RE: RB-2025-014 All poisonous weeds or growth and other noxious weeds eradicated.
Dear Sarah-Anne Trayner,
The following violations of the Code of the Village of Rye Brook, and/or the New York State Uniform Fire
Prevention & Building Code (NYSUFP&BC)were found to exist at the property above.
DESCRIPTION
A. Every owner, tenant, occupant or person legally in possession of real property in the Village of
Rye Brook shall maintain such property in the manner provided herein and shall maintain the
public property located between the property line and the curb or edge of the street or highway in
the same condition as the property of which he or she is legally in possession. Such private and
public property shall be maintained as follows:
(1) The grass, hedges, vines, shrubs and brush reasonably cut or trimmed and the trimmings or
clippings and any leaves or other debris removed therefrom.
(2)All poisonous weeds or growth and other noxious weeds eradicated.
(3)All rubbish, litter, leaves, twigs, branches, cuttings or other unsightly or objectionable materials
which are or might tend to become health, safety or fire hazards removed from such land. This
subsection is not intended to prevent mulching and composting of materials originating on the
property as long as such activities are not carried out in an objectionable, unsightly or unsafe
manner.
B. In the event that such owner or other aforementioned person fails or refuses to comply herewith,
the Board of Trustees shall cause to be served upon him by mail a written notice requiring such
owner to comply with such provisions. If such owner fails, neglects or refuses to comply within five
days after service of such notice, the Director of Public Works shall cause the violation to be
corrected. In any such case, such owner shall pay to the Village all costs in connection with such
correction within 30 days after the completion thereof. Upon the failure of such owner to pay such
costs, the Director of Public Works shall certify such costs to the Assessors of the Village, and
thereupon such costs shall become and be a lien upon the land involved and shall be added to and
become a part of the taxes next to be assesged and evied upon such land and shall bear interest

of this section with respect to costs shall be in addition to any penalty imposed by this Code for
violation or noncompliance with any provision of this chapter.
You are hereby directed to contact the Building Department, obtain all necessary permits and commence to
correct the above-captioned violation(s) immediately. Violations of the NSYFP&BC must completely be remedied
by August 11,2025, which is (30) days after the date of this notice and are returnable at the rate of
$1,000.00/day for each day of the continued violation, or imprisonment not exceeding one year, or both.
A RE-INSPECTION OF THE PREMISES IS REQUIRED BY LAW TO CONFORM COMPLIANCE WITH THIS
NOTICE &ALL APPLICABLE CODES.
FAILURE TO COMPLY WITH THIS NOTICE IS A CRIME PUNISHABLE BY FINE, IMPRISONMENT OR
BOTH.

Thank you for your time this morning.
As mentioned, we represent Sarah Anne Trayner in connection with premises located at 66 Bowman Avenue
and are in receipt of the Notice of Violation issued by you dated July 8, 2025.
Our client is in the process of addressing this alleged violation. Specifically, Ms. Trayner's landscaper Gus
Capparelli from F. Capparelli Landscape Design was contacted. He advised however that his only option was to
hire an outside company to spray a type of weed killer.
Ms. Trayner would prefer to pursue a more environmentally sensitive option due to the potential damage a
weed killer could do to the surrounding vegetation. Thus, Ms. Trayner has spoken with Poison Ivy
Removal.com. We are awaiting this company's proposal to remove the poison ivy using a more
environmentally friendlier way.
Obviously and as discussed, the removal will not be completed by the dated referenced in the NOV.
Notwithstanding, we intend to cause the removal at the earliest opportunity. You advised that this was
acceptable and given our communication, a violation will not be issued so long as we continue to address this
situation in a timely manner.

1055:07/10/2025 16:18 - Court employee attempting an eviction at incident
location requesting assistance.
1057:07/10/2025 17:47 - I (PO McKenna) and PO Tompkins were dispatched to 3
Wyman St to assist with an eviction. Upon arrival we spoke to Stephen
Carroll the Town Constable who stated that Paulo Cesar Barzola and his
family needed to be out of the residence by 1630hrs. Mr. Carroll stated
that Mr. Barzola was the party on the lease agreement. Mr. Barzola was not
on scene at this time. Mr. Barzolas family proceeded to gather most of
their belongings and left them in the driveway and the backyard to be
picked up tomorrow morning. We then spoke to the landlord Mirsad Memcaj who
stated the family can come and pick up the remainder of their belongings
tomorrow and if they need to get into the residence a contractor will be on
location with the key. Mr. Memcaj stated he is unsure if he will be at the
residence tomorrow but will try to be there. Mr. Memcaj also stated that
he does not want Mr. Barzola on the property at any point in time. If Mr.
Barzola is on the property Mr. Memcaj would want to pursue charges. The
family left the property without any incident and the house was secure with
new locks.
