SUBJECT: 900 King Street Redevelopment Rye Brook, New York Sunrise Senior Living – Amended PUD Application DATE: March 12, 2025 With regard to the above-mentioned project, this office has received and reviewed the following: 1. Amended Site Plan Drawings, prepared by JMC, dated February 20, 2025; 2. Perkins Eastman Architectural Drawings, dated February 20, 2025; 3. MPFP Landscape Drawings, dated February 20, 2025; 4. JMC Preliminary Stormwater Pollution Prevention Plan, latest revision February 20, 2025; 5. Application for Site Plan Approval, dated February 20, 2025; 6. NYSDEC Short EAF Form, dated February 20, 2025. Our last comment memo regarding the previous site plan was dated March 6, 2021; it appears many of those comments still apply and could be conditional to any resolution of approval for the amended plan; thus our current comments are as follows: 1.) As per comment 2 of our project review letter dated March 6, 2021, we note that the Applicant has indicated on the plans that the proposed Sanitary Sewer Facilities are intended to be privately owned. The Applicant should confirm if the WCDOH will allow these facilities to be privately owned, and if so, the Applicant should be required to submit to the Village a formal operation and maintenance agreement for the Sanitary Sewer Facilities, for Village review; 2.) As per comment 4 of our project review letter of March 6, 2021, we have not as yet received information regarding demonstration of satisfactory Sanitary Sewer scour velocity, for anticipated project sanitary sewer flows; 3.) As per comment 5 of our project review letter of March 6, 2021 regarding the project Water Supply System, we note that the following water system upgrades 900 King Street Site Plan March 12, 2025 Page 2 Improving Life. By Design. were to be made as a condition of both project approval, as well as the project water supply provider’s “Willingness to Serve” letter: a. Installation of interconnections to the Westchester Joint Water Works water supply facilities both at King Street and at Anderson Hill Road, to be performed by Veolia Water, and; b. Installation of a water meter and vault on the 16-inch water main, on water facilities located near Anderson Hill Road, in order to by-pass the existing 8- inch water meter and vault that experiences significant peak flow head loss. The cost of this improvement was to have been borne by the Applicant. We note that these upgrades were scheduled to be performed during the year 2019. Please confirm if these water system upgrades and improvements have been completed. We recommend that the above water system improvements, as well as all components of the proposed project water distribution system, be installed prior to issuance of any building permit for project buildings. 4.) As per comment 6 of our project review letter of March 6, 2021 regarding sanitary sewer Inflow and Infiltration (I&I), we note that the Applicant had committed to an I&I flow removal of 80,000 gpd. This flow reduction was to be accomplished through either a monetary contribution, or through a specific project-based mitigation, to be agreed upon by the Applicant and Village. Please provide an update as to current I&I mitigation status. 5.) We have performed an initial review of the Preliminary Stormwater Pollution and Prevention Plan (SWPPP), and we find that the preliminary SWPPP generally addresses the requirements of the NYSDEC General Permit for Stormwater Discharges. Based on this initial, preliminary review, we note the following: a. Proposed condition stormwater facilities indicate the use of a sub-surface infiltration system, which appears to cover an area of about 5,000 square feet. The SWPPP notes that a conservative percolation rate of 1-inch per hour was used in calculations, based on soil testing performed in (2) locations by JMC. We were unable to determine the specific locations of these tests, nor their proximity to the location of the proposed infiltration practice. b. We note that as the proposed infiltration system appears to encompass an area of about 5000 square feet, and in accordance with NYS Stormwater Design Manual Appendix D – Infiltration Testing Requirements, we note that an infiltration practice of 2,500-5,000 sf in area requires (3) infiltration tests to be performed. c. The project Geotechnical Report by AKRF indicates that prior infiltration tests were performed (near PB-12 & 13), with average infiltration rates of 0.69 and 0.63 inches-per-hour. These rates are below the values obtained by JMC. 900 King Street Site Plan March 12, 2025 Page 3 Improving Life. By Design. d. The AKRF Geotechnical report noted differing levels of groundwater being recorded (approximately El.239 and El.245). The report recommended that additional subsurface investigations be performed, in order to establish an accurate groundwater level. Based on a. – d. above, revised infiltration testing should be performed in the specific area of the proposed infiltration system, with sufficient numbers of tests performed. Additionally, the groundwater level in the area of the proposed infiltration system should be investigated and more accurately defined prior to final SWPPP submission. 6.) Please provide copies of the project NOI forms for review, when available. 7.) A more in-depth review of the project SWPPP must be performed prior to the issuance of any project building permits. Please provide a copy of the final SWPPP for detailed review when available. 8.) Plan Sheets C211 and C212 reference previous unit counts of (136) 1,2- and 3- bedroom units, as well as (94) units of 1- and 2-bedroom assisted living/memory care. These unit counts should be revised to reflect (126) and (85), respectively, to be consistent with other plan sheets; 9.) As per comment 7 of our project review letter of March 6, 2021, the proposed fire truck access plan and onsite fire protection plans must be reviewed by the Village Fire Department and Building Department, for code compliance and operational considerations; 10.) All other points noted in the Village’s Resolution of Approval dated August 10, 2021, not mentioned herein, should be again considered as part of any new resolution of approval.
