Sells, Inc. , - Civil Engineers and Surveyors, Bedford Hills, New York and filed in the County of Westchester as Map No. 23809 on July 28, 1989 hereinafter referred to as the "Grantee"; W I T N E S S E T H WHEREAS, the Grantor and Grantee acknawledge that a certain air conditioner compressor installed to service Lot #5 encroaches approximately eight (81 ) square feet at the southwest property line of Lot No. 5 and HOA-1 on the map herein referred to as Map No. 23809 filed on July 28, 1989; and WHEREAS, the said encroachment is de minimis in size and in - no way interferes with the health, safety, and welfare of the parties using that portion of HOA-1 as shown. on Map No. 23809 and of the eight (81 ) square feet referred to herein; and WHEREAS, the Grantor wishes to accomodate the Grantee, his heirs, successors and assigns by allowing the compressor to remain in place. NOW, THEREFORE, the Grantors in the consideration of One ($1. 00) Dollar lawful money of the United States and other good and valuable considerations do hereby grant and release to the Grantee, a perpetual easement relating to the eight (81 ) square feet and that the Grantee may enter upon the area known as the southwest property line of Lot No. 5 on Map No. 23809 for the purpose of repair, service and/or replacement to the compressor as required and further this Easement shall be perpetual and shall run with the land. A copy of said Easement is annexed hereto as Schedule "A". IN WITNESS WHEREOF, the Grantor has executed this instrument the date and year first above written.
