HomeMy WebLinkAboutEasement Recorded (6) µ :f =gym; L�e�a 9$71PAa299 Sect ion 1 Block 5 Lot P/O 18D, Lot 18 D/S Town of Rye Village of Rye Brook E` County of Westchester State of New York DEED OF EASEMENT THIS DEED OF EASEMENT, made this lL day of August, 1990, by and . between RYE BROOK DEVELOPMENT ARTNERS (the fee owners being hereinafter referred to as "Grantor"), a New York partnership having an office c/o Alamit Properties, Inc. at The Centre at Purchase, New York 10577, and the VILLAGE OF RYE BROOK, a municipal corporation having its principal office on Bowman Avenue in the Village of Rye Brook, New York 10573 (hereinafter referred to as "Grantee"). W I T N E S S E T H• The Grantor is the fee owner of all of the real property as shown and described on a certain "Subdivision Map of Rye Brook Estates" situate in the Village of Rye Brook, Westchester County, New York and which map was prepared and completed on January 20, 1989 by Charles H. Sells, Inc., Civil . Engineers and Surveyors, Bedford_ Hills, New York and filed in the County of Westchester as map No. 23809 on July 28th, 1989; and WHEREAS, the Board of Trustees of the Village of Rye 'Brook on February 14, 1989, approved the subdivision of the subject property, formerly owned in fee by BROOK TWO VENTURES, INC., a New York corporation with offices located c/o Alamit Properties, Inc., The Centre at ]Purchase, Purchase, New York 10577, the predecessor in interest to RYE BROOK I DEVELOPMENT PARTNERS (the Grantor herein),, into sixty (60) lots, designated Lot Nos. l. through 60 and'common areas shown on that certain map known and designated at Map No. 23809 filed. in the County Clerk's Office of the County of Westchester on July 28, 1989; and 'I • WHEREAS, such approval was aonditioned,. inter-alia, upon BROOK TWO VENTURES, INC., its successors, its hie rs�and assigns dedicating parcel "C" Longledge Drive and Parkridge court, upon completion, as public roads to the Village of Rye Brook; and 04-a /fal4V Pin!Ak 'I I. r Y�UBER 9871PA000 -r-, WHEREAS, the said parcels are. shown on map No. 23809 and said map was adopted by the Village Board of z Trustees of the Village of Rye Brook on February 14, 19891 and WHEREAS, it is. the intention of the proposed dedication of Longledge Drive and Parkridge Court, in addition to being dedicated as public streets and roads in the Village of Rye Brook, to also serve as access to parcel "A" and to a parkland to be owned in fee by the Village of Rye Brook; and � k WHEREAS, the said parcel "C't as shown on map No. 23809 is in construction and is being utilized as the "right-of-way" and is presently and temporarily being substituted for the easement right-of-way contained in Liber 3909 cp 102, Liber 3937 cp 410, as corrected by Liber 5026 cp 341, Liber 5199 cp 90, as corrected by Liber 5784 cp 55 and Liber 7033 cp 114; and i WHEREAS, the said easement contained in- Liber 7033 cp 114 authorizes and permits the Grantor to move and re-route the easement as therein contained; and ; WHEREAS, the said Longridge Drive and Parkridge Court is in construction and bonded for.the improvement of same; and WHEREAS, it is the intention of the Grantor as well as the Village of Rye Brook herein to provide the public with free and open access to the parklands as shown on map No. 23809. NOW, THEREFORE, the Grantors in the consideration of one and 00/100 ($1.00) Dollar, lawful money of the United States, and other good and valuable considerations, do hereby grant and release to the Grantee, a temporary easement to become dedicated, upon completion, to the Village of Rye Brook as shown' on map No. 23809 as approved by Resolution of I the Village Board on February 14, 1989. This temporary easement, which shall became dedicated upon completion to the satisfaction of the Village of Rye Brook, is granted on the following terms and t conditions: } The Village of Rye Brook shall have the right at any time of free ingress and egress for the purpose of reaching the public parkland owned by Village of Rye Brook without becoming or being held liable for trespass. I - 2 - i r. The Grantor shall, after the completion of construction or of any . other work required to be done in connection with the dedication of parcel "C" dedicate same to Village of Rye Brook. TO HAVE AND TO HOLD, said temporary easement, which shall become a dedicated road and street easement unto the Grantee, its successors and assigns forever.
