I talked with Jud Siebert from my office who confirmed that it is illegal to have two principal structures on a lot— no area
or use variance can make it legal. The only way they can legalize the structure is to convert it back to a garage. I'm in the

Drew,
An few issues have come up regarding the subject property which straddles the municipal line between Rye Brook's R2-
F Two Family Zone,and Port Chester's R-5 One Family Zone.
I've attached some information detailing Port Chester's recent action along with a detail of the 1930 Town of Rye
Existing Conditions Map which shows the bulk of the property, the bulk of the main dwelling,and the entire rear
converted garage within Rye Brook. The rear garage which appears on the 1930 map was permitted to be converted for
occupancy by"domestic help" under permit#238 issued in 1948,however there is no C/O for the conversion only a pre-
date letter.A copy of the permit and pre-date letter is also attached.

Here are some of the issues;
1. According to the attached information,the Port Chester Building Department has legalized a 2 family dwelling
within their 1 family district without a variance or zoning text amendment where the bulk of the dwelling is not
located within their jurisdiction.
2. The non C/O'd rear domestic help garage was converted at some time in the past to a full two family dwelling.
It is no longer occupied by persons employed by the owners of the property as domestic help.
S. The file contains a plumbing permit dated 10.12.00 and inspection report for the installation of 2 gas meters and
related supply piping for the rear house;copy also attached.

Thank you for the email.
Unfortunately the record does not bear out that both houses are supposed to be 2 family homes.According to our
property files and the assessment records from the Town of Rye neither building are legal 2-family dwellings in Rye
Brook. Furthermore there is no C/O to use the rear building as a dwelling at all.The record reflects that the only legal
use of this property in Rye Brook is as a single family dwelling in the front, and a non-habitable garage in the rear.
I've attached a copy of the only property survey available to show that the majority of the property, as well as the
majority of the front dwelling is in Rye Brook and therefore under the jurisdiction of the Village of Rye Brook, not Port
Chester.
In order to legalize this property your client must seek to legalize the 2-family use in the front house in the manner
prescribed by law, and remove the dwelling units from the rear garage.

Hi Mike this is Kathy Zaccagnino from Rye Port Real Estate.My Agent Sophia had a listing on 11 Monroe and it closed in
2016,the property is in Port chester and part in Rye Brook. When we were selling it, basically is was a nightmare. I was
glad it closed and out of our hands.
Recently,the new owner called Sophia and now wants to sell the property.This has a house in front and a house in
rear,both are suppose to be 2 families.. When sophia,gave me the file,l see there still are problems, which I
don't understand because we were cleared to close in 2016. 1 have something dated 4/13/19 stating violations, I have a
CO that says it is only for the portion in Port Chester and something saying a Co was not required for permit# issued
11/20/1974 for addition to existing 2 family dwelling Village being Rye Brook.
I can't believe we got this nightmare back. would you be able to help me make some sense of this situation,which
pertains to the Rye Brook Side,and if possible tell me how much of it is in Rye Brook. Would greatly appreciate your help.
