Building Department files contain no records of a fence permit issued for the subject property. It is possible that the fence pre-dates the Village's fence permitting requirements which were adopted in 1994. The file contains a property survey dated, 8/10/95 which shows an existing fence around the rear of the property. The survey shows the fence encroaches onto the neighboring property to the north. Unfortunately, the Building Department does not know when the subject fence was installed. Additionally, the Building Department does not manipulate permits to suit a given narrative or for any other reason without substantial authoritative proof. The fact is the record contains no permit for the fence, nor information as to the installation date. The survey shows that the fence encroaches over the property line onto the neighbor's property at the north elevation. Even if you were to file an application now to legalize the fence the Building Department would be powerless to issue a C/O until either the encroachment was removed, or a legal easement agreement was entered into between both affected property owners. So the house is under contract, and the buyers attorney has raised the question as to whether the fence has a C of 0. Seems like maybe it was installed in connection with an above ground pool back in 1995? 1 think Laura sent you the survey and pool C of 0. I bought the house in 2007 and had the pool removed since I had young kids. I guess the question is can you amend the pool C of 0 to include the fence?Or provide something that satisfies the attorney?
