid
by the Town of Rye for the last 12 years.
Mrs. Halsey said that another alternative the Town Board is considering
is to divide the Federal Revenue Sharing proportionately, and use only
Port Chester's share towards repayment, so that Rye Brook would not be
affected.
Mayor Kabcenell pointed out that Federal Revenue Sharing is included in
the Budget and if that money is used to reduce Port Chester's debts, we
will have to raise that amount in taxes.
Trustee Harris said we are entitled to be represented by the Town
Supervisor and we should make our wishes known.
Resident Gene Strum said we should ask for a Town Audit annually so that
we know this matter is being cleared up. Mayor Kabcenell said he was not
impressed with the last audit. They just pointed things out and walked
away from it.
Attorney Kramer said she was concerned about possible loss of future
Federal Revenue Sharing because there are certain regulations which call
for Public Hearings and public involvement in decision making as to how
FRS funds are spent, and if this process is not going to take place
on a year to year basis, and if the Town is not going to follow
the requirements of the revenue sharing laws, she is concerned whether
the proper declarations can be made to the Federal Government in order
to receive that money, and concerned about obligating it well into the
future.
Mayor Kabcenell said that if that is the nature of the agreement,
then it would seem to be illegal. It might be appropriate for us to
---- suggest to the Town that we would like to participate in the
deliberations. Perhaps we should send them a letter expressing our '
various concerns.
Trustee Nardi recommended that we contact the Village of Mamaroneck and
ask them to act in concert with us in this matter.
REPORT OF VILLAGE ATTORNEY - PARKING VIOLATIONS OF PRIVATE PROPERTY
Mayor Kabcenell said we have received a number of requests to
provide for issuing summonses an parking violators on private property.
We asked the Attorney to explore the statute and the law, with input from
the Police Chief.
Attorney Kramer said the Village has a right to pass a local law
pursuant to its police powers to regulate parking and traffic on private
property. It does not have that same right with respect to school
property, the school district has the authority to pass Legislation
concerning parking and traffic. If we act according to a local law
for private property for shopping centers and office complexes, it becomes
a village-wide charge, and it would be the obligation of the Village
pursuant to its police power to pay for the signs, and pay for the
necessary enforcement of those regulations.
Trustee Meiskin said parking areas in shopping malls which are declared
as fire lanes or handicapped places, the owner of the property is
obligated to put the signs up and we can then go in and enforce it.
Ms. Kramer said the shopping centers and handicapped are special statutes.
Arbors and Rye Ridge Condominiums and office parks are not covered by
these statutes and in order to enforce our parking or traffic ordinances
there, it would be by village-wide police power and therefore we would
have to pay for the signs in -those areas. The Board has to make a
determination as to whether it would want to pass traffic and parking
regulations concerning these private areas, if so, whether we want to
limit that to handicapped and fire lanes, rather than a broader type
of legislation which would require police cooperation in enforcing.
Mayor Kabcenell asked Ms. Kramer what obligation the Village might have
if someone parked in a fire lane, and we did not see them?
If a Rye Brook police officer issued a ticket, would he have to appear
in court if the ticket were contested?
Ms. Kramer said we have the wherewithal to pass an ordinance dealing with
these private properties, but the Chief and I both recommend that we not
include their ten-minute parking regulations, but in the interest of public
safety, we do enforce the fire lane.
Mayor Kabcenell said he had asked the Fire Chief to designate fire lanes,
but as yet has no information. We can then ask the individual areas to
mark the designated areas, and we can then enact NO PARKING legislation
for those areas.
PUBLIC HEARINGS.
VILLAGE CODE. The statute stipulates that the Village assume the Town Code
for a period of two years after incorporation, and since it is almost two
years and we are in the midst of re-codifying it, creating our own, for that
interval until our code is completed, we have to go through the
motions of adopting the existing code, or there will be no code.
I would therefore like to set a Public Hearing on the adoption of this
Village Code for June 26th, 1984.

The Town Code to be adopted would be as effective on the date of
our incorporation.
LOCAL LAW — VENDING AND PEDDLING.
This has been discussed at great length, but we must set a Public
Hearing in connection with adoption. This will also be on June
26th, 1984.
Trustee Meiskin announced that there would be a meeting of the
Airport Advisory Board on May 30th 1984 at the National Guard
Hanger, and the County Airport to talk about the future of the
airport. They are looking for public input, they will be talking
about resolving the lawsuit with Midway which wants to bring in
its own aircraft, and then right behind them you have American
Airlines, TWA etc. , about what's going to happen at the airport.
Noise complaints should be reported to 939 8484, Noise monitoring
equipment is going to be installed very soon.
Mayor Kabcenell announced that June 16th and 17th will be the second
birthday celebration for Rye Brook.
June 16th — there will be a five—mile run starting at General
Foods and ending at Crawford Park.
June 17th — 12 noon to 4 p.m. at Crawford Park, will be the party,
with fun and games for all!
RESOLUTIONS.
On the motion of Trustee Nardi, seconded by Trustee Meiskin,
RESOLVED that the Superintendent of Public Works, Donald Brown,
be authorized to attend the 1984 Highway School at Cornell University
on June 4, 5 & 6.

SEWER REHABILITATION CONTRACT.
On the motion of Trustee Meiskin, seconded by Trustee Harris,
RESOLVED that upon the recommendation of URS Company Inc. Consulting
Engineers, Halcyon Construction Corp. of Valhalla, New York, be
awarded the bid for Sewer System Rehabilitation in the amount of
$82,450.

The-Mayor explained that a lot of this deals with the establishment
. of a central garage and we will be providing fuel for our own vehicles
and we hope to pay considerably less than we have been paying.
Harriet Halsey asked about street light maintenance and recalled
that someone was paid to go around and check the lights. Mayor
Kabcenell said that had been changed and we are now getting the
reports from our own people.

WHEREAS the Developer has made preliminary application to the
Village of Rye Brook for approval of proposed development, and
WHEREAS the Village desires to engage an independent consultant
to review the proposed development,
On the motion of Trustee Meiskin, seconded byTrustee Nardi,
BE IT RESOLVED that the Village of Rye Brook will engage Frederick
P. Clark Associates as consultant to review the proposed development
of Betsy Brown Associates, and
BE IT FURTHER RESOLVED that an initial payment of $2,500 shall
be required from Betsy Brown Associates, payable to the Village
of Rye Brook. From said funds, which will be held in an escrow
- account, the Village will make payment to the independent consultant
to evaluate the proposal.

Mayor Kabcenell said there are some other appointments to be made
as soon as we are in touch with the people concerned.
Since this is a new position to Eleanor Brookfield, who is here
tonight, I want to express my gratitude for agreeing to serve
on the Recreation Commission. We guarantee that we will be happy
with the association and that she will be very happy with the
- - association.
Mrs. Harriet Halsey voiced concern in connection with traffic
in three areas.
Latonia Road when there are games, with parking on both sides of
the street, leaving room for only one way traffic, and potential
danger for emergency vehicles.
Westchester Avenue, General Foods Visitor entrance, with cars
coming out and malting a left turn towards White Plains, and
in doing so, crossing a double yellow line on a four—lane road.
South Ridge Street, driveway into Zinsner's office, dangerous
situation when cars are coming out of the driveway and cars making
a right turn on red from Westchester Avenue.
Mayor Kabcenell referred all three matters to Joe Pellino, of the
Traffic Commission, who was present.
Mr. & Mrs. Sands of 51 Talton Road, complained of children cutting
through their property to Crawford Park, and littering with beer
bottles and vodka bottles. Since the park is Town property, it
was suggested that they address their complaint to the Town Board.
Mrs. Halsey had one other complaint — she had a flyer asking
young people to apply for jobs delivering Pennysaver which was
attached to a telephone pole in her neighborhood, which is illegal.
Mayor Kabcenell said they would be advised that this was not
allowed.
Trustee Harris made a report in connection with water, and the
American Water Company request to have its customers pay for
lost water, and reported that the percentage granted was
considerly less than their request.
Trustee Meiskin reported that fines levied in the Town Court
for summonses issued in Rye Brook, were not coming back to Rye
Brook, but was being retained by the Town Court.

Attorney Kramer said that if we had our own Police Justice, the
Village would receive money, which amounted to $10-12,000 last
year.
Trustee Meiskin recommended that we study this, and get a report.
The Mayor set the Agenda Meeting for June 12th at 8 pm, and the
next Regular Meeting for June 26th, 1984 at 8 p.m., both at the _
Village Office.
Resident Gene Strum asked if the Mayor would have a financial
statement, and Mayor Kabcenell said he hoped to have one.
