WHEREAS, application has been made to the Zoning Board of Appeals by Jack Gigh &Anna
Maria Macchia (collectively, the "Applicant") for variances, in connection with the proposed
legalization of unenclosed off-street parking area and maximum allowable impervious front yard
coverage, on property located at 15 Maywood Avenue,in an R-5 zoning district, designated and shown
on the tax map of the Village of Rye Brook as Parcel ID# 135.67-2-66 (the "Property"); and
WHEREAS, the Applicant seeks relief from the following requirement(s) of the Rye Brook
Zoning Code:
1) § 250-6(G)(1)(d)[2] — Unenclosed off-street parking shall not be developed within 25
feet of the front lot line. The Applicant's unenclosed off-street parking has been
constructed 9.96 feet from the front lot line, thereby requiring a variance of 15.04 feet.
2) § 250-37(D) — The maximum impervious coverage in the front yard is 30%. The
Applicant's expanded driveway and parking area has been constructed with a front
yard coverage of 42.9%, thereby requiring a variance of 12.9%.
WHEREAS, a duly advertised public hearing was opened and closed on January 6, 2026, at
which time all those in attendance wishing to be heard were given such opportunity; and
WHEREAS, the proposed action is a Type II action pursuant to 6 NYCRR § 617.5(17) of the
New York State Environmental Quality Review Act and accordingly, no further environmental review
is required; and
WHEREAS, the Board, from the application and record before it, after viewing the Property
and neighborhood concerned, hearing from the Applicant, and upon considering each of the factors set
forth at Section 250-13(G)(b)[2][a]-[e] of the Rye Brook Zoning Code, finds:
1) The requested variance WILL NOT create an adverse impact to the character of the
neighborhood;
2) The benefits the Applicant seeks CANNOT be achieved through another method, feasible for
the Applicant to pursue that does not require the variance;
3) The requested variance IS substantial;
4) The requested variance WILL NOT create any adverse impacts to the physical or environmental
conditions of the neighborhood; and
5) The need for the variance IS self-created.
NOW, THEREFORE, BE IT RESOLVED that said application is hereby GRANTED on
the following conditions:
1) No permit or certificate of occupancy shall be issued until the Applicant has paid in
full all application and consultant fees incurred by the Village in connection with the
review of this application.

We represent the Applicants in connection with the above-referenced application for area
variances before the Village of Rye Brook Zoning Board of Appeals (the "ZBA"). This letter is
submitted in support of the requested relief, which is limited to legalizing an existing
driveway/parking condition in the front yard.
BACKGROUND
The Premises is improved with a single-family residence. The Applicants seek no expansion of
the dwelling and do not propose any new construction.The application relates solely to an existing
driveway and front-yard parking area that has been in place for many years.
The Applicants advise that the driveway configuration was installed by a family member (the
father of one of the property owners). The driveway surface is not simply macadam; it is
constructed with aesthetically appearing pavers that present as a residential hardscape
improvement consistent with the character of Maywood Avenue.
The Applicants have the Premises under contract for sale. If the requested variances are denied,
the Applicants will suffer an extraordinary hardship, including the risk of default and breach under
their contract of sale, as well as the practical and economic burden of removing or substantially
reconfiguring an existing condition that functions as the Premises' only reasonable off-street
parking arrangement.
REQUESTED AREA VARIANCES
The Applicants request the following area variances to legalize the existing conditions:

2. Front-yard impervious coverage variance under Village Code § 250-37.13, seeking relief of
12.9%, from 30.0%maximum permitted to 42.9%existing/proposed.
NEIGHBORHOOD CONTEXT AND COMPARABLE PROPERTIES
The Premises is not out of context. As demonstrated below, many other homes on the same block
have limited garage capacity and utilize front-yard driveway and parking arrangements consistent
with the existing condition at the Premises. By way of example,the following Maywood Avenue
properties are identified as having one-car garages:
• 9 Maywood Avenue - Tax Parcel 135.75-1-24
• 17 Maywood Avenue - Tax Parcel 135.75-2-65
• 19 Maywood Avenue - Tax Parcel 135.67-2-64

The Applicants also note that 2 Maywood Avenue features an essentially identical front-yard
driveway/parking configuration constructed with similar decorative pavers. The Applicants
understand that this installation was permitted. This close comparable further confirms that the
existing condition at the Premises is consistent with established patterns along Maywood Avenue.
Given the proliferation of similar front-yard driveway and parking configurations on Maywood
Avenue, granting the requested variances will preserve the established character of the
neighborhood and will not introduce any new or discordant condition.
AREA VARIANCE STANDARD
In deciding an area variance application, the ZBA must weigh the benefit to the applicant against
any detriment to the health, safety, and welfare of the neighborhood or community, and must
consider the five factors set forth in Village Law § 7-712-b(3)(b).
1. Undesirable change in neighborhood character or detriment to nearby properties
Granting the requested variances will not produce an undesirable change in the character of the
neighborhood. The driveway and front-yard parking condition is an existing at-grade
improvement, constructed with pavers that visually integrate with the residential streetscape. In
addition, the comparable properties identified above confirm that front-yard parking
accommodations are common on the block due to limited garage capacity and typical lot
configurations. Legalizing an existing, visually consistent condition will not detrimentally affect
neighboring properties.

2.Feasible alternatives
There are no feasible alternatives that would achieve strict compliance without imposing
substantial and unreasonable hardship.Eliminating or materially reducing
the existing driveway and front-yard parking area would deprive the -
Premises of necessary off-street parking and would likely shift vehicles to PAR-6 AM
on-street parking, which is inconsistent with the practical parking needs R�o� RI'SH
of single-family homes. Reconfiguring the driveway to meet the 25-foot Rm�S RAa►5
setback and 30% impervious coverage limitations is not reasonably NO
achievable without extensive removal of existing hardscape and
disruption to the Premises. Moreover, Maywood Avenue is subject to

school-day daytime no-parking restrictions (11:00 a.m. to 2:00 p.m.)and , SVt,.ORL O
seasonal winter alternate-side parking regulations beginning November
15th and extending until March 15th , which materially limits on-street
parking availability and reinforces the need for a functional off-street
parking arrangement at the Premises.
3. Substantiality of the requested variances
The requested variances are measurable in numeric terms; however, the practical and visual
impacts are modest. No structure is proposed, the existing condition is at grade, and the paver
installation presents as an aesthetically finished driveway rather than an incongruous paving
condition. The relief requested is limited to legalizing the existing condition.
4.Adverse effect on physical or environmental conditions
Granting the requested variances will not create an adverse physical or environmental impact.The
Applicants do not propose to expand the driveway or increase impervious coverage beyond the
existing condition. Legalizing the existing driveway avoids disruptive removal and reconstruction
work that could temporarily disturb soils and drainage patterns. The existing condition has
functioned for years without presenting any observed safety or welfare concerns.
5. Self-created difficulty
The ZBA may consider whether the difficulty is self-created; however, that factor is not
dispositive. The driveway was installed years ago by a family member and the Applicants seek to
address the condition responsibly through the variance process. As discussed below, the relevant
code language is sufficiently ambiguous that it is understandable how a homeowner would not
appreciate that a zoning variance might be required for a driveway configuration that appears
consistent with neighborhood conditions.
AMBIGUITY IN& 250-6.G.(1)(d)I21
Section 250-6.G.(1)(d)[2] provides that "unenclosed off-street parking shall not be developed
within 25 feet of a front lot line."The ordinance does not plainly explain to the average homeowner
how that prohibition applies to common residential driveway and parking configurations,
particularly where, as here,the driveway is finished with decorative pavers and mirrors numerous
existing conditions along the street. In that context, it is understandable that a homeowner would

have no idea that a building permit, or more importantly an area variance, could be required to
maintain an existing driveway/parking arrangement.
CONTRACT OF SALE AND HARDSHIP
The Applicants have the Premises under contract to sell. Denial of the requested variances would
create an enormous hardship by impairing the marketability and transferability of the Premises and
exposing the Applicants to a material risk of default and breach under their contract.That hardship
is grossly disproportionate to any purported neighborhood impact from legalizing an existing
driveway and front-yard parking condition that is consistent with surrounding properties.
CONCLUSION
For the reasons set forth above, the Applicants respectfully request that the ZBA grant the
requested area variances under Village Code § 250-6.G.(1)(d)[2] and § 250-37.D.

A. An Area Variance to the Zoning; Ordinance is requested because strict application ofthe ordinance
would create the following hardship.-
Strict application of the ordinance would require removal or substantial reconfiguration of the existing front-yard driveway and
parking area that nave long served as the only practical oir-street parking on this small,constrained lot. le current c rtveway
configuration is consistent with other similar properties on the street and is not out orcharacter with the surrounding
neighborhood. Because of the house location,lot size/shape,and existing grading,there is no reasonable alternate location for code-
compliant parking without significant exLense and disturbance. In addition,the applicants are presently in contract to sell the
property,and strict enforcement of the ordinance would create a hardship by jeopardizing that transaction and impairing the
