Mayor kabce"ell opened the meeting with two items of uusi"eyy. The Tax Warrant is established consistent with the a^uset which has been approved. It authorises the Receiver of Taxes to ze,v ' collect and receive taxes on behalf of the Village of nye Brock. The total, in the Warrant is *3,440,767 and in audition there are maintenance changes assessed for. . . . ' - Joel Sachs - Attorney for REP stated that they had appeared 000595 before the Planning Board two days after we appeared before the Village Board which the Planning Board felt was short notice and they wanted some information from the Assessor's office about the tax impact of the subdivision and they also thought that i t was appropriate for this Board to have issued the Negative Declaration on the Environmental Impact before they made their recommendation. As a result it was Put over to the June meeting of the PB, and I got a letter from the Assessor, Ken White, that he has already divided the property into separate tax parcels which he did as a courtesy so that the June 1st deadline which I thought was important has been waived, because he is already treating it as three parcels, but he would like the subdivision formalised at some point. The Public Hearing could not be held until after receipt of the Planning Board recommendation, after their June 5th meeting, but I would like to have the hlegative Declaration on the Environmental Finding. This is simply a subdivision for financial p;urposes, and the declaration states that there will be no building and does not authorize any further development on the site. On the motion of Trustee Zak:, seconded by Trustee Meiskin, WHEREAS, the Village Board of the Village of Rye Brook has previously designated itself as lead agency for all future actions related to the development of Royal Executive Park located off upper King Street, north of Anderson Hill Road in the Village of Rye Brook; and WHEREAS, on April 23, 1986, Royal Executive Park II filed an application with the Village Board of the Village of Rye Brook for subdivision approval in order to subdivide its property within the Village of Rye Brook into two parcels, one parcel of approximately 18.2 acres of land presently under construction as a Corporate Office Park to be known as Royal Executive Park II and the remaining parcel of approximately 31 acres of vacant and undeveloped land to be known as Royal Executive Park III; and WHEREAS, the instant application for subdivision approval will allow Royal Executive Park II to refinance the Corporate office Park presently under construction and such subdivision approval will not allow any further development of the Royal Executive park Site; THEREFORE, BE IT RESOLVED, that in regard to the subdivision application of Royal Executive Park II, the Village Board of the Village of Rye Brook hereby determines that the proposed subdivision of the Royal Executive Park II Property located in the Village of Rye Brook will not have a significant effect on the environment and thus directs that a "Negative Declaration" be issued pursuant to the requirements of the New York State Environmental Quality Review Law and the laws of the Village of Rye Brook; and IT IS FURTHER RESOLVED, that the reason for this determination is that the granting of the subdivision approval application will merely result in the subdivision of the Royal Executive Park II parcel into two parcels and will not authorize any further development on the site; and BE IT FURTHER RESOLVED, that the Village Clerk of the Village of Rye Brook is hereby authorized to prepare a negative declaration and have such declaration published and posted as required by law. 000596 Trustee Meiskin voting AYE Trustee Nardi voting AYE Trustee Cresenz:i voting AYE 'Trustee Zak voting AYE hlayor Kabcenell voting AYE The Public Hearing will be scheduled for June 17th. Public_ Hearing - NO PARKING ON ROANDKE AVENUE 0()0507 TAX WARRANT - 1896/87 THE MAYOR AND TRUSTEES OF THE VILLAGE OF RYE BROOK, COUNTY OF WESTCHESTER, STATE OF NEW YORK TO: The Receiver of Taxes and Assessments of the Town of Rye and the Village of Rye Brook: You are commanded to levy, collect and receive from the several persons and corporations whose names are set down in the Assessment Roll and Tax List of the Village of Rye Brook for the fiscal year 1986-87 to which Assessment Roll and Tax List the warrant is attached and which roll and list are herewith delivered to you, and from the owners and tenants or the occupants of the property of such non-residents set down in said Assessment Roll and Tax List, and from the goods and chattels liable to execution and sale for taxes or said several persons, corporations, tenants or occupants the amount of the assessment stated in said roll and list opposite the names of such as the amount to be paid by such persons, corporations, tenants, or occupants of property as described respectively as follows: For the Operating Budget 4,336,694 Debt Service 104,228 Total 4,440,922 Less Estimated Revenue - 600,155 Less Accumulated Surplus - 400,000 Total 3,440,767 In addition, the following maintenance charges shall be assessed against the entire Village and collected in the amounts of: Street Lighting 104,500 Water Hydrant Charge 76,500 Sewer Maintenance 35,000 NET BUDGET (Being for all purposes the 3,656,767 amount of) You are authorized to collect said tax in two unequal Jr 000598 installments, the first of which shall be two-thirds of the total, and shall be payable on the first day of June, 1986, and the remaining one-third which shall be payable on the first day of February, 1987. You are also authorized to collect said tax from any taxpayer or taxpayers desiring to pay same. Interest shall attach to and be collected with said taxes as follows: (a) As to two-thirds of said taxes payable on the first day of June, 1986, 2% on any unpaid balance after June 30th for the month of July, 1986, or any part thereof that the taxes remain unpaid. (b) As to one-third of said taxes payable on the first day of February, 1987, 2% on any unpaid balance after February 28th for the same month of February, 1987, or any part thereof that the taxes remain unpaid and thereafter 1% for each and every month or part thereof that the taxes remain unpaid. On the first day of March, 1987, you shall forthwith make your return of the proceedings under and by virtue of the warrant to said Mayor and Trustees of the Village of Rye Brook (and you will file this warrant and list with the Clerk of the Village aforesaid, together with a statement and list of the assessments remaining unpaid and uncollected, and the reason why the same were not collected) , which statement shall be verified by you under oath to the effect that the same is in all respects true. By virtue of this warrant, you are authorized and empowered and directed to continue your efforts to collect with interest, in accordance herewith, all taxes remaining unpaid as of the first of March, 1987, until such time as you shall be advised by the Board of Trustees that the Village shall direct the sale of such unpaid taxes through tax lien foreclosure of other proceedings, under the Tax Law of the State of New York.
