DEED OF EASEMENT
THIS DEED OF EASEMENT, made this 17.�-day of December,
1993 by and between HIDDEN FALLS HOMEOWNERS ASSOCIATION, INC. , a
not-for-profit corporation, having its principal place of business
located at c/o Alamit Properties, Inc. , 4 Stonefalls Court, Rye
Brook, New York (hereinafter referred to as "Grantor") , and RYE
BROOK DEVELOPMENT PARTNERS, a New York Partnership with its
principal place of business located at c/o Alamit Properties, Inc. ,
4 Stonefalls Court, Rye Brook, New York (hereinafter referred to
as the "Grantee") .
WHEREAS, upon examination of a certain survey of Lot No.
22 prepared by Charles H. Sells, a portion of the deck "overhangs"
as shown on Lot No. 22 and, therefore, encroaches on parcel "HOA-
lo" by twelve (12) inches.
WHEREAS, the HIDDEN FALLS HOMEOWNERS ASSOCIATION, INC.
is the owner in fee of HOA-10; and

WHEREAS, RYE BROOK DEVELOPMENT PARTNERS is the fee owner

of Lot No. 22 ; and
WHEREAS, the said encroachment is de minimus in nature
NOW, THEREFORE, the Grantor for and in consideration of
ONE AND 00/100 ($1.00) DOLLAR, lawful money of the United States,
and other good and valuable considerations, does hereby grant and
v release to the Grantee, an easement as described in Schedule "All
attached hereto and made a part hereof, to accommodate the quiet
enjoyment of the said deck as it encroaches on Parcel. HOA-1.0 on Map
No. 23809 as common property owned in fee by HIDDEN FALLS
HOMEOWNERS ASSOCIATION, INC. The said easement shall be permanent
and shall run with the land.
IN WITNESS WHEREOF, the Grantor hereto has executed this
Agreement the day and year above written.

County, New York" and dated January 20, 1989 and filed July 28,
1989 in the Westchester County Clerk's Office, Division of Land
Records, as Map No. 23809 and said easement being more particularly

Rye Brook, Westchester County, New York" and dated January 20, 1989
and filed July 28, 1989 in the Westchester County Clerk's Office,
Division of Land Records, as Map No. 23809 ;

feet to the True Point of BEGINNING,

to a point,
