MINUTES OF REGULAR BOARD MEETING HELD ON January 15th 1985 at 8 P.M.
at the Village Office.
Present: Mayor Kabcnell, Trustees Meiskin, Nardi, Harris, Zak

Minutes were accepted as presented.
Mayor Kabcenell — we have reevaluated the licensing and fee
structure and have brought it more into line with neighboring
communities.

George Morrow - Special Assistant to the Mayor - Police Chief Gendalia
had asked if the Board would consider increasing the Pistol Permit
application fee. This is not part of our general fee structure,
the police department has had this fee for years. It is now $50.00
plus a charge for fingerprinting. Chief Gendalia would like the fee
to be $100.00, in view of the work involved - there is an investigative
process, which takes a great deal of time, and he has a whole stack of
permits.
Mayor Kabcenell - ask the Chief to give us a specific recommendation.
On the motion of Trustee Harris, seconded by Trustee Zak,
RESOLVED that the fee schedule for the Village of Rye Brook be
adopted as presented.

STATUS REPORT - CENTRAL GARAGE.
Mayor Kabcenell - The Central Garage has been active now for seven months,
and the downtime of police vehicles has been considerably decreased due
to regular maintenance and tune-ups. As a result of this, and using
regular gas instead of super, bidding on gasoline and diesel fuel,
buying tires by state bid, our costs are much less than previously.
For the police vehicles, compared to 1983 figures, we- used 10,840 gallons
compared to 12,258 gallons, almost 12% decrease in gallons. In dollars,
due to tune-ups, maintenance and the lower price of fuel, the savings
amount to 33% $15,263 compared to $9,924, a saving of $5,340. This is
just for gas for police vehicles!
Repairs for seven months in 1983 were $6300, and in 1984 - $5100.
This will be improved much more in future, since we were working with
older cars, the ones which had not been well maintained. With new
cars, and a maintenance program, there should be significant savings,
as well as more efficient. At this point we are functioning without the
assistant mechanic which we budgeted, - perhaps we will need someone
part time to take care of vacations.
Trustee Meiskin - prefaced his statement that it was not made in anger
but in total confusion. The Central Garage does not belong to Rye
Brook and this is a disgrace. For the last two years, we have been
negotiating with the Rye Town Board to get something that properly
belongs to the citizens of Rye Brook, and they have consiptently said
"we'll see you next week." This is now two years, and I am disappointed
with the representatives that are supposed to represent Rye Brook, in

that I read in the Daily Item last week that an agreement had been
reached between Port Chester and the Town of Rye over MTA taxes.
On a debt of over $400,000.00, Port Chester is settling at $80,000.00.
I don't want to say it is a disgrace, let's say a disappointment,
there have been many areas where there has been mutual cooperation
between the Rye Town Board and Rye Brook, and in this one particular
instance, I cannot understand the negative behaviour of the Rye Town
Board in not giving the residents of Rye Brook, the garage which is
known as the Central Garage. The residents of Rye Brook paid for it
for however long it has been there, they have paid:to maintain it.
Since the Town Board .is willing to set tlefor $80;000 oh a $400,000 debt
from Port Chester, I see no reason why they should not transfer the
garage, which is the rightful property of the residents of Rye Brook.
There is no record of anything that would preclude them from doing
this. The Rye Town Board also represents the citizens of Rye Brook.
I am very disappointed and very confused as to why they are not doing it.
I would certainly like to continue our cooperation with the Rye Town
Board - this is one issue which galls me, and I am sure there are many
residents who feel the same confusion.
' Trustee Zak - I concur with every Trustee Meiskin has said.
Trustee Meiskin - All costs have been borne by the citizens of Rye Brook,
Now - Rye Brook has to share the cost of the $320,000 nonpayment of MTA
taxes.
Sid Miller - resident - Have we formally requested it?
Trustee Meiskin - Many times -we have had meetings with them - they
have said they agree with us, and will get to it tomorrow.

Mayor Kabcenell - For the record, Rye Brook continues to pay for the
maintenance of the garage. It is in our budget - we maintain the garage.
One of the problems, and we have explained this very carefully to the
Town Board, is a difficulty in making a capital investment in something
we don't own, with Village funds. It would make good sense to
have the property transferred so that we can further increase the
efficiency of the operation.
Trustee Meiskin - one of the members of the Town Board made a statement
asking how they could answer to Port Chester if they gave us something
that really belonged to the whole town. I think that the MTA taxes being
forgiven by the Town, certainly infringes on the Rye Brook residents.
I believe the garage would be an equitable trade.
Trustee Harris said he really didn't think a dollar amount should be
involved in connection with the garage.
Mayor Kabcenell - Nobody challenged on the Town Board that it was
really appropriate to transfer the property - it simply hasn't been
done.
Resident Morton Smith - there was a report in the Daily Item recently
that the Town has a $4.6 million deficit, which does not appear in
their budget. The $320,000 amount of forgiven MTA taxes will increase
that as a townwide charge. Is this perhaps a subject for a taxpayer
lawsuit.
In response to a question from the floor as to why Rye Brook taxes
were not guaranteed in the same way as Port Chester, Mayor Kabcenell
said that it was wrong to do so, and that we would not compound the
situation. Trustee Nardi said they had agreed to stop, but they are
still doing it.
Trustee Nardi stated we should recommend that our counsel check to
see what our options are, but Trustee Meiskin suggested that before
doing that, we should seek another, final, meeting. Trustee Nardi
agreed, but that we should be prepared at that time to tell the Town
Board what our next step would be. Mayor Kabcenell said there were
meetings sheduled and this would be covered.

TRAFFIC IMPROVEMENT - RIDGE/BOWMAN INTERSECTION.
Mayor Kabcenell - now through the diligence of Rye Brook to resolve
something that has been before the County Board for 12 years.
We have now effectuated plans for the improvements on Bowman Avenue
at Ridge Street - it is to be bid this month and construction is
scheduled for early Spring. Traffic controls at Ridge/Bowman will
be upgraded, Bowman will be widened. All of the.documents clearly
state that a traffic signal at the entrance to the shopping center, - -
but the last latter shows some confusion on this item, and I am not
sure we have resolved that. Most of this will be done at no cost
to the Village, the County is doing the engineering and the widening,
they were to provide the traffic signal at the shopping center, and we
were to provide the upgrading of the signal at the. intersection, and most
of this money is coming from the developer of 287/Bowman Plaza, which is
Harrison, but where we 'provided him with a curb cut. Not only have been
able to resolve this longstanding problem, but have been able to do this
with virtually no cost to the Village.
KING STREET PROPERTY.
Mayor Kabcenell - we are in process of requesting quotations for the
land survey related to the utilisation of the property. This ca_n
be addressed in concert with a status report from the Fire Study Committee,
FIRE STUDY COMMITTEE UPDATE
Sid Miller - At the time of the purchase of the land on King Street, -
which we were very much in favor of - costs of land were skyrocketing
and the land is more valuable to us today, and is .ever appreciating
in value.
The Committee still feels very strongly that a fire house at that
site is very important to the well being of the Village, that it is
a good idea to build a building, work out some long-range contract
with Port Chester and to have their equipment, their men and volunteers
in that location. We feel it is in the best interests of the village
to work this out.
Mayor Kabcenell - Mayor Iasillo of Port Chester has appointed a
committee to react with our Fire Study Committee in terms of this
aspect, and all of the other aspects.
Sid Miller - we are planning meetings and we are going to try and work
this out.
Mayor Kabcenell - we have to start negotiations on the new contract,
and they must recognize now that we would like to continue this
arrangement.
Sid Miller - in response to question of size - 5,000 s.f. would be
sufficient to house 2 pumpers and a hook & ladder.
Mayor Kabcenell - the land would be adequate for this and for a
municipal office, if necessary.
RESOLUTIONS.
REGISTRATION OF VOTERS.
On the motion of Trustee Meiskin, seconded by Trustee Nardi,
WHEREAS the Board of Trustees, pursuant to Section 15-118,
Sub. 3(a, b, c) of the Election Law, is required to
designate the hours for the registration of voters, and
the date of registration being fixed by law as the 10th
day preceding the election, and
WHEREAS the Board of Trustees have determined that more
than one-half of voters qualified to vote at a forthcoming
village election for village officers were personally reg-
istered at the last preceding general election other than
a Village election for officers and that

taking the registration for such forthcoming election in
a single place will be accomplished more efficiently and
economically,
RESOLVED that in accordance with Section 15-118 (Sub. 9)
of the Election Law, the places where the registration of
voters are normally held shall be consolidated into a single
place as follows:
Ridge Street School - Lobby
FURTHER RESOLVED that a single Board of Electors be used
for taking the registration of each such election district, .and
FURTHER RESOLVED that the Village Clerk be authorized to
appoint two (2). election inspecotrs wnu shall serve on
registration day, and
FURTHER RESOLVED, that if said inspectors of election are
unable to serve on registration day, that the Village Clerk
be authorized to appoint alternate inspectors, and
FURTHER RESOLVED that the inspectors of election of this
Village shall prepare a register for such election in the
manner provided by law and shall meet on the tenth day
preceding the coming annual election, to wit,
On the 9th day of March, 1985 at the Ridge Street School
Lobby between the hours of 12:00 o'clock an the afternoon
of that day and 9:00 o'clock in the evening of that day,
for the purpose of _completing said register for such election
in the manner provided by law, and
FURTHER RESOLVED that the Village Clerk shall furnish the
necessary blank books, in connection with such registration
and election at the expense of the Village, and
FURTHER RESOLVED that the inspectors of election shall receive
as their compensation the sum of $5

RESOLUTION - APPOINTMENT OF INSPECTORS OF ELECTION
On the motion of Trustee Harris, seconded by Trustee Nardi,
RESOLVED that pursuant to Election Law SS 15-116, there
shall be two (2) inspectors of election for each Village
election district in the Election to be held on
March 19th, 1985 from 7 a.m. to 9 p.m. , and
FURTHER RESOLVED that the following inspectors are
appointed:

On the motion of Trustee Meiskin, seconded by Trustee Harris,
RESOLVED that at the next Village Election to be held on
March 19th, 1985, voting machines shall be used, said voting
machines being awned by the Town of Rye, and
BE IT FURTHER RESOLVED that if said voting machines are not
available, the use of paper ballots is hereby authorized, and
BE IT FURTHER RESOLVED that the polls in each of the seven
(7) election districts shall be opened at 7 o'clock in the
morning and remain open until 9 o'clock in the evening of
said day.

WHEREAS Harry Hayes has been a long time member of Washington

WHEREAS Harry Hayes, has given much of his time, expertise and efforts
on behalf of the residents of Rye Brook, and
WHEREAS Harry .Hayes has now completed his term as Chief of the
Washington Park Engine G Hose Company N4.
On the motion of Trustee Nardi, seconded by Trustee Meiskin,
THEREFORE BE IT RESOLVED that the Village of Rye Brook extends
to Harry Hayes our expression of gratitude, thanks and appreciation,
and
BE IT FURTHER RESOLVED that the Mayor and Trustees personally
thank Harry Hayesfor his cooperation and efforts towards improving

Mayor Kabcenell — Mr. Hays has been a most dedicated servant of
the people, and we want him to be aware of our appreciation.
DISPOSITION OF OLD TRUCK
This deals with a resolution introduced on January 8th rebating to
.the sale of old Highway Department equipment.
Highway Superintendent Don Brown stated that it would take $50,000
to put this equipment in shape, a new piece of equipment would cost
$130,000. We do need it more than six days per year and we can
rent equipment for $90 per hour.
The resolution of January 8th was as fonows —

RESOLVED that the Superintendent of Public Works be authorized to
sell to the highest bidder, one 1968 GMC Chassis with a 1968 SANS—

RESIGNATION OF CINDY LUND, DEPUTY VILLAGE CLERK
WHEREAS Cindy Lund has served the Village of Rye Brook as
Deputy Clerk, and as a dedicated secretary of the Village, and
WHEREAS Cindy Lund has rendered extraordinary service and has
performed with a generosity of time and spirit from which each of
us has benefitted, and
WHEREAS the Village has benefitted from Cindy Lund's service, and
WHEREAS each of us feels privileged to know Cindy Lund and to
have worked with Cindy Lund, and
WHEREAS we wish to publicly acknowledge our gratitude to Cindy
Lund,

PUBLIC HEARING RECONVENED ON ADOPTION OF LOCAL LAWS FOR THE VILLAGE
Mayor Kabcenell — we got hung.up on a proposed local lava relating to
an issue which has confused and confounded many communities.
It has to do with the establishment of a Code of Ethics and we worked
from a draft prepared by Ed Beane, a member of the volunteer Legal
Committee. What we want to do is to see that noone takes advantage
of his position. Putting this down on paper is difficult.
We want to make a statement that public office should not be misused.
There was a lengthy discussion, with input by Board Members, Village
Attorney, several residents and members of the legal committee.
In the meantime, until the Board Members had more time to digest
the proposed draft, Mayor Kabcenell suggested that we go on record
with the intent to establish such a Code of Ethics.
On the motion of Trustee Meiskin, seconded by Trustee Nardi,
BE IT RESOLVED that the proper operation of the Village government
requires that officials, officers and employees be independent,
impartial and responsible to the people; that government decisions and
policy be made in the proper channels of the governmental structure;
that public office not be used for personal gain; that public officials,
officers and employees observe in their official acts the highest
standards of morality and discharge faithfully the duties of their
office regardless of personal consideration; and that the public have
confidence in the integrity of its government and the officers and
employees thereof. In recognition of these goals, the Board of
Trustees intends to establish a Code of Ethics for all officials and
officers of the Village of Rye Brook, and for all employees of such
Village hereinafter referred to as the "Village". In the event of
any conflict between the provisions of this Code and the provisions
of Article 18 of the General Municipal Law, the latter shall control, and

General Municipal Law of the State of New York, the Board of Trustees
intends to create a Board of Ethics consisting of five members.

In response to a question from Trustee Nardi, Attorney Kramer stated -
that while the Code of Ethics could be established by resolution, as a
Local Law it would be harder to change.

RESOLVED that the Public Hearing on Adoption of Local Laws be
adjourned to February 19th, 1985 at 8 p.m.

Mayor Kabcenell announced the date for the Agenda Meeting would be
February 12th and the Regular Board Meeting for February would be
held on February 19th in conjunction with Greivance Day, which must
be held on that date by law.
The meeting was adjourned at 10.40 p.m.
