HomeMy WebLinkAboutAmended Site Plan Approval 2025-11-13 RECEIVED November 13, 2025 Approved 4-0 NOV 14 2025 VILLAGE CLERK'S OMCE VILLAGE OF RYE BROOK PLANNING BOARD RESOLUTION PB 25-007 GRANTING AMENDED SITE PLAN APPROVAL FOR PROPERTY LOCATED AT 24-30 CAROL COURT—THE ENCLAVE WHEREAS, Angela Loffa, Landscape Architect, on behalf of the Enclave Homeowners Association (collectively, the "Applicants', submitted an application for approval of an amended site plan concerning the proposed installation of plantings for screening on the properties located at 24-30 Carol Court in the Enclave, known as Section: 129.35,Block: 1,Lots: 14.24 through 14.30, on the Town of Rye Tax Map,in the H-1 Zoning District (the "Property"); and WHEREAS,on March 24,2009,the Village of Rye Brook Board of Trustees approved Preliminary and Final Subdivision and Site Plan and applications for the development of 30 semi-attached residences that comprise the Enclave at Rye Brook development, which approval included a landscaping and planting plan: and WHEREAS, the plantings now proposed by the Applicants are intended to replace previously approved and existing plantings, including trees, that are in a dying or distressed condition; and WHEREAS, the Planning Board is the Approval Authority for this application pursuant to Village Code § 209-1A(2)(a) and § 209-1A(2)(c); and WHEREAS, the Planning Board reviewed the following plans and application materials: 1. Application for Amended Site Plan Approval; 2. A plan labeled "Drawing L-1" entitled, "Planting Plan" prepared by Angela Loffa Landscape Architect dated 7/16/25; 3. Hardesty& Hanover Memorandum, dated September 5, 2025; and WHEREAS, the application is a Type II Action pursuant to 6 NYCRR 617.5(c)(8) and (12) of the State Environmental Quality Review Act (SEQRA) thereby requiring no further environmental review; and WHEREAS, a duly advertised public hearing was opened on November 13, 2025, at which time all those wishing to be heard on the Application were given such opportunity, and the public hearing was closed on November 13, 2025; and WHEREAS, the Planning Board, Village Planning Consultant, and Village staff have reviewed all application materials and made recommendations; and WHEREAS,the Planning Board has considered the Site Plan Review Standards as set forth in Chapter 209 of the Village Code and is familiar with the site and all aspects of the project. NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook Planning Board hereby GRANTS the Amended Site Plan for the proposed installation of landscape screening at property located at 24-30 Carol Court, which shall be undertaken by the Applicants over time in order to replace existing landscaping as may be necessary to maintain healthy plantings as proposed, subject to the following conditions: 1. The Applicants shall submit a Construction Management Plan to the satisfaction of the Village Building Inspector and Superintendent of Public Works/Village Engineer. 2. The Planting Plan shall be amended to replace the proposed Norway Spruce tree with a native, evergreen species to the satisfaction of the Village Planner and the Superintendent of Public Works/Village Engineer. 3. The Applicants shall adhere to all provisions of the Village Code pertaining to tree removal when existing trees are removed from the Property. BE IT FURTHER RESOLVED,that no permits shall be issued until the Applicant has paid to the Village all applicable fees and professional review fees incurred in connection with review of this Application. BE IT FURTHER RESOLVED, during construction, the Village Building Inspector or Superintendent of Public Works/Village Engineer may authorize, upon the written request of the applicant, minor changes to the approved site plan. Such minor modifications shall be consistent with the design and intent of the approved site plan. The architect or engineer of record shall submit the approved change(s) on a set of as-built plans, which plans shall be maintained in the permanent file of the Building Department.All changes to the site plan, other than minor changes described herein, shall require approval of a site plan amendment by the Planning Board. BE IT FURTHER RESOLVED, all construction shall be performed in accordance with all approved plans and land use approvals, any approved amendments thereto and field changes authorized and approved by the Building Inspector, the Superintendent of Public Works/ Village Engineer, or their designee, in writing. Any applicant who violates this Resolution may be issued a stop work order and summons in accordance with the provisions of Chapter 91 of the Code of the Village of Rye Brook. Referral to the County Planning Board may not occur until your project has progressed well along through the design process. Since the Planning Board's comments may impact project design,this checklist is provided to encourage early consideration of these areas of concern by applicants to avoid project changes later. I.COUNTY PLANNING BOARD POLICIES: Written policies underlie all recommendations of the County Planning Board. Westchester 2025-Context for County and Municipal Planning and Policies to Guide County Planning,adopted by the County Planning Board on 5/6/08,amended 1/5/10,can be found at www.westchestergov.com/2025. ❑ Westchester 2025:Policies should be reviewed to determine how they relate to the development proposal. II.IMPACTS TO COUNTY FACILITIES AND SERVICES: The County Planning Board coordinates the review of development projects with Westchester County departments to identify and address potential impacts on County services and infrastructure.In some situations,permits and approvals may be required that could change project design. ❑ Map of County Facilities: Review the State & County Roads and Parks map (which also includes county channel lines) to identify proximity to County facilities at: www.westchestergov.com/planningdocs/pdfmaps/countystateroadsparks.pdf. Former County Roads do not need review by the Department of Public Works,but will still likely trigger a review by the County Planning Board. ❑ COUNTY CHANNEL LINES: Applications for development on sites within 100 feet of a designated County Channel Line require a stream control permit from the County Department of Public Works. Information and forms can be found at: www.westchestergov.com/dpw/bldgperm.htm ❑ COUNTY PARK: New construction& land alteration projects adjacent to County parks are expected to address screening& buffer of new uses from the park, as appropriate. Stormwater should not drain from a developed site onto a County park without acceptable quantity and quality controls.County parks are designated as Critical Environmental Areas. ❑ SEWAGE TREATMENT AT COUNTY TREATMENT PLANT: Local municipalities are required to reduce and eliminate inflow and infiltration(I&I)into the sanitary sewage systems tributary to County treatment plants.New development will be expected to reduce I&I in relation to generation of new flow at a ratio of three to one. This requirement must be discussed with local officials. ❑BEE-LINE BUS SERVICE: Bee-Line bus stops serving a development site should be identified on plans or noted if located off-site. If a bus stop is located along the site's frontage, the applicant should contact the County Department of Transportation to discuss impacts and the need for improvements. Safe and separate pedestrian access should be provided to link a bus stop and sidewalk with building entrances. Financial assistance to achieve fair & affordable housing development is available through Westchester County & other sources. Applications that include new residential units to be affirmatively marketed & sold or rented subject to fair& affordable housing provisions should be tied to Westchester County guidelines on affordability including income guidelines of eligible households that can be found at: http://homes.westchestergov.com/. If County funding is sought to develop fair & affordable housing,the County Board of Legislators must be included as an involved agency under SEQR ❑RECYCLING: New buildings must contain a designated area of sufficient size for separation and storage of recyclables and trash. Building expansions should also include sufficient space for separation and storage of recyclables. III.DEVELOPMENT STANDARDS The County Planning Board's land use policies focus attention on several aspects of development that may have intermunicipal and quality of life impacts.The list below includes areas most frequently commented on by the County Planning Board. ❑WATER: All development plans should include sufficient provisions for stormwater management, water quality measures and mitigation of flooding. ❑Plans should identify the major drainage basin or watershed the site is located in (Croton River, Upper Hudson River, Lower Hudson, Upper Long Island Sound, Bronx River and Lower Long Island Sound). Any such treatments should not be constructed within wetlands or buffer areas around wetlands. ❑The development should treat and retain as much stormwater on-site as possible,particularly when the site is located in a drainage basin with known flooding problems. Permeable paving surfaces should be used where feasible.Vegetative rain gardens should be used,particularly in areas of overland or channelized stormwater flow,to improve stormwater quality and reduce runoff volume. Specific consideration is required of potential impacts to surface and subsurface drinking water supplies. ❑ SITE LAYOUT.Aesthetic design,building orientation and community character should be considered in the site layout and building appearance. ❑In most locations,buildings should face the street and have pedestrian access from the street. ❑Commercial buildings should be located near the front street line with the majority of parking located in the rear of the building. Even gas stations and convenience stores should be upfront in a landscaped setting with parking,pumps and canopy toward the rear. ❑Buildings should be of pedestrian-scale when seen from the sidewalk. ❑Building facades should contribute to and enhance the character of the community. ❑Driveway and pathway connections should be provided to adjacent sites when possible and cross easements provided. ❑ STREETS. Street design should reduce unwarranted paving and promote connectivity. ❑New streets should connect with adjacent streets wherever feasible to prevent the proliferation of dead-end streets and promote neighborhood integration. ❑Connections could be vehicular or pedestrian/bicycle only,where appropriate. El Street widths should be minimized for streets with low traffic volume to reduce speeds and impervious surfaces. Lane widths of 12 feet are only appropriate for major roadways. ❑Driveway widths should be no more than 9 feet to reduce impervious surfaces. ❑Permeable paving surfaces should be used where feasible. ❑ GREEN TECHNOLOGY.New development should include as many green building elements as possible,such as:renewable building materials,energy efficient heating/cooling systems and fixtures,water saving devices,green roofs and permeable paving surfaces.Information can be obtained from the U.S.Green Building Council at: www.usgbc.org. ❑ LANDSCAPING AND LIGHTING.The site improvements should enhance community character. ❑ Landscaping should consist of native plant species appropriate for the location.Invasive plant species should be prohibited. Waiver: Upon finding by the Building Inspector, Village Engineer, Planning Board or Board of Trustees that, due to the particular character or limited nature of development or change in use or to special conditions peculiar to a site,the submission of a final site plan,or certain portions of information normally required as part of the site development plan,is inappropriate or unnecessary or that strict compliance with said submission requirements will cause extraordinary and unnecessary hardship,such official or Board may waive such submission requirements wherever, in the opinion of such official or Board, such waiver will be consistent with the goal of promoting the public health, safety and general welfare of the community. (the HOA). Recently,Tommy Ciminello,another resident and director of the HOA,submitted to the Planning Board a request for a sketch plan conference regarding a requested amendment to the landscape plan portion of the Enclave's Site Plan approval. I only learned yesterday afternoon from Mr. Ciminello that the Planning Board has agreed to meet with Mr. Ciminello this evening at 6:30. 1 am unable to attend the meeting. Mr. Ciminello states in his submission that he is writing on behalf of the HOA,but I want it to be noted that I,as one of the three directors of the HOA,do not approve of or support what is being stated or requested in Mr. Ciminello's submission. I had indicated to Mr. Ciminello and the other director in writing a few weeks ago that there should be no submission to the Village until all three directors had an opportunity to review,discuss and agree upon the details of such a submission.This did not occur. Mr. Ciminello has chosen to ignore that customary approach and has submitted his request without my knowledge or consent.There was no vote taken by the HOA board regarding the preparation or submission of a request such as this. I most certainly do not agree with what he is stating or proposing. Also,what is being proposed by Mr. Ciminello does not take into consideration input from the Blind Brook Club,for which the evergreen barrier exists by original agreement. An important fact that was not disclosed to you is that the Club contacted our HOA and the Village over a year ago to complain about the existence of the"holes"in the required landscape barrier. Legalities aside we need to be better neighbors to the Club.Allowing a significantly lesser barrier in order to create a view of the golf course for the few homes seeking such is not fair to the Club nor to the other owners at the Enclave,all of whom are unaware of the situation and what will be the cost to remedy it. No owner opinions have been solicited.Instead this is the work of two board members,and one former board member,two of whom own homes involved.The residents at Enclave all own the area in dispute as Common Area. It is my opinion that they need to be involved with such changes to their property and understand the reasons why,something I have been asking the other board members to agree to for weeks if not months to no avail. To be clear our board has not even taken an official internal vote.Rather these two directors have taken this on themselves. Another important fact not disclosed to you is that the three of us met with Mike Nowak on Wednesday,May 15,2024 to discuss the matter of the multiple"holes"that were deliberately created by the removal of trees which may have been in need of pruning or cutting back but which I believe were removed without the necessary permits or permission, the same trees which were part of the evergreen visual barrier between Enclave and The Blind Brook Golf Club behind Units 25-30. Mr. Nowak confirmed to us that the"holes"constitute a violation of the landscape portion of the Enclave Site Plan approval (although no formal Notice of Violation has been issued).This information as well was not disclosed to you. Mr.Nowak confirmed that we need to develop a plan to fill those"holes",and he also confirmed that evergreens need to be used to fill 1 those"holes"as only evergreens provide the necessary visual barrier;deciduous trees do not provide such a barrier. Here again,this information was not disclosed to you. My desire is to develop a proper and appropriate plan to fill the"holes"as quickly as possible so as to clear the violation. It seems to me the Mr.Nowak is correct that the most appropriate trees to be used to fill those"holes"would be the evergreens originally approved by the Village- spruce,hemlock, fir,cedar,and pine. Instead,Mr. Ciminello is proposing one evergreen (red cedar) and multiple ornamental deciduous trees and shrubs to fill those"holes".
