Mr. Espinosa,
Upon further review of the code it is my opinion that Village Code§186-5.A.(3)does apply to any bed,cab,or frame
mounted removable mechanical snow removal/treatment equipment such as a snowplow,salter/sander, brine spreader,
or any other such removable mechanical equipment temporarily mounted to a code compliant vehicle intended solely for
the removal of snow or treatment of roadways,driveways,parking lots or other such surfaces to mitigate the effects of
snow and ice. I have included the specific language of the code below for your review.
Please note that in order for my opinion to be codified into law,the Village Board of Trustees must first agree with my
opinion and ultimately approve a modification of the language of the code. In the meantime I have spoken with the
Police Department and have made them aware of this issue and of my opinion.As such and until such time as the Board
of Trustees rules on this matter one way or the other,please feel free to mount the snowplow to your pickup truck and
park such vehicle on your property in the designated parking space between November 15 and April 15.
Please note that all other regulations in this regard still apply, and that it is unlawful to park any vehicle on a front lawn
at any time.

§ 186-5 Commercial vehicles. [Added 2-9-1994 by L.L. No. 2-1994,11]
A. Prohibition.
There shall be no off-street parking or storage in any residential district of any of the following:
(1) Vehicles with commercial plates.
(2)Any vehicle displaying a commercial message or business advertisement visible from the outside of the
vehicle.
(3)Vehicles with visible tools or equipment, other than snowplows between November 15 and April 15.
(4) Vehicles with a gross vehicle weight(G.V.W.R.) in excess of 9,000 pounds.
B. Exceptions.
The restrictions of Subsection A of this section shall not apply to:
(1)Any vehicle with a G.V.W.R. less than 9,000 pounds, a height of less than eight feet and a length of 22 feet
or less,provided that said vehicle displays no commercial message,tools or equipment visible from outside the
vehicle. However, no more than one livery vehicle shall be permitted per site.

(2)Not more than one vehicle described in Subsection B(1), but displaying a commercial message or having
tools or equipment visible from the outside, so long as such vehicle is garaged in a fully enclosed structure.

,&(3;Vehicles Snaking deliveries, service calls or rendering emergency services to or at a residence while the
operator is engaged in such activity on the premises.
(4)Recreational vehicles, boats and trailers, as defined in § 186-6 of this chapter,and junked motor vehicles, as
defined in § 186-7 of this chapter, which vehicles, boats and trailers shall be regulated by such sections.

1034:01/29/2020 05:54 - 47 observed a vehicle bearing NY Commercial Reg.
82509MK parked in the driveway of 50 Bowman overnight. The driveway for
this residence is located on Osbourne P1. The vehicle is described as a
black Chevrolet with a yellow box marked "Snow Ex" in the back. . The
vehicle was observed parked at this location at 0200 hrs. and was still
there at 0544 hrs. Police photos were taken with camera 1 at 0550 hrs.
