GRANTING SITE PLAN AND WETLAND PERMIT APPROVAL FOR
PROPERTY LOCATED AT 44 ROCK RIDGE DRIVE
VILLAGE OF RYE BROOK PLANNING BOARD
WHEREAS, David and Alexandra Richardson (the "Applicants' have submitted
applications for approval of a Site Plan and Wetlands Permit for the construction of a patio,
bluestone walkway, paver walkway, driveway apron, stormwater system and landscaping on
the property located at 44 Rock Ridge Drive, SBL 135.27-1-26 on the Town of Rye Tax
Map, in the R-10 Zoning District (the "Property'; and
WHEREAS, the Planning Board is the Approval Authority for the Site Plan
pursuant to Section 179-2.A(2), Section 209-1.A(2)(a) and Section 209-1B(1) of the Village
Code; and
WHEREAS, the Planning Board is also the Approval Authority for the Wetland
Permit application pursuant to Chapter 245 of the Village Code; and
WHEREAS, the Planning Board reviewed the following plans and application
materials:
1. Short Environmental Assessment Form and EAF Mapper Summary Report;
2. Application for Site Plan Approval;
3. Site Plan Submittal Review Checklist;
4. Exterior Building Permit Application;
5. Building Permit Checklist& Zoning Analysis;
6. A Wetlands Permit Application;
7. Wetland Plant list prepared by NatureView Design Group;
8. A plan entitled, "Richardson Patio Installation, Proposed Site Plan," prepared Caccio
Engineering, PLLC, dated 7/21/22, last revised 01/26/23;
9. A Wetland Mitigation plan prepared by NatureView Design Group dated 11/20/22;
10. A Site Survey entitled, "Survey of Property prepared for Alexandra DeVaux
Richardson & David Richardson," prepared by Ward Carpenter Engineers, Inc. dated
5/27/22; and
WHEREAS, the application is a Type II Action pursuant to 6 NYCRR 617.5(c)(11)
and (12) of the State Environmental Quality Review Act (SEQRA) thereby requiring no
further environmental review; and
WHEREAS, the Village Planning Consultant, Village Staff and the Planning Board
reviewed the plans and application materials submitted; and

WHEREAS, a duly advertised public hearing was opened on February 9, 2023 at
which time all those wishing to be heard on the application were given such opportunity,
and the public hearing was closed on February 9, 2023; and
WHEREAS, the proposed patio, bluestone walkway, and paver walkway is located
within the 100 foot wetland buffer; and
WHEREAS, the proposed disturbance of the buffer requires approval of a wetland
permit in accordance with Chapter 245 of the Village Code and mitigation for disturbance of
the buffer at a ratio of 2:1; and
WHEREAS, the proposed total wetland buffer disturbance is 830 square feet and
the Applicants will perform 1,683 square feet of on-site mitigation within the buffer zone;
and
WHEREAS, the Planning Board has considered the Wetland Permit standards set
forth at Section 245-8.A of the Village Code and finds that the Applicant proposes sufficient
wetland mitigation in compliance with Village Code standards subject to compliance with
the conditions set forth herein; and
WHEREAS, the Planning Board has considered the Site Plan review standards set
forth at Chapter 209 of the Village Code; and
WHEREAS, the Planning Board is fully familiar with the application and all aspects
of the project.
NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook
Planning Board hereby approves the site plans listed herein and a Wetland Permit for the
construction of a patio, bluestone walkway, paver walkway, driveway apron, stormwater
system and landscaping on the property located at 44 Rock Ridge Drive, SBL 135.27-1-26 on
the Town of Rye Tax Map, in the R-10 Zoning District, subject to the following conditions:
1. The Applicant shall submit a Construction Management Plan to the satisfaction of the
Village Building Inspector and Superintendent of Public Works/Village Engineer.
2. The Wetland Permit shall be valid for a period of one year from the date of this
resolution, however, an extension of an original permit may be granted upon written
request to the Planning Board by the original permit holder or his/her legal agent at least
30 days prior to the expiration date of the original permit.
3. The Wetland Permit issued pursuant to this approval shall contain the following
conditions pursuant to Section 245-113 of the Village of Rye Brook Code:
a. Work conducted under a permit shall be open to inspection at any time, including
weekends and holidays, by the approval authority, the Advisory Council on

Environmental Conservation, the Village Engineer or their designated
representatives.
b. All permits issued under Chapter 245 shall be void and of no effect after one year
from the date of issue thereof, unless the work for which the permit was issued
has been actually commenced and not been abandoned during that period. In
such cases, the applicant may reapply for a wetland permit from the approval
authority in accordance with the provisions of Chapter 245. If the work for which
the permit was issued has commenced within one year from the date of issuance
of the permit, such permit may be renewed by the approval authority in
accordance with the renewal provisions set forth at § 245-5(A)(8) of the Village
Code.
c. The permit holder shall provide written notification to the Village Engineer of the
date on which the regulated activity is to begin at least five business days in
advance of such date.
d. The approval authority's permit shall be prominently displayed at the project site
during the undertaking of any of the activities authorized by the permit.
e. The boundaries of the regulated activity and all wetlands and watercourses shall
be stated and appropriately marked in the field so as to make the boundaries
visible.
f. The permit, including all conditions, shall be binding on all successors and
assignees of the permit holder; and
BE IT FURTHER RESOLVED, that no permits shall be issued until the
Applicant has paid to the Village all applicable fees and professional review fees incurred in
connection with review of this Application.
BE IT FURTHER RESOLVED, during construction, the Village Building
Inspector or Superintendent of Public Works/Village Engineer may authorize, upon the
written request of the Applicant, minor changes to the approved site plan. Such minor
modifications shall be consistent with the design and intent of the approved site plan. The
architect or engineer of record shall submit the approved change(s) on a set of as-built plans,
which plans shall be maintained in the permanent file of the Building Department. All
changes to the site plan, other than minor changes described herein, shall require approval of
a site plan amendment by the Planning Board.
BE IT FURTHER RESOLVED, all construction shall be performed in
accordance with all approved plans and land use approvals, any approved amendments
thereto and field changes authorized and approved by the Building Inspector, the
Superintendent of Public Works/ Village Engineer, or their designee, in writing. Any
applicant who violates this Resolution may be issued a stop work order and summons in
accordance with the provisions of Chapter 91 of the Code of the Village of Rye Brook.
BE IT FURTHER RESOLVED, that this resolution shall supersede conflicting
provisions of the Village Code.

WHEREAS, David & Alexandra Richardson have submitted Applications for approval of a

1. SEQRA. The Proposed Action is a Type II action with regard to SEQR because it involves the
construction of a single-family residence on an approved lot and the construction of minor
accessory/appurtenant residential structures, including garages, carports, patios, decks,
swimming pools, tennis courts, satellite dishes, fences, barns, storage sheds or other
buildings not changing land use or density.
2. Wetlands and Wetland Buffers. The proposed patio, bluestone walkway, and paver walkway
will be located within the 100-ft wetland buffer. The proposed disturbance of the buffer will
require approval of a wetlands permit in accordance with Chapter 245,Wetlands, of the Village
Code and mitigation for disturbance of the buffer at a ratio of 2:1 (mitigation: total area of
disturbance). The amount of proposed disturbance to the wetland buffer is 830 square feet. The
Applicant has proposed to provide 837 square feet of wetland plantings to mitigate the
disturbance to the buffer. To meet the 2:1 mitigation requirement, an additional 823 square feet
of mitigation will be required.

will be located within the 100-ft wetland buffer. The proposed disturbance of the buffer will
require approval of a wetlands permit in accordance with Chapter 245, Wetlands, of the Village
Code and mitigation for disturbance of the buffer at a ratio of 2:1 (mitigation: total area of
disturbance). The plan should be revised to note that amount of permanent disturbance within
the wetland buffer to determine if an adequate amount of mitigation has been proposed.

This is reflected in the updated "DRAINAGE CALCULATIONS"table on the plan sheet.
• Perc tests are required
Perc tests were performed in August 2022, pert rate is 6.66 min/inch
• Code requires full capture of all impervious onsite, both old and new so design for 4400SF impervious
Roof and other current impervious(itumuge hove veer, redirected to tine proposed Luitec rechurgers.
• Most of the drywells should be outside of wetland buffer, DEC prefers that.
Rechargers have been moved, as required.
• Revisit disturbance in wetland buffer,
