I have attached the two permit applications and your cover letter hereto for your convenience. By way of background, the original application package received by the Building Department on August 4, 2022, from T-Mobil proposed a natural gas generator to be installed inside the tel-com utility building, the revised application now proposes a diesel fuel fired generator with attached monolithic 190-gallon diesel fuel tank installed outside the building. Upon completion of my review of the revised materials I offer the following comments: 1. The correct application to install a generator is the Application to Install a Permanent Standby Backup Generator, a copy of which is attached hereto for your convenience. In addition, neither application received from T-Mobil contains the correct Village Hall Parcel ID# of 129.68-1-14,neither contains the zone of R-15, neither application contains any information whatsoever regarding what equipment is slated for installation, in fact the Wireless Tel-com application which should list the new wireless equipment simply says, Install Generator, and neither application shows the correct property owner, (the Police Department does not own the property). Please arrange for your client to re-submit the correct applications containing all pertinent and correct information. 2. Village Code§250-4.1.B.(7)limits the fuel type of generators installed within residential zones to natural or L.P. gas only. Rye Brook Village Hall is located within the R-15 Residential Zoning District. Please arrange for your client to modify their application to a natural or L.P gas generator, or in the alternative I must deny the application (once we receive the correct applications)with a formal Notice of Disapproval for failure to comply with the aforementioned section of Village Code, and they will then have the opportunity to seek relief from the Village Zoning Board of Appeals. Upon completion of my review I offer the following comments: 1. Although the eight-page plan set contain page C-1 entitled, SITEPLAN dated 06/17/22, there is no actual site plan on this page or on any other page in the plan set. Please provide a comprehensive proposed exterior site plan showing the exact location of the proposed generator and any other equipment proposed to be visible from the exterior. 2. The installation of additional exterior equipment on Village Hall property may require an amended Special Permit from the Village Board of Trustees. Unfortunately, the lack of a comprehensive site plan makes such determination impossible. 3. The revised plans do not indicate the capacity of the proposed diesel fuel tank nor the actual size/height of the generator/fuel tank unit. Please provide information in this regard. 4. The original generator permit application submitted on March 3, 2022, has not been updated to reflect the current revisions. Please provide a properly completed revised generator permit application which reflects the current proposal. 5. The electrical installation permit application from E.C. Electrical Contractors also received on March 3, 2022, indicates the installation of a natural gas generator. Once the generator application has been processed your electrician must submit a revised application reflecting the correct generator. Please provide the requested materials to the Building Department for further review. On March 7, 2022, upon completion of my review of the application and plans I had a telephone conversation with you requesting additional information needed on the plans showing compliance with NFPA 37, and additional generator exhaust discharge/venting information. You then initiated a series of"what-if' emails regarding the fuel type, and location of the generator, culminating with my request for hard copies of proposed plans for review of whatever it is that T- Mobil wants to do. To date we have yet to receive any additional information or plan revisions addressing my March 7th comments, or any proposed changes to the fuel type or generator placement as indicated in your emails. As such the application remains dormant as we await either the information I requested in March, or the proposed change in fuel type and generator location plan revisions. (9) Tower. Any structure built for the sole or primary purpose of supporting any Commission-licensed or authorized antennas and their associated facilities, including structures that are constructed for wireless communications services including, but not limited to, private, broadcast, and public safety services, as well as unlicensed wireless services and fixed wireless services such as microwave backhaul,and the associated site. (c) Review of applications. A State or local government may not deny and shall approve any eligible facilities request for modification of an eligible support structure that does not substantially change the physical dimensions of such structure. (1)Documentation requirement for review.When an applicant asserts in writing that a request for modification is covered by this section, a State or local government may require the applicant to provide documentation or information only to the extent reasonably related to determining whether the request meets the requirements of this section.A State or local government may not require an applicant to submit any other documentation,including but not limited to documentation intended to illustrate the need for such wireless facilities or to justify the business decision to modify such wireless facilities. (2)Timeframe for review. Within 60 days of the date on which an applicant submits a request seeking approval under this section, the State or local government shall approve the application unless it determines that the application is not covered by this section. (i) To toll the timeframe for incompleteness, the reviewing State or local government must provide written notice to the applicant within 30 days of receipt of the application, clearly and specifically delineating all missing documents or information. Such delineated information is limited to documents or information meeting the standard under paragraph (c)(I)of this section. (ii)The timeframe for review begins running again when the applicant makes a supplemental submission in response to the State or local government's notice of incompleteness. (iii)Following a supplemental submission,the State or local goverment will have 10 days to notify the applicant that the supplemental submission did not provide the information identified in the original notice delineating missing information. The timeframe is tolled in the case of second or subsequent notices pursuant to the procedures identified in this paragraph (c)(3).
