Jenkins Westchester County Executive 432 Michaelian Office Building 148 Martine Avenue White Plains, New York 10601 Telephone: (914) 995-4400 Website: westchestercountyny.gov April 20, 2026 Christopher Bradbury, Village Administrator Rye Brook Village Hall 938 King Street Rye Brook, NY 10573-1226 County Planning Board Referral File RYB-26-001 – 900 King Street Amended Site Plan Approval Dear Mr. Bradbury: The Westchester County Planning Board has received a site plan (dated February 20, 2025) and related materials for a proposed amendment to a previously approved site plan application to redevelop a 17.77- acre former office site located at 900 King Street (NYS Route 120). The currently-approved site plan is for the construction of an age-restricted residential Planned Unit Development (PUD) community consisting of a four-story independent living facility in the center of the site with 126 units; a four-story assisted living and memory care facility northeast of the independent living facility with 85 units; and 20 three-bedroom residential townhouses in the western portion of the site. The existing office building on the site would be demolished. This application has been under consideration by the Village since 2017, and the original site plan was adopted by the Rye Brook Planning Board on June 24, 2021. Subsequent amendments have been adopted, the latest in 2025 for which we provided a comment letter dated April 21, 2025 (RYB 25-001). The currently proposed amendments include minor adjustments to the footprints of the townhouses, and adjustments to the driveways and parking areas at the rear of the assisted living building. 18 of the planned 249 parking spaces on the property would be reallocated as land-banked, adjacent to the newly designed rear driveways. No changes to the unit count or other areas of the site are proposed. We have reviewed the proposed amendments under the provisions of Section 239 L, M and N of the General Municipal Law and Section 277.61 of the County Administrative Code and we offer the following comments: 1. NYS DOT review. King Street (NYS Route 120A) is a State highway. The Village should forward a copy of the updated application to NYS DOT and identify any additional requirements needed to evaluate potential traffic impacts to King Street. 2. Construction within a regulated stream/wetland buffer. We note that the proposed amendments include changes to the proposed construction within the on-site wetland buffer areas. While we note that a portion of the proposed parking area would now be landbanked until future demand warrants, we are concerned that the proposed generators would be located closer to the on-site wetlands than any structures in the approved plan. We recommend that Referral File No. RYB-26-001 – 900 King Street April 20, 2026 Page 2 these generators be relocated away from the wetlands, preferably on the eastern side of the driveway. The applicant should continue to work with NYS DEC to identify any new requirements for the proposed plan amendments. 3. Road and sidewalk connections. We appreciate that the applicant has included a sidewalk along Arbor Drive to connect the proposed building to King Street and associated Bee-Line bus stops. We note that Arbor Drive is a private road, and as such maintenance considerations and a road use agreement should be instituted between the various property owners in order to ensure responsibility is established and safe usage is maintained.
