GRANTING AMENDED SITE PLAN APPROVAL
FOR ST. PAUL'S EVANGELICAL LUTHERAN CHURCH
FOR PROPERTY LOCATED AT 761 KING STREET
VILLAGE OF RYE BROOK PLANNING BOARD
WHEREAS, Ralph Mastromonaco, P.E., submitted an application on behalf of the
property owner, St. Paul's Evangelical Lutheran Church, for a site plan amendment to
legalize a clothing drop-off shed for charitable donations and two (2) refuse/recycle bins in
the rear of the property located at 761 King Street,within the R-15 and Scenic Road Overlay
Zoning Districts and designated on the Tax Assessment Map of the Town of Rye as Parcel
136.21-1-22 (the "Property'; and
WHEREAS, in 1997 the Village Board of Trustees granted Special Use Permit and
Site Plan approval for a child day care center at St. Paul's Evangelical Lutheran Church, 761
King Street, Rye Brook, New York; and
WHEREAS, the Village of Rye Brook Planning Board (the "Planning Board") is the
Approval Authority for the application for the proposed Site Plan amendment pursuant to
Sections 179-2.A(2), 209-1.A(2)(c) and 209-1.B(8) of the Village Code; and
WHEREAS, the Planning Board reviewed the following plans and application
materials:
1. Application for Site Plan Approval
2. Site Plan Submittal Review Check List
3. Exterior Building Permit Application
4. Sheet 01 of 01, "Site Plan Proposed Clothing Drop-off Shed" prepared by Ralph
G. Mastromonaco,P.E., Croton-on-Hudson N.Y., dated 7/25/18,last revised
10/10/19; and
WHEREAS, the Proposed Action is a Type II Action pursuant to the New York
State Environmental Quality Review Act ("SEQRA") requiring no further review pursuant
to the requirements of SEQRA;and
WHEREAS, the Village Planning Consultant, Village Staff and the Planning Board
reviewed the information, submitted comments regarding the site plan and made
recommendations concerning screening of the clothing drop-off shed and refuse/recycle
bins; and

WHEREAS, on October 10, 2019, the Planning Board opened a public hearing on
the subject application for amended site plan approval, at which time all persons interested
were given an opportunity to speak on behalf of or in opposition to said application and the
Planning Board closed the public hearing on October 10,2019;and
WHEREAS, the Planning Board has considered the Scenic Roads Overlay District
standards set forth at Village Code §250-7.F(6), particularly in relation to the proposed
placement of the clothing drop-off shed and the two (2) refuse/recycle bins and their
compatibility with the surrounding environment;and
WHEREAS, the Planning Board finds the clothing drop-off shed and the two (2)
refuse/recycle bins are properly configured and located, and the location does not create any
impacts to the King Street Scenic Roads Overlay District; and
WHEREAS, the Planning Board is fully familiar with the application and the
Property.
NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook
Planning Board hereby approves the application for an amendment to the Site Plan for St.
Paul's Evangelical Lutheran Church to legalize a clothing drop-off shed for charitable
donations and two (2) refuse/recycle bins in the rear of the property located at 761 King
Street,within the R-15 and Scenic Road Overlay Zoning Districts and designated on the Tax
Assessment Map of the Town of Rye as Parcel 136.21-1-22 subject to the following
conditions:
1. The Applicant shall remove the proposed arborvitae plantings from the site plan.
2. No advertising is permitted on the shed,but identification information may be
displayed.
BE IT FURTHER RESOLVED, that all other conditions set forth in the
aforementioned 1997 Resolution of the Village Board of Trustees which are not otherwise
modified herein shall remain in full force and effect.
BE IT FURTHER RESOLVED, that no permits shall be issued until the
Applicant has paid to the Village all applicable fees and professional review fees incurred in
connection with review of this Application.

WHEREAS, Ralph Mastromonaco, P.E., submitted an application on behalf of the property
owner, St. Paul's Evangelical Lutheran Church, for a site plan amendment to install a clothing drop-
off shed for charitable donations in the rear of the property located at 761 King Street, Town of Rye
Tax Parcel 136.21-1-22, within the R-15 and Scenic Road Overlay Districts.
NOW, THEREFORE, BE IT RESOLVED, the Planning Board of the Village of Rye Brook will

SITE PLAN SUBMITTAL REVIEW CHECKLIST
This form shall serve as a checklist for site plan submittal and review by the Village of Rye Brook. The use of this plan
review checklist by the applicant is to ensure compliance with the technical provisions of§209 of the Code of the Village
of Rye Brook entitled, Site Plan Review, pertaining to preliminary and final plan preparation. The Village Code is
available on the Village Website at: www.ryebrook.org. Prior to the appearance before ANY meeting or hearing of the

® COUNTY PARK: New construction &land alteration projects adjacent to County parks are expected to address screening&
buffer of new uses from the park, as appropriate. Stormwater should not drain from a developed site onto a County park without
acceptable quantity and quality controls.County parks are designated as Critical Environmental Areas.
29 SEWAGE TREATMENT AT COUNTY TREATMENT PLANT: Local municipalities are required to reduce and
eliminate inflow and infiltration(I&I)into the sanitary sewage systems tributary to County treatment plants.New development will be
expected to reduce I&I in relation to generation of new flow at a ratio of three to one. This requirement must be discussed with
local officials.
®BEE-LINE BUS SERVICE: Bee-Line bus stops serving a development site should be identified on plans or noted if located
off-site. If a bus stop is located along the site's frontage, the applicant should contact the County Department of
Transportation to discuss impacts and the need for improvements. Safe and separate pedestrian access should be provided to link
a bus stop and sidewalk with building entrances. Information on County bus service and design guidelines can be found at:

®FAIR AND AFFORDABLE HOUSING: Many municipalities require inclusion of fair & affordable units in new
developments. Financial assistance to achieve fair & affordable housing development is available through Westchester County &
other sources. Applications that include new residential units to be affirmatively marketed& sold or rented subject to fair &
affordable housing provisions should be tied to Westchester County guidelines on affordability including income guidelines of

affordable housing,the County Board of Legislators must be included as an involved agency under SEQR
®RECYCLING: New buildings must contain a designated area of sufficient size for separation and storage of recyclables and
trash.Building expansions should also include sufficient space for separation and storage of recyclables.For more information about

JUSTORM SEWER SYSTEM: Any connections to a County storm sewer line will require a permit from the Department of

III.DEVELOPMENT STANDARDS
The County Planning Board's land use policies focus attention on several aspects of development that may have intermunicipal and
quality of life impacts.The list below includes areas most frequently commented on by the County Planning Board
®WATER: All development plans should include sufficient provisions for stormwater management, water quality measures and
mitigation of flooding.
®Plans should identify the major drainage basin or watershed the site is located in (Croton River, Upper Hudson River, Lower

®Development that involves filling, creation of impervious surfaces or buildings and substantive loss of natural vegetation in a
floodplain or flood prone area should be avoided.
®Above ground,vegetated retention/detention basins or devices are preferred because they perform better, are easier to inspect and
maintain and provide additional environmental benefits over subsurface structural devices. Any such treatments should not be
constructed within wetlands or buffer areas around wetlands.
®The development should treat and retain as much stormwater on-site as possible, particularly when the site is located in a drainage

®Impervious cover should be minimized. Permeable paving surfaces should be used where feasible. Vegetative rain gardens should
be used,particularly in areas of overland or channelized stormwater flow, to improve stormwater quality and reduce runoff volume.

®Buildings along coastlines and low lying area should consider the impacts of sea level rise. Specific consideration is required of
potential impacts to surface and subsurface drinking water supplies.
W SITE LAYOUT. Aesthetic design,building orientation and community character should be considered in the site layout and
building appearance.
®In most locations,buildings should face the street and have pedestrian access from the street.
®Commercial buildings should be located near the front street line with the majority of parking located in the rear of the building.
Even gas stations and convenience stores should be upfront in a landscaped setting with parking,pumps and canopy toward the rear.
NBuildings should be of pedestrian-scale when seen from the sidewalk.
NBuilding facades should contribute to and enhance the character of the community.
N Driveway and pathway connections should be provided to adjacent sites when possible and crosseasements provided.
® STREETS. Street design should reduce unwarranted paving and promote connectivity.
N New streets should connect with adjacent streets wherever feasible to prevent the proliferation of dead-end streets and promote
neighborhood integration.
®Connections could be vehicular or pedestrian/bicycle only,where appropriate.
®Street widths should be minimized for streets with low traffic volume to reduce speeds and impervious surfaces. Lane widths of 12
feet are only appropriate for major roadways.
(Driveway widths should be no more than 9 feet to reduce impervious surfaces.
NPermeable paving surfaces should be used where feasible.
® GREEN TECHNOLOGY.New development should include as many green building elements as possible,such as:renewable
building materials,energy efficient heating/cooling systems and fixtures,water saving devices,green roofs and permeable paving

® LANDSCAPING AND LIGHTING.The site improvements should enhance community character.

Waiver:Upon finding by the Building Inspector, Village Engineer, Planning Board or Board of Trustees that, due to the particular character or
limited nature of development or change in use or to special conditions peculiar to a site,the submission of a final site plan,or certain portions of
information normally required as part of the site development plan,is inappropriate or unnecessary or that strict compliance with said submission
requirements will cause extraordinary and unnecessary hardship,such official or Board may waive such submission requirements wherever,in the
opinion of such official or Board, such waiver will be consistent with the goal of promoting the public health, safety and general welfare of the
community.The findings for granting such waiver shall become a part of the public record. Any waiver request must be made in writing,and
include sufficient detailed information for the appropriate authority to make an informed decision.

We are in receipt of your email of October 3, 2019 concerning a response to the FP Clark Memo of
September 6, 2019. The Memo had only four(4) comments and we offer the following information:
Comment 1. Short Environmental Assessment Form.
Response: A Short Environmental Assessment Form dated March 29, 2019 was submitted with
our May 22, 2019 materials to Mike Izzo.
Comment 2. Site Plan with Zoning Regulations Table for the Clothing Drop-off Shed
Response: A zoning regulations table is added to the plan. However, as the site is in the R-15,
single-family residential district none of the requirements actually apply to the
church. The site has been previously approved.
As to the parking calculation, §250-6, G, (c) [14] the required parking is based on one
(1) space for every four(4)seats OR one (1) space for every 200 SF of gross floor
area.
The gross square footage of the church is approximately 8,158 SF which would
require 41 parking spaces.
There are eighty (80) existing parking spaces which would allow for 320 seats.
The pastor reports that the occupancy load of the church is approximately 300,
therefore, 75 spaces would be required.
Comment 3. Landscaping Screening
Response: We added additional shrubbery to the Site Plan.
Comment 4. Lighting
Response: No lighting is proposed for the clothing drop-off shed.

Subject: St. Paul's Evangelical Lutheran Church, 761 King Street —
Application for Approval of an Amended Site Plan
As requested, we reviewed the plans submitted by Ralph Mastromonaco, P.E. on behalf of the property owner,
St. Paul's Evangelical Lutheran Church for approval of an amended site plan to install a clothing drop-off shed
for charitable donations in the rear of the property located at 761 King Street, Town of Rye Tax Parcel 136.21-
1-22, within the R-15 and Scenic Road Overlay Districts.
Property Description
The 2.44-acre property is currently developed with an existing church and associated parking.
Landscape trees and other plantings are located throughout the property.
Project Description
The Applicant proposes to install clothing drop-off shed for charitable donations in the rear of the property.
Review
We reviewed application materials, correspondence and plans that include the following items:

Please note that our review is limited to planning and environmental issues. We offer the following comments
regarding the proposed site plan amendment:
Comments
1. Short Environmental Assessment Form: An SEAF and EAF Mapper Summary Report should be
submitted for review.
2. Site Plan: A Zoning RegulationsTable should be provided on the site plan. The table should also include the
calculation of required parking for the site.
3. Landscaping Screening: Based on our visit to the site, the existing evergreen trees located in the area of the
donation drop-off shed have sparse vegetation on the lower branches resulting in views of the donation box from
the adjacent street. We recommend that additional landscaping materials be planted, such as shrubs, to help
screen the shed from the adjacent neighborhood.
4. Lighting: We question if any lighting is proposed for the donation drop-off shed. If lighting is proposed, it should
be shown on the site plan with the proposed fixtures, wattages and an illumination contour plan.
We look forward to discussion with the Planning Board.

Dear Mr. Mastromonaco,
The Building Department is in receipt of the revised site plan showing the existing dumpsters
and proposed clothing drop-off shed. Upon review of same, advice from counsel, and based on
continuing complaints received from the residential neighbors, the Building Department is
unable to consider your proposal in an administrative capacity.
Therefore, in order for St. Paul's Church to avoid a violation & court summons for unauthorized
modification of their approved site plan, please advise your client to either remove the clothing
drop-off bin from the premises immediately, or to file an application for site plan modification
approval from the Village Planning Board.

Additionally, the Zoning Code defines a "Structure" as follows:
Structure: Anything constructed or erected, the use of which requires location on the
ground or attachment to something having location on the ground.
The proposed clothing drop-off shed is not constructed or erected and it is not attached to the
ground. The clothing drop-off shed would be brought to the site and placed on the ground with no
attachment. It is totally portable and could be removed at any time.
The clothing drop-off shed would be in an area that is heavily screened as can be seen by the site
plan we provided.
We are requesting your review and opinion on the best way to legally place the clothing drop-off
shed for the charitable use proposed, or in the alternative, your authorization, pursuant to this
written request, for this minor modification to the approved Site Plan.
If this request of you is not possible, we will, of course, provide the complete Site Plan application
as required for the full project, though I am hoping that would not be necessary.

Dear Mark,
I apologize for all the confusion regarding the clothing drop bin at St. Paul's Church. While it's true we have been
working on this for over a year, we were never provided with a Site Plan Application which is required in order to
proceed to the Planning Board. And unfortunately to date we still don't have one we're able to process. The applications
must be signed and notarized by the interested parties in order to be considered for anything. We simply can't distribute
an incomplete application to the Planning Board, the Planning Consultants or to the Village Attorney.
It's also unfortunate timing that I was out of the office for a week and unable to review the submitted materials, but that
was my scheduled vacation for which I make no apologies.
St. Paul's Site Plan Application, if complete, will be placed on the July Planning Board Agenda provided there is a July
meeting.

We have been sending plans and information for over a year now, along with pdf files.
Please see the attached. (only a small summary is being sent)
The latest Planning Board application sent 5/22/19 was signed and notarized and Mike told me it was the
correct application.
Our letter of today said we would bring the signed (other requested) applications to the meeting.
We thought we would be on the June 13, 2019 agenda as we submitted in a timely fashion(5/22/2019) and paid
all the fees ($3,075.00).
Again maybe Mike will remember.
You should have quite a large file on this by now, for a little clothing drop-off box.

Enclosed please fin two (2) copies of the drawing entitled Site Plan, Proposed Clothing Drop-Off
Shed, St. Paul's Evangelical Lutheran Church dated July 23, 2018.
We represent St. Paul's Evangelical Lutheran Church in their endeavor to be allowed to install a
Clothing Drop-Off Shed in the parking lot for charitable use. Our client was told by your Department
that Site Plan Approval from the Planning Board would be required.
Site Plan Approval from the Planning Board is a lengthy process with much paperwork involved.
We offer the following information on the Village Code, Chapter 209, Site Plan Review, that we
believe eliminates the need for formal Site Plan Approval:
209-1, B. (3) Any change(s) of use from residential to nonresidential, or vice versa, or a
change in an existing use that will affect the characteristics of the site in terms of
traffic, access, parking, loading, circulation, hours of operation, drainage,
utilities, lighting, security or other Village services, except as set forth below at
§ 209-1E. This provision shall not apply to Tier I home occupations.

The installation of a clothing drop-off shed would not affect the characteristics of the site in terms of
traffic, access, parking, loading, circulation, hours of operation, drainage, utilities, lighting, security
or other Village services.
209-1, D. Minor modifications. During construction, the Village Building Inspector or
Village Engineer may authorize, upon the written request of the applicant, minor
changes to the approved site plan. Such minor modifications shall be consistent
with the design and intent of the approved site plan. The architect or engineer of
record shall submit the approved change(s) on a set of as-built plans, which
plans shall be maintained in the permanent file of the Building Department.
The installation of a clothing drop-off shed could be considered by you to be a minor modification
being consistent with the design and intent of the approved site plan. Therefore, you would require
only an as-built plan of the installed clothing drop-off shed.
We are requesting your authorization, pursuant to this written request, for this minor modification to
the approved Site Plan.
