DEED OF EASEMENT
THIS DEED OF EASEMENT, made this . day of
October, 1991 by and between HIDDEN FALLS HOMEOWNERS
ASSOCIATION, INC., a not-for-profit corporation, having its
principal place of business located at c/o Alamit
Properties, Inc., 4 Stonefalls Court, .Rye Brook, New York
(hereinafter referred to as "Grantor") , and RYE BROOK
DEVELOPMENT PARTNERS, a New York Partnership -with its
principal place of business located at c/o Alamit
Properties, Inc., 4 Stonefalls Court, Rye Brook, New York,
(hereinafter referred to as the "Grantee")..
WHEREAS, upon examination of a certain survey

and/or deck overhang as shown on'l of No. 40 encroaches on
parcel "HOA-6" 0.16 feet, and
WHEREAS, the Hidden Falls Homeowners
Association, Inc. is the owner in fee of HOA-8; and
WHEREAS, RYE BROOK DEVELOPMENT PARTNERS is owner
in fee of Lot No. 40; and
WHEREAS, the said encroachment is de minimus in
nature. ,
NOW, . THEREFORE, the Grantor for and in
consideration of ONE AND 00/100 ($1.00) DOLLAR, lawful
money of the United States, and other good and valuable
considerations, does hereby grant and release to the'
Grantee, an easement as described in Schedule "A" attached
hereto and made 'a part hereof to accommodate the quiet
enjoyment of the concrete pad and deck overhang as shown on
survey dated October 21, 1991 which encroaches on HOA-8.

The said easement shall be permanent and shall run with the
land.

State of New York, said easement being more particularly
bounded and described as follows:

BEGINNING at a point said point being distance
9.98 feet as measured in a easterly direction along the
• southerly boundary line of Lot.No. 40 from its intersection
with the division line of property now or formerly of Lot
41 on the west and of Lot 40 on the east as shown on

Westchester County Clerk's Office, Division of Land Records
on July 28, 1989 as Map No. 23809; thence easterly along
