Building Inspector,Village of Rye Brook: r' Date: JUL 2 9 2025 RECEIVED April 1, 2025 APR - 2 2025 VILLAGE OF RYE BROOK VILLAGE CLERK'S OFFICE ZONING BOARD OF APPEALS RESOLUTION ZBA 25-005 WHEREAS, application has been made to the Zoning Board of Appeals by Michael Weinberg(the"Applicant's for a variance,in connection with the construction of a new deck at property located at 505 Comly Avenue, in an R-15 zoning district approximately 50 feet from the intersection of Maplewood Lane and Comly Avenue, designated and shown the tax map of the Village of Rye Brook as Parcel ID No. 136.22-1-11 (the "Property"); and WHEREAS, the Applicant seeks relief from the following requirements of the Rye Brook Zoning Code: (1) § 250-37.0 - the maximum allowable total impervious coverage is 5,307.28 square feet. The existing non-conforming total impervious coverage is 7,258.5 square feet. The proposed deck construction and expansion will result in a total impervious coverage of 7,258.5 square feet. Therefore, a total impervious coverage variance of 1,951.22 square feet is requested. (2) § 250-20.G.(3) —the minimum required rear yard setback is 40 feet. The proposed deck expansion will result in a rear yard setback of 39.82 feet, thereby requiring a rear yard setback variance of.18. WHEREAS, a duly advertised public hearing was held on April 1, 2025, and closed on April 1, 2025, at which time all those wishing to be heard were given such opportunity;and WHEREAS, the proposed action is a Type II action pursuant to the New York State Environmental Quality Review Act and accordingly, no further environmental review is required; and WHEREAS, the Board, from the application, after viewing the premises and neighborhood concerned, and upon considering each of the factors set forth at Section 250- 13(G)(b)[2][a]-[e] of the Rye Brook Code, finds for variance above: 1) The requested variances WILL NOT create an adverse impact to the character of the neighborhood; 2) The benefits the Applicant seeks CANNOT be achieved through another method, feasible for the Applicant to pursue that does not require the variances; 3) The requested variances ARE substantial; 4) The requested variances WILL NOT create any adverse impacts to the physical or environmental conditions of the neighborhood; and 5) The need for the variances IS self-created.
