RYE BRORO O , K AT 8:00 p_M, PRESENT: Mayor Kabcenell, Trustees Cresenzi, Nardi, , ar , Zak, Treasurer Cortese, Meiskin ardi, Attorney Kramer, Deputy Jane N ABSENT: Clerk Smith On the motion of Trustee Cresenzi, seconded by Trustee Nardi RESOLVED that the minutes of the Regular Meeting of January 28, 1986 and the Agenda Meeting combined with a Special Meeting held on February 4, 1986 be accepted as presented. The vote on the motion was as follows: Trustee Nardi Trustee Cresenzi Voting AYE Trustee Meiskin voting AYE Nardi voting AYE Trustee Zak voting AYE Mayor Kabcenell voting AYE PUBLIC HEARINGS Continuation from February 4, 1986, Louis Larizza 4 unit Cluster Housing on Highview Avenue. Mayor Kabcenell: regarding the subdivision of application by Louis Larizza for a 4 unit cluster housing on Highview Avenue. If there is someone here from the Planning Board that may wish to Comment at this time, please do so: Mr. Bernard Klem: We approve the application of the 4 unit subdivision with the request that said builder save the saveable trees on the property. On the motion of Trustee Meiskin seconded by Nardi Resolved that application for subdivision by Louis Larizza for 4 unit cluster houses on Highview Avenue be approved. The vote on the motion was as follows: Trustee Cresenzi voting AYE Trustee Meiskin voting AYE Trustee Nardi voting AYE Trustee Zak voting AYE AMEND THE SPECIAL PERMITS FOR 2 GAS STATIONS Mayor Kabcenell read the Legal Notice published on February 18, 1986 I I 000566 Discussion was as follows: The difference is that the stations will open one hour earlier and close one hour later. The hours would be 6:00 a.m. to 9:00 p.m. except on Sunday which would be from 8:00 a.m, to 8:00 P.M. A question was Put forth as to complaints from residents regarding Pollution, other. Response was negative. The question was presented to the Mayor regarding the failure to comply with the time schedule of this new special Permit and the Mayor advised that a summons would be imposed. The maximum fine would not exceed $250.00 per violation. On the motion of Trustee Cresenzi seconded by Trustee Nardi Resolved that the Special Permits for (2( gas stations at So. Ridge Street & Bowman Avenue be amended to allow .them to operate from 6:00 a.m. to 9 00 p.m. except on Sunday which would be from 8:00 a.m. to 8:00 p.m. The vote on the motion was as follows. AYE Mayor Kabcenell voting AYE AMEND LOCAL LAW #7=84 TO PROHIBIT PARKING "HERE TO CORNER" ON GARIBALDI PLACE & WEST STREET — Mayor Kabcenell read the Legal Notice that was published on February 18, 1986 and asked Traffic Commissioner Joseph Pellino for any comments that he may have. Joseph Pellino stated that cars are parked in a very dangerous manner on Garibaldi Place. He stated that taking parking spaces away from residents is not a punishment but a safety measure. On the motion of Trustee Meiskin second by Trustee Cresenzi RESOLVED that the Amendment to Local Law #7-84 be amended to Prohibit Parking "Here to Corner" on Garibaldi Place and West Street. The vote on the motion was as follows: Trustee Cresenzi voting AYE Trustee Meiskin voting AYE Trustee Nardi voting AYE Trustee Zak voting AYE - Mayor Kabcenell voting AYE COMMUNICATIONS , 000567 Application of Anglican Church of the Advent on Comly Avenue for subdivision of 3 acre parcel. Attorney Kramer stated that when the Anglican Church purchased the property from the Lutheran Church it carried a deed restriction, the purpose of the restriction was that the property should not be used for any other use than church use. Mr. Adler advised that the restriction was placed on the Property at the request of the Planning Board when the property was sold by the Lutheran Church to be used for church use only. Mayor Kabcenell chose to adjourn this discussion until the next board meeting on March 25, 1986, due to the fact that there was no-one present to represent the Church of the Advent, he also asked that the Village Attorney contact the Church of the Advent (applicant) for some answers. On the motion of Trustee Meiskin seconded by Trustee Cresenzi Resolved that this discussion be adjourned to the March 25, 1986 meeting. The vote of the motion was as follows: Trustee Cresenzi voting AYE Trustee Meiskin voting AYE Trustee Nardi voting Aye Trustee Zak voting AYE Mayor Kabcenell voting AYE LETTER RE: AMBULANCE CORPS Mayor Kabcenell read a letter which was not to the Village Board but a copy was sent from the Associate Administrator of United Hospital praising the great job done by the members , of the Port Chester/Rye Volunteer Ambulance Corps. Mayor Kabcenell joined the associate administrator in praising the corps for a job well done by its dedicated members. DISCUSSIONS & REPORTS FIRE CONTRACT The fire contract between the Village of Rye Brook and the Village of Port Chester is for a period of 3 years commencing on June 1, 1986 to May 31,1989. This is the first time that a contract has been agreed upon for such a long period. This would enable the municipalities to budget for this expense. on the motion of Trustee Meiskin seconded by Trustee Nardi BE IT RESOLVED that the Fire Contract between the Village of Rye Brook and the Village of Port Chester be signed by Mayor Kabcenell. This would be for 3 years with an increase of 6% annually, the amount of the contact .is $348,316.00 which will be paid to the Village of Port Chester. The vote of the motion was as follows: Trustee Cresenzi voting AYE Trustee Meiskin voting AYE Trustee Nardi. voting AYE Trustee Zak voting AYE Mayor Kabcenell voting AYE SITE PLAN REVIEW FOR RESIDENTIAL SUBDIVISION A proposal should be granted that all subdivisions regardless of their size be reviewed. Mayor Kabcenell requested a public hearing for the March 25, 1986 meeting. On the motion of Trustee Nardi seconded by Trustee Cresenzi BE IT RESOLVED that a Public Hearing will take place on March 25. 1986 On the motion of Trustee Nardi seconded by Trustee Cresenzi BE IT RESOLVED that a public hearing will take place on March 25, 1986 to amend the Local Law #28-84 "Addition to Zoning Law. The vote on the motion was as follows Trustee Cresenzi voting AYE Trustee Meiskin voting AYE Trustee Nardi voting AYE Trustee Zak voting AYE Mayor Kabcenell voting AYE ZONING CODE AMENDMENT PROHIBIT PARKING OF BOATS AND BOAT TRAILERS Mayor Kabcenell stated that this was incomplete at this time The request for a Zoning Code Amendment prohibiting the parking of boats and boat trailers be postponed until March 25, 1986. Information will be gathered from neighboring communities concerning their approach to this issue. GRIEVANCE DAY The Board of Trustees sitting as an assessment Board of Review heard grievances from four (4) property owners or their representatives. All grievances have been referred to the Village Attorney and assessor for review and report. This board will make a decision prior to April 1, 1986. 0005611 STREET LIGHTS After months of delay and waiting for parts and supplies for the restoration of the street lights in the Brook Lane/Lincoln Avenue/Rye Hills section of the Village work has begun and should be completed by the end of the month. RESOLUTIONS On the motion of Trustee Nardi seconded by Cresenzi WHEREAS the loyal and dedicated service of Brad Edwards the General Manager of the Rye Town Hilton who has been transferred to Nevada. WHEREAS Brad Edwards has served the Village of Rye Brook as a gentleman and hotel manager BE IT RESOLVED that the Mayor and Trustees on behalf of the residents of Rye Brook wish Brad Edwards the best in his future endeavors. On the motion of Trustee Nardi seconded by Trustee Zak BE IT RESOLVED that Penny Randall of 130 N. Ridge Street, Rye Brook, NY be appointed to the Recreation Commission to fill the unexpired term of Leon Marraro said term to expire in April, 1988. The vote of the motion was as follows Trustee Cresenzi voting AYE Trustee Meiskin voting AYE Trustee Nardi voting AYE Trustee Zak voting AYE Mayor Kabcenell voting AYE Mayor Kabcenell asked if there was anyone that wanted to bring something before the board The curator of the Museum of Cartoon Arts asked if there was any decision regarding the sign. Mayor Kabcenell said there was nothing before him that he could comment on and advised that a discussion would take place at the Regular Meeting of the Board of Trustees on March 25, 1986. A resident also commented on the terrible condition of Ridge Street and the mayor advised that Westchester County recently patched the road. However the Village is still pressuring the county to repave the entire road. 0005 70 The next meeting will take place on March 25, 1986 The meeting was adjourned at 8:55 p.m.
